of 17 December 2012
on the specification of individual essential services and basic quality requirements for their provision
The Czech Telecommunications Authority provides pursuant to § 41 of Act No. 29 / 2000 Coll., on Postal Services and on the amendment of certain laws (Act on Postal Services), as amended by Act No. 221 / 2012 Coll., for the implementation of § 3 (3) of the Postal Services Act:
BASIC PROVISIONS
Definition of terms
For the purposes of this decree:
(a) an establishment by post in which the holder of the postal licence himself or through a third party provides and provides all the essential services contained in his postal licence and which is necessary to fulfil the conditions of availability and density referred to in Article 14;
(b) a fully contiguous part of the territory of the municipality, which is clearly separated from other buildings in the surrounding area, the construction of several neighbouring municipalities directly linked to each other being considered as one housing unit; However, separate objects or places with minimum installation shall not be considered as a housing unit;
(c) a designated foreign operator notified by a member country to the World Postal Union as an operator which is obliged to participate in the provision of a basic service abroad in the territory of that country or to provide basic foreign postal services.
TECHNICAL SPECIFICATIONS OF BASIC SERVICES
Postal delivery service up to 2 kg
(1) When providing a service of delivery of mail up to 2 kg, the operator shall not confirm receipt of the mail and the consignee shall not confirm receipt. No compensation shall be granted in the event of loss, damage or loss of the contents of the postal consignment. The place of delivery is in the Czech Republic or abroad.
(2) In the case of the service referred to in paragraph 1, the weight of the postal consignment shall not exceed 2 kg and its dimensions shall be at least 14 x 9 cm. The maximum size of the postal consignment shall not exceed 60 cm and the sum of all three dimensions shall be 90 cm.
Postal parcel delivery service up to 10 kg
(1) When providing the service of delivery of mail packages up to 10 kg, if the place of delivery
(a) in the Czech Republic, the operator does not confirm the receipt of the mail and the recipient does not confirm its receipt. No compensation shall be granted in the event of loss, damage or loss of the contents of the postal consignment;
(b) abroad, the operator shall confirm the receipt of the postal consignment and the consignee shall confirm its receipt. In the event of loss, damage or loss of the contents of the postal consignment, compensation shall be granted to the extent agreed in the postal contract.
(2) In the case of the service referred to in paragraph 1 (a), the weight of the postal consignment
(a) exceeds 2 kg and does not exceed 10 kg and its dimensions are at least 14 x 9 cm; or
(b) it does not exceed 2 kg and at the same time one of the dimensions of the postal consignment exceeds the dimensions laid down for the postal consignment up to 2 kg in accordance with the second sentence of Paragraph 2 (2).
(3) In the case of the service referred to in paragraph 1 (b), the weight of the postal consignment shall not exceed 10 kg and its dimensions shall be at least 14 x 9 cm.
(4) The maximum size of the postal consignment referred to in paragraph 2 (a) or (b), the place of delivery of which is in the Czech Republic, does not exceed 240 cm and the sum of all three dimensions is 300 cm. In the case of mail to be delivered abroad, its largest dimensions correspond to the dimensions determined by the designated foreign operator or by the foreign operator with which the operator has a contract.
Service of delivery of cash by postal voucher
(1) The service of delivery of the cash amount by the postal voucher includes the postal cash voucher - cash, postal voucher account - cash and postal voucher - account.
(2) When providing a postal cash voucher service, the cash amount shall be transmitted to the operator in cash or by transfer of funds to which the payment order is given by means of a payment card, and its receipt shall be confirmed by the operator. Payment of the cash amount shall be made in cash and the recipient shall confirm receipt of the cash amount. The place of delivery is in the Czech Republic or abroad.
(3) When providing a postal voucher account - cash is transmitted to the operator by a cash transfer of funds without cash, with the exception of the transfer of funds for which the payment order is given by means of a payment card, and the operator confirms its receipt. Payment of the cash amount shall be made in cash and the recipient shall confirm receipt of the cash amount. The place of delivery is in the Czech Republic.
