DECLARATION
of 16 December 2016
on a procedure for granting a subsidy from the State Budget to take measures to reduce the level of radiation from the presence of radon and its products in the internal air of buildings for housing and residence for the public and to take measures to reduce the content of natural radionuclides in drinking water intended for public use
The Ministry of Finance provides, pursuant to § 237 (2) of Act No. 263 / 2016 Coll., Atomic Act, for implementation of § 103 (6) (b) to (d) of this Act:
Subject matter
This decree provides
(a) the procedure for receiving applications for grants from the State Budget for the adoption of a reasoned measure to reduce the level of exposure from the presence of radon and its conversion products in the internal air of buildings for housing or residence to the public, or measures to reduce the content of natural radionuclides in drinking water intended for public use (hereinafter referred to as "the application");
(b) the procedure for facilitating the regional subsidy;
(c) the particulars of the application and the time limits for its submission.
Forms of application
(1) The requirements of the application are:
(a) the identification details of the owner referred to in the legislation governing the conditions for granting the subsidy from the State Budget in certain exposure situations (hereinafter referred to as "the applicant"), which are the names and, where applicable, surnames, date of birth, address of residence, natural person, and identification number, if assigned, or name, registered office and identification number, in the case of a legal person;
(b) a bank connection if the subsidy is to be paid through a transfer of funds;
(c) identification of the building in which the measure referred to in Article 1 (a) is to be implemented to reduce the exposure rate from the presence of radon and its products of transformation in the indoor air of buildings for housing or residence to the public, or measures to reduce the content of natural radionuclides in drinking water intended for public use (hereinafter referred to as "measures"), as indicated in the property register;
(d) an indication of the current use of the construction,
(e) an indication of the results of the volume activity measurement of radon,
(f) an indication of the expected costs of the implementation of the measure and the amount required;
(g) the period within which the measure will be implemented;
(h) for the applicant, in the case of a legal person, identification information
1. persons acting on behalf of the applicant, stating the reason on the basis of which he is entitled to act or on the basis of power of attorney;
2. persons with a share in the applicant;
3. the persons in which the applicant has a holding and the amount of that holding;
(i) the contact details of the applicant, which are the telephone and electronic address or identification of the data box.
(2) The application shall include:
(a) a proof of ownership of the building in which the measure referred to in paragraph 1 (a) is to be implemented, which is an extract from the cadastral of real estate not more than 3 months of age, or proof of ownership of the water pipeline for public use;
(b) proof of the results of measurements of the volume activity of radon not more than 3 years old;
(c) the budget of the envisaged costs and project documentation to the extent appropriate to the construction law by type and scope of the measure; the owner of the apartment in the apartment or family house presents project documentation only if he exceeds the average of the volume activity values of radon from all living rooms and kitchen apartments at the usual use of 3,000 Bq / m3,
(d) a declaration by the applicant of ownership of the public water pipeline, unless he has proof of ownership;
(e) a declaration by the applicant or a document certifying that the residence in the apartment or family home is the residence of another person, if the applicant has another residence.
Procedure for receipt and transmission of applications
(1) The application for a subsidy for the calendar year in question is accepted by the Regional Authority, in whose administrative area the construction referred to in Article 2 (1) (c) is carried out by 30 September of the calendar year in question.
(2) The Regional Authority, with its opinion and approval of the State Nuclear Safety Authority pursuant to the Atomic Act (2), shall forward the applications to the Ministry of Finance (hereinafter referred to as the Ministry) no later than 31 October of the year in which the subsidy is to be granted.
(3) The model of the application is set out in the Annex to this Decree and is also accessible in a way that allows remote access through the Public Administration Portal.
Procedure after implementation of the measure
(1) After the implementation of the measure, the applicant shall provide the Regional Authority with proof of the results of the control measurements demonstrating the effectiveness of the measures implemented, and
(a) a detailed item budget, broken down by delivery and installation;
(b) documents proving the actual amount of costs effectively incurred; and
(c) the consent of the State Nuclear Safety Authority to the measure implemented.
(2) The Regional Authority shall examine the documents referred to in paragraph 1 and transmit them, including the approval of the State Nuclear Safety Authority, with the action taken by the Ministry.
The subsidy may be granted after demonstrating compliance with the conditions laid down in the legislation governing the conditions for granting the subsidy from the State Budget in certain exposure situations (3) by means of control measurements.
Transitional provision
Applications submitted before the date of entry into force of this Order shall be assessed in accordance with Decree No. 461 / 2005 Coll., as effective before the date of entry into force of this Order.
Efficacy
This Decision shall enter into force on 1 January 2017.
