DECLARATION
of 4 November 2025
amending Decree No. 425 / 2024 Coll., on agrovoltaic electricity generation
The Ministry of the Environment and the Ministry of Agriculture provides pursuant to § 22 paragraph 3 of Act No. 334 / 1992 Coll., on the Protection of the Agricultural Soil Fund, as amended by Act No. 183 / 2024 Coll. and Act No. 87 / 2025 Coll., for the implementation of § 8a paragraphs 1 and 9 of this Act:
Decree No. 425 / 2024 Coll., on Agrovoltaic Electricity Production, is amended as follows:
1. In Article 1 (c), the words "and equipment used for the storage of electricity from an agrovoltaic electricity plant (hereinafter referred to as the" electricity storage facility ')' shall be inserted after the words "necessary equipment '.
2. In Article 1, the words "and electricity storage facilities' shall be added at the end of the text in point (d).
3. In Paragraph 2 (1), the words "after the implementation of the agrovoltaic electricity plant's intention 'are inserted after the words" may'.
4. In Article 2, the following paragraph 2 is inserted after paragraph 1:
"(2) The agricultural land on which agrovoltaic electricity production is to be located may be the type of agricultural culture of standard arable land after the start of the agrovoltaic electricity production project, provided that at least 90% of the area of the part of the soil block on which the agrovoltaic electricity production is to be located is supported at least once in the preceding three subsidy periods for the production of very high-working vegetables or high-working vegetable species under the Government Regulation on direct payments to farmers. The condition under the first sentence concerning the grant of production aid in successive subsidy periods shall be fulfilled by the share of the land block during the entire period of operation of the agrovoltaic electricity plant. '
Paragraph 2 shall become paragraph 3.
5. In Paragraph 2 (3) of the Introductory Part of the provision, the words "after the implementation of the agrovoltaic electricity plant's intention, temporarily 'shall be inserted after the words" may'.
6. in Article 2 (3) (a):
"(a) the new agricultural culture referred to in paragraph 1 shall be established within a maximum of 2 years from the date of the start of the implementation of the agrovoltaic electricity plant's project;"
7. In Article 2, at the end of paragraph 3, the dot is replaced by "or 'and the following point (c) is added:
"(c) the agricultural culture referred to in paragraph 1 shall be converted into another agricultural culture as referred to in paragraph 1, but only for a maximum period of 2 years from the date of the update of the land register on the basis of the notification of the user pursuant to Article 3g (1) (e) of the Agriculture Act."
8. Paragraph 3 (1) is deleted.
Paragraphs 2 to 5 shall be renumbered paragraphs 1 to 4.
9. In the first sentence of Article 3 (1), the words "horizontal 'shall be deleted, the words" in accordance with the agricultural culture referred to in Article 2' shall be inserted after the words "horizontal agrovoltatic electricity production '.
10. in the first sentence of Article 3 (2), the words "Photovoltaic modules of the vertical agrovoltaic power generation plant must be replaced" shall be replaced by the words "If the agrovoltaic power plant does not meet the requirements of paragraph 1, the photovoltaic modules shall be inserted after the word" area "; the words" ("vertical agrovoltaic power plant") shall be inserted. "
11. in the second sentence of Article 3 (3), the words "above the surface of agricultural land" shall be inserted after the words "these photovoltaic modules."
12. in Article 3 (3), the words "on agricultural land" shall be inserted after the word "areas" and the words "and electricity storage facilities" shall be added at the end of the text of the paragraph.
13. In Article 3, the sentence "The area of agricultural land under the electricity storage facility is not an agricultural area 'is added at the end of paragraph 3.
14. in Article 3, paragraph 4 is deleted;
15. The following Section 3a is inserted after Section 3, including the title:
Agrovoltaic power plant with mobile modules
(1) In the case of a horizontal agrovoltaic power plant with mobile photovoltaic modules, the minimum height of 210 cm above the surface of the agricultural land referred to in Article 3 (1) shall be determined in the horizontal position of the photovoltaic modules or in the nearest horizontal position, excluding the technical solution for turning the photovoltaic modules into a completely horizontal position.
(2) In the case of a vertical agrovoltaic power plant with mobile photovoltaic modules, the width of the spacing between the rows of photovoltaic modules and the distance from the photovoltaic module according to § 3 (2) shall be determined in the vertical position of the photovoltaic modules or in the nearest vertical position, excluding the technical solution for rotation of photovoltaic modules to the fully vertical position. ';
16. At the end of the heading § 4, the words "and electricity storage facilities' are added.
17. in Paragraph 4 (3), the sentence "Pedological research shall be carried out only at the place of the hiding place of the cultural layers of the soil" shall be inserted after the second sentence.
18. In Article 4, the following paragraph 5 is added:
"(5) For electricity storage facilities, paragraphs 1, 3 and 4 shall apply mutatis mutandis. ';
19. In Article 5, the following paragraph 4 is added:
"(4) For electricity storage facilities, paragraphs 1 to 3 shall apply mutatis mutandis. ';
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.