(4) When providing a postal cash voucher service, the cash amount shall be transferred to the operator in cash or by transfer of funds to which the payment order is given by means of a payment card, and its receipt shall be confirmed by the operator. The payment of the cash amount shall be made by means of an uncash transfer of funds and the recipient shall confirm receipt of the cash amount. The place of delivery is in the Czech Republic.
Service of delivery of recommended consignments
(1) When providing the service of delivery of the recommended consignments, the operator shall confirm receipt of the mail and the consignee shall confirm receipt of the mail. The place of delivery is in the Czech Republic or abroad. In the event of loss of the postal consignment, compensation shall be granted on a flat-rate basis and in the event of damage or loss of the contents of the postal consignment, the compensation shall be granted up to the amount determined by the consignor or the amount agreed for such cases in the postal contract. If the place of delivery of the postal consignment is in the Czech Republic, the flat-rate amount of compensation shall be at least twenty times the price for this service for consignments of the lowest weight category. Where the place of delivery of the postal consignment is abroad, the amount of the flat-rate compensation shall be equal to the value corresponding to 30 International Monetary Fund units of special drawing rights according to the average rate declared by the Ministry of Industry and Trade for the relevant calendar year in the Postal Bulletin.
(2) In the case of the service referred to in paragraph 1, the weight of the postal consignment shall not exceed 2 kg and its dimensions shall be at least 14 x 9 cm. The maximum size of the postal consignment shall not exceed 60 cm and the sum of all three dimensions 90 cm.
(3) The service of delivery of the recommended consignment shall ensure that:
(a) duplicates which are meant to secure a written certificate for the consignor proving the delivery of the postal consignment to the consignee;
(b) delivery into their own hands which means that the postal consignment will be delivered:
1. where the addressee is a natural person, only to the addressee, the addressee's agent, the legal representative of the addressee or the agent of the legal representative of the addressee,
2. where the addressee is a legal person, only the entitled person,
(c) the supply to their own hands only to the addressee, which means that the postal consignment addressed to the natural person will only be delivered to the addressee.
(4) Where the place of delivery of the postal consignment is abroad, the service referred to in paragraph 3 shall be provided only if the designated foreign operator or foreign operator with whom the operator has a contract so permits.
Security parcel delivery service
(1) When providing a security delivery service, the operator shall confirm receipt of the postal consignment and the consignee shall confirm receipt. In the event of loss, damage or loss of the contents of the postal consignment, compensation shall be granted up to the value declared, which shall be the amount determined by the consignor or agreed in the postal contract for the amount of compensation. The maximum amount of the declared value may be limited by the operator, but for a postal consignment whose delivery point is in the Czech Republic, it must not be limited to less than CZK 1 000 000. The place of delivery is in the Czech Republic or abroad.
(2) In the case of the service referred to in paragraph 1, the weight of the postal consignment shall not exceed 10 kg and its dimensions shall be at least 14 x 9 cm. The maximum size of the postal consignment, the place of delivery of which is in the Czech Republic, does not exceed 240 cm and the sum of all three dimensions is 300 cm. For mail to be delivered abroad, its largest dimensions correspond to the dimensions determined by the designated foreign operator or by the foreign operator with which the operator has a contract.
Service for free delivery of mail up to 7 kg for blind persons
(1) In the case of a service free of charge for delivery of mail up to 7 kg for blind persons, the place of delivery of mail in the Czech Republic or abroad is.
(2) As the content of the postal consignment when providing the service referred to in paragraph 1, only items for the use of the blind person shall be authorised, which mean a document drawn up in tangible letters for the blind persons, publications, including phonograms for the personal use of the blind person or other objects adapted for the use of the blind person, provided that the consignor or addressee is a blind person or a legal person whose activity is the provision of services to the blind persons or the satisfaction or protection of their interests. For the purposes of this decree, a non-visible person shall mean a person with a strong or severe fainting or a person with a practical or complete blindsight (5). The consignment shall be packed in such a way that it is possible to test its contents without breaching the package. The weight of the postal consignment does not exceed 7 kg. The dimensions of the postal consignment are at least 14 x 9 cm. The maximum size of the consignment shall not exceed 60 cm and the sum of all three dimensions shall be 90 cm.
