GOVERNMENT REGULATION
of 29 November 2023
amending Government Regulation No 92 / 2015 Coll., on rules for the organisation of the Office of Staff
The Government orders pursuant to § 205 (a) of Act No. 234 / 2014 Coll., on the Civil Service:
Government Regulation No. 92 / 2015 Coll., on the Rules for the Organisation of the Service Office, is amended as follows:
1. In Paragraph 3 (1), "4 'is replaced by" 6'.
2. Paragraph 3 (2) reads as follows:
"(2) If the average number of systemised departments in the service office is not less than 6 after rounding to an integer, the department may be established if it is at least 4 systemically located. The calculation of the average number of systemised sites forming departments shall not include systemised sites included in the separation pursuant to § 6 (2) and § 7 (2) and in the organisational department pursuant to § 8, if it is a separation. '
3. Paragraph 3 is deleted.
Paragraph 4 shall become paragraph 3.
4. In Article 3 (3), the words "to the Deputy Director for Management 'are replaced by the words" to the Director-General' and the words "to the High Secretary of State 'are inserted after the words" to the Secretary of State'.
5. In Paragraph 4 (1), "10 'is replaced by" 13'.
6. In Paragraph 4, the following paragraph 2 is inserted after paragraph 1:
"(2) If the average number of systemised posts in the service office is not less than 13 after rounding to an integer, the department may be set up if it consists of at least 9 systemically located locations including at least 2 systemically located units of the head of department or at least 1 systemically located department head and at least 2 systemically located places directly subordinate to the head of department. The calculation of the average number of systemised sites forming the department shall not include the systemised sites included in the section referred to in paragraphs 3, 6 (1) and 7 (1) and in the organisational unit referred to in paragraph 8, if it is a trade union. ';
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
7. in Article 4 (3) (b) and (c):
'(b) part of a non-national office; or
(c) part of an official office whose organisational structure is always approved by the head of the staff; ';
8. In Article 4 (3) of the final part of the provision, the number "7 'is replaced by" 9' and the words "or at least 1 systematic post of Head of Department and at least 2 systematic places directly subordinate to the Head of Department 'are inserted after the word" separation'.
9. Paragraph 4 (4) and (5) are deleted.
Paragraph 6 shall become paragraph 4.
10. in Article 4 (4), the words "to the Deputy Director for Management" shall be replaced by the words "to the Director-General" and the words "to the High Secretary of State" shall be inserted after the words "to the Secretary of State";
11. in Article 5 (1), "37" is replaced by "40," the words "to the Deputy Director for Management" shall be replaced by "the Director-General" and, at the end of the paragraph, the sentence "The minimum number of systematic positions of the directors of trade unions or heads of departments shall not include the systematic place of head of the head office of the Director-General of the Section, if the office of the Director-General of the Division is the office of the departments."
12. in Article 5 (2), the words "the Secretary of State or" shall be inserted after the words "the head office."
13. in Article 5, paragraphs 3 and 4 are deleted;
Paragraph 5 shall become paragraph 3.
14. in Article 5 (3), the words "Deputy Director" shall be replaced by the words "Director-General";
15. In Article 6, at the end of paragraph 2, the sentence "Paragraph 3 on the minimum number of systematic posts shall not apply to the department of the representative office."
16. in Article 6 (3), the words "to the Deputy Director for Management" shall be replaced by "to the Director-General."
17. in Article 7, the following paragraphs 1 and 2 are inserted:
"(1) The cabinet of a member of the Government shall have the status of department. Paragraph 4 on the minimum number of systematic posts shall not apply to the cabinet of a member of the government.
(2) The cabinet of a member of the government may be divided into departments. Paragraph 3 on the minimum number of systematic posts shall not apply to the cabinet of a member of the government. '
Paragraphs 1 to 3 shall become paragraphs 3 to 5.
18. in Article 7 (3), the word "Cabinet" shall be replaced by "Director of Cabinet."
19. in Paragraph 8 (3), the words "Deputy Director" shall be replaced by the words "Director-General" and the words "Deputy Director-General" shall be replaced by "Director-General."
20. In Paragraph 8, the following paragraph 4 is inserted after paragraph 3:
"(4) In the Civil Service section, it is possible to set up an office of the Secretary-General of the State, which is in particular an organisational body ensuring the support of the Secretary-General of the State in the performance of his management activities. The head of the office of the Secretary-General of the State shall be under the direct authority of the Secretary-General of the State. '
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
21. Article 9 shall be deleted;
22. in Article 11 (1), the word "State" shall be inserted after the word "cases."
23. in Article 11 (2), the words "property, economic," shall be inserted after the words "organisational."
Transitional provision
The section set up before the date of entry into force of this Regulation with a lower number of systemised places than those provided for in Section 5 (1) of the Government Regulation No. 92 / 2015 Coll., as effective from the date of entry into force of this Regulation, shall bring the service office into line with this Regulation, together with the first substantial change in its scope.
Efficacy
This Regulation shall take effect on 1 July 2024.