(3) When providing a service free of charge for delivery of mail up to 7 kg for blind persons, the operator shall not confirm receipt of the mail and the consignee shall not confirm receipt of the mail. No compensation shall be granted in the event of loss, damage or loss of the contents of the postal consignment.
(4) The service of free delivery of mail up to 7 kg for blind persons includes delivery of recommended mail. Where delivery of the recommended consignment is required by the consignor in the course of this service, the operator shall confirm receipt of the mail and the consignee shall confirm receipt of the consignment. In the event of loss of the postal consignment, compensation shall be granted on a flat-rate basis and in the event of damage or loss of the contents of the postal consignment, the compensation shall be granted up to the amount determined by the consignor or the amount agreed in the postal contract. If the place of delivery of the postal consignment is in the Czech Republic, the flat-rate amount of compensation shall be at least twenty times the price for the service of the recommended consignments in accordance with § 5 of the lowest weight category. Where the place of delivery of the postal consignment is abroad, the amount of the flat-rate compensation shall be equal to the value corresponding to 30 International Monetary Fund units of special drawing rights according to the average rate declared by the Ministry of Industry and Trade for the relevant calendar year in the Postal Bulletin.
(5) The duty-free service referred to in paragraphs 1 to 4 need not apply to the air transport surcharge.
Basic foreign postal services
When providing a basic foreign postal service, the delivery of a postal consignment or the amount of money required under a foreign postal service, which by its nature is similar to one of the essential services referred to in Sections 2 and 3, Sections 4 (2), 5 to 7 and 12, shall be ensured. In the case of postal services for which a delay can be negotiated [Paragraph 5 (3) (a)], provision of that service shall be made.
Postal parcel delivery service over 10 kg submitted abroad
The service of delivery of mail packages over 10 kg submitted abroad shall include delivery of mail packages weighing more than 10 kg but not more than 20 kg, within the framework of a foreign postal service agreed with the designated foreign operator.
International response service
The international response service shall provide for the exchange of an international response issued by the International Office of the World Postal Union and purchased in any Member State of the World Postal Union for postage stamps of nominal value equivalent to the lowest price for the service of delivery of the mail referred to in Article 2 carried abroad in the fastest manner, regardless of the country of destination.
Services of mail in international contact
(1) The international service of responsible mail allows payment of the postal service price on delivery of a postal consignment of not more than 50 g under the basic postal service referred to in Article 2, whose place of delivery is abroad, in the event that the foreign addressee has undertaken to pay the delivery price to the designated foreign operator.
(2) The service referred to in paragraph 1 is provided for responsible consignments sent back abroad.
Printed bag delivery service
(1) For the delivery service of the printing bag, the place of delivery of the mail is abroad.
(2) Only printed matter which means newspapers, periodicals, books and similar printed documents shall be authorised as the content of the postal consignment when providing the service referred to in paragraph 1. The weight of the postal consignment shall not exceed 30 kg.
(3) When providing a delivery service for a printing bag, the operator shall not confirm receipt of the postal consignment and the consignee shall not confirm receipt. No compensation shall be granted in the event of loss, damage or loss of the contents of the postal consignment.
(4) The delivery service of the printing bag includes delivery of the recommended printing bag. In this case, the operator shall confirm receipt of the postal consignment and the consignee shall confirm receipt. In the event of loss of the postal consignment, compensation shall be granted on a flat-rate basis and in the event of damage or loss of content, the compensation shall be granted up to the amount determined by the consignor or the amount agreed in the postal contract. The amount of the flat-rate compensation corresponds to a value corresponding to 150 accounting and monetary units of the International Monetary Fund of special drawing rights according to the average rate declared by the Ministry of Industry and Trade for the relevant calendar year in the Postal Bulletin.
Official service of documents
In particular, the basic services shall allow delivery to their own hands, delivery to their own hands only to the addressee, the provision of a copy, the determination of the time limit for the deposit of the postal consignment and the exclusion of any change in the place of delivery, according to the requirements of other legislation governing the rules governing the official service of documents, in particular in criminal, administrative, tax and judicial proceedings (1) or laying down binding rules for the service of documents in other cases (6).
BASIC QUALITATIVE REQUIREMENTS
Availability and density of post offices
(1) Sufficient availability of post offices is ensured if the total number of post offices corresponds to the number of premises laid down by the Government Decree pursuant to § 3 (2) (a) of the Postal Services Act.
(2) Sufficient mail density is ensured when the mail is operated
(a) in each municipality having 2,500 inhabitants or more,
(b) in each municipality which has less than 2,500 inhabitants and in which the post office is operated on the date of entry into force of this decree and at the same time there is a matrix office2), a general building authority (3) or a primary school with a first and second degree;
(c) in municipalities, so that the distance from any point in the municipality in the Czech Republic to the post office does not exceed 10 km;
(d) in such a way that the distance from any place other than the territory serving exclusively a purpose other than housing in a municipality with more than 2,500 inhabitants does not exceed 3 km by air line to the post office.
(3) The requirement under paragraph 2 (c) need not be met for 5% of the population located in the territory for which the post office ensures availability, provided that the availability of basic services is ensured by other appropriate means.
(4) The requirement under paragraph 2 (d) need not be met for 5% of the population of the population of municipalities with more than 2,500 inhabitants, provided that the requirement under paragraph 2 (c) is met.
(5) The post office referred to in paragraph 2 shall be made available to the public each working day in such a way that the sum of the opening hours is at least 15 hours per week, having 5 working days. Posts in excess of the number determined in accordance with paragraph 2 shall be made available to the public each working day in such a way that the sum of the opening hours is at least 10 hours per week with 5 working days.
Availability of mailboxes
(1) Sufficient density of mailboxes is ensured if:
(a) in each housing unit with a maximum population of 10 000, there shall be a number of mailboxes for each and every 1 000 inhabitants to have at least one mailbox. This requirement need not be met if the requirement under point (b) is met;
(b) in each of the housing units with more than 10 000 inhabitants, the number of mailboxes shall be such that the distance from any part of the housing unit, except for marginal parts with significantly less density, does not exceed 1 km to the nearest mailbox.
(2) Postage boxes must be located primarily in those places where residents of the building regularly arrive for another reason, in particular at shopping centres or near public transport stops.
(3) Postage boxes must be selected every working day.
Exceptional cases where delivery to the address of each natural and legal person may not be ensured
(1) Delivery to the address of each natural or legal person need not be ensured if:
(a) travel to a place designated at or delivered at the post office is linked to reasonable concerns about the danger of life, health or property or property held by the operator;
(b) the place of delivery is located outside the premises and is not available after publicly accessible infrastructure or is only available after publicly accessible special purpose communication, the technical condition of which makes it impossible for the operator to supply even if all efforts are made; or
c) the postal consignment is worth more than CZK 150,000, or the amount of money required exceeds CZK 150,000.
(2) The use of the exemption provided for in paragraph 1 (a) and (b) must be notified in writing to any natural person who is present at the site and to any legal person who has his registered office or establishment at the site and to the Office. The notification referred to in paragraph 2 shall be made within 3 months of the date of issue of the postal licence and, in any subsequent case, at least 1 month before the date from which the exemption provided for in paragraph 1 (a) and (b) is to be used, or without delay after an unforeseeable event has occurred which is the reason for making use of the exemption provided for in paragraph 1 (a) and (b).
(3) The notification referred to in paragraph 2 shall include an invitation to choose, except for the person concerned, another appropriate means of delivery, in particular:
(a) supply to the supply closet;
(b) supply elsewhere; or
(c) the deposit of the postal consignment or the amount of money required at the premises of the holder of the postal licence.
In the case referred to in point (a), the operator shall bear the costs of setting up the supply closet.
Extension of the deadline
(1) At the request of the addressee in writing of any post office, the time limit for the collection of the mail or the amount of money required for the addressee shall be extended to the establishment within the period specified in the application. The receipt of this request is confirmed on request.
(2) At the request of the addressee applied to the establishment where the postal consignment or the amount of money required is stored, the time limit for the collection of the postal consignment or the amount of money required shall be extended.
(3) The time limit referred to in paragraphs 1 and 2 cannot be extended if this is contrary to the postal contract concluded with the consignor.
(4) The request referred to in paragraph 1 may not be granted or may not be made if, in the light of the circumstances, it would not be possible to clearly identify the postal consignments and the amounts of money referred to in the application. The applicant shall be informed in writing of such a procedure without delay.
(5) The acts referred to in paragraphs 1 and 2 form part of the postal service provided by the consignor under a signed postal contract.
Change of storage post
(1) At the request of the addressee in writing, the postal consignment or the amount of money required to be collected shall be deposited with another addressee of the chosen establishment. The receipt of this request is confirmed on request.
(2) At the request of the addressee, applied to the establishment where the postal consignment or the amount of money required is stored, a stored postal consignment or the amount of money required to be collected at an establishment other than the original establishment shall be prepared.
(3) Requests pursuant to paragraphs 1 and 2 may not be granted or may not be made in cases where the requested change in the storage post would be accompanied by disproportionate complications, or where, in view of the circumstances, it would not be possible to clearly identify the postal consignments and the cash amounts referred to in the application. The applicant shall be informed in writing of such a procedure without delay.
(4) The acts referred to in paragraphs 1 and 2 form part of the postal service provided by the consignor under a signed postal contract.
Change of place of delivery
(1) Following a written request from the addressee to any post office, the postal consignment or the amount of money required shall be delivered at a place other than that indicated in the postal address (hereinafter referred to as "delivery '). The receipt of this request is confirmed on request.
(2) A delivery may not be made if this is contrary to the postal contract concluded with the consignor or if, in view of the circumstances, it would not be possible to clearly identify the postal consignments and the amounts of money referred to in the application.
(3) The delivery may be terminated at any post office on the basis of its written appeal by the addressee. On request, the appeal is confirmed. The delivery may also be terminated by the operator if, in view of the changed circumstances, it would no longer be possible to clearly identify the postal consignments and the cash amounts to be sent. The applicant shall be informed in writing of such a procedure without delay.
Exclusion of replacement delivery
(1) Where a replacement supply consisting of the issue of a postal consignment or the amount of money referred to is made available to another appropriate natural person who agrees to forward the postal consignment or the cash amount to the addressee, it shall be possible at the same time to exclude that method of delivery on the basis of a written request from the addressee to any post. The receipt of this request is confirmed on request. The procedure according to the application is part of the postal service provided by the sender under a closed postal contract.
(2) Where, in the light of the circumstances, it would not be possible to clearly identify the postal consignment or the amount of money referred to in paragraph 1, any postal consignment or the amount of money which could be affected by such an application shall be excluded from the replacement delivery. The applicant shall be informed in writing of such a procedure without delay.
Withdrawal
(1) Following a written request from the addressee, postal consignments or money amounts shall be deposited at the agreed establishment without attempted delivery to the addressee's address. The removal cannot be negotiated in cases where this would be contrary to the postal contract concluded with the consignor. The procedure according to the application is part of the postal service provided by the sender under a closed postal contract.
(2) The request referred to in paragraph 1 may not be granted or may not be made if, in the light of the circumstances, it would not be possible to clearly identify the postal consignments and the amounts of money referred to in the application. The applicant shall be informed in writing of such a procedure without delay.
Speed of basic services
(1) For the basic service referred to in Article 2, the transport times of mail of up to 50 g shall be measured. When measuring transport times, at least 92% of mail delivered on the first working day following the date on which their postal submission was made shall be obtained per calendar year.
(2) The measurement of the transport times referred to in paragraph 1 shall be carried out according to the method contained in the Czech technical standard, which includes the method of measuring the transport time of the services between the end points for each postal consignment (4), and the methodology for carrying out the measurements specifying the general requirements laid down in this Czech technical standard, the use of which is considered to have been carried out and the result of the measurements is eligible for verification. The methodology for carrying out measurements according to the previous sentence shall be subject to prior approval by the Office.
(3) The results of the measurement of transport times, including all supporting documents of the measurement result, shall be transmitted to the Audit Office no later than 45 days after the date of completion of the measurement referred to in paragraph 1.
Information on mailboxes
Each mailbox shall bear an information label indicating the time of selection of the mailbox, the name of the establishment which ensures the selection of the mailbox, its address and telephone number, the price of the basic services that are applicable to the service referred to in Article 2, if:
(a) the weight of the national postal consignment does not exceed 200 g;
(b) the weight of the postal consignment abroad does not exceed 50 g.
Information on opening times
(1) Information on opening times of the establishment must be provided at the entrance to the establishment where the essential services are provided in such a way that this information is visible even when the establishment is closed.
(2) The information referred to in paragraph 1 shall include an indication of which mail in the vicinity provides the essential services at a time when the local establishment does not provide them and what its opening hours are.
Information available on request or published at post offices
Information on:
(a) post offices and other establishments, including their postal routing numbers, addresses, opening times, telephone numbers, the way in which persons are operated in a wheelchair for disabled persons and persons carrying a stroller with a child, and a distinction between whether they are mail or other premises;
(b) the postal routing number for the address indicated;
(c) in cases where delivery to the address of each natural and legal person is not ensured pursuant to Article 16 (1) (a) and (b);
(d) basic services, including the essential characteristics of those services, which are decisive for the competent choice of the consignor, including the price list of the services, in the case of postal services abroad, as well as information covering the designation of the individual countries of destination and, where applicable, their abbreviations, in the form required by the postal conditions, indicative information on the foreign conditions applicable to each country of destination and other information relating to each country of destination, including information on the customs legislation in force in the country of destination, provided that they have been transmitted to the holder of the postal licence and that they may be relevant to those interested in the essential services;
(e) the provisions of the postal conditions relating in particular to the conditions which are necessary for proper delivery at the place specified in the postal address, the alternative delivery options which may be introduced on a proposal from the addressee, the manner in which the holder of the postal licence co-operates with the customs inspection in respect of foreign postal services, as well as an indication of the necessary or possible methods of cooperation between the addressee and the holder of the postal licence in respect of customs controls, the manner in which the infringement of the obligation under the contract concluded or the damage caused, including the time limits in which it is to be carried out;
(f) abbreviations used in the framework of the service provided where users can meet them.
Information available in a way that allows remote access
The means of remote access shall be available on the website of the postal licence holder:
(a) the information referred to in Article 25 (a) to (d) and (f);
(b) information on other appropriate means of securing postal services; if the postal service is an appropriate way of providing a mobile service site, then also details of when and where the mobile service station can be reached and how it can be contacted,
(c) recommended patterns of address writing, in the case of postal services abroad, patterns of proper postal address writing to each country of destination.
Information on changes in the postal network
(1) Where the post office or other establishment of the holder of a postal licence in which one of the essential services contained in his postal licence is to be provided is to be temporarily closed or cancelled, the information on that fact and on the way in which the postal service is made available at that place shall be published in accordance with Article 24 (1) at least 1 month before the date of its intended temporary closure or cancellation, or without delay in cases which the postal licence holder could not have foreseen.
(2) The information referred to in paragraph 1 must be transmitted within the time limit referred to in paragraph 1 in writing to the Office and to the essential local authorities which may be affected by the amendment.
Transitional provision
If the holder of a postal licence pursuant to Article II (2) of Law No 221 / 2012 Coll. intends to close an establishment in which one of the essential services is provided and which is operated on the date of the entry into force of this decree in excess of the requirements under Paragraph 14, he shall, in due time before its conclusion, discuss this intention with the essential territorial authorities which may be affected by the amendment and shall endeavour to ensure the availability of essential services in cooperation with a third party, or to ensure that availability by other appropriate means. Paragraph 27 is not affected by this.
Efficacy
This Decree shall take effect on 1 January 2013.
