ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 16 November 2020
on the adoption of crisis measures
Following Resolution No. 957 of the Government of the Czech Republic of 30 September 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic because of a health threat related to the detection of coronavirus / referred to as SARS CoV-2 / in the territory of the Czech Republic, and within the meaning of § 5 (a) to (e) and § 6 of Act No. 240 / 2000 Coll., on crisis management and amending certain laws (emergency law), as amended, for the resolution of a crisis situation, the adoption of a crisis measure, by virtue of § 5 (c) and § 6 (1) (c) of the Crisis Act.
Government with effect from 17 November 2020 at 00am
I. imposes on critical infrastructure bodies within the meaning of § 2 (k) of the Crisis Act and their contractors directly involved in ensuring the operation of the Critical Infrastructure Component within the meaning of Government Regulation No. 432 / 2010 Coll., on criteria for determining the Critical Infrastructure Component, as amended, to take the necessary measures to ensure the operation of the Critical Infrastructure Component under this Crisis Measure;
II. imposes on critical infrastructure bodies which are the operators of one or more critical infrastructure elements in one of the sectors referred to in Articles I, II, V and VI as listed in the Annex to Government Regulation No 432 / 2010 Coll., on criteria for determining the critical infrastructure element, as amended,
1. identify their contractors which are necessary to ensure the operation of the critical infrastructure elements concerned ("the necessary supplier") and, in agreement with them, ensure their synergies in the operation of the critical infrastructure elements concerned;
2. keep up-to-date list of necessary suppliers;
3. regularly transmit the list of necessary suppliers, but at least once a month, to the Ministry or to another central administrative office to which the construction, installation, means or public infrastructure of the operator has been designated as critical infrastructure elements under the Crisis Act;
III. Orders natural persons designated by a critical infrastructure entity within the meaning of § 2 (b). (k) the Crisis Act and natural persons designated by the contractors of critical infrastructure entities directly involved in ensuring the operation of the critical infrastructure element, taking into account their real role in providing the function of critical infrastructure element within the meaning of Government Regulation No 432 / 2010 Coll., on criteria for determining the critical infrastructure element, as amended; for the purposes of this resolution, critical infrastructure entities and contractors of a critical infrastructure entity within the meaning of this paragraph of the resolution are hereinafter referred to as "the legal person concerned 'and critical staff within the meaning of point III of the Government of the Czech Republic Resolution of 30 September 2020 No 957, published under No 391 / 2020 Coll., are hereinafter referred to as" natural persons' for the purposes of this resolution:
1. Remain at a time when a natural person can be ordered to work exclusively at places designated by the legal person concerned, except:
(a) journeys strictly necessary to procure their own basic needs;
(b) travel to medical facilities strictly necessary for the provision of urgent health services to a natural person;
(c) journeys strictly necessary to deal with their own urgent official affairs;
where, in the cases referred to in points (a) to (c), a natural person is required to notify each such journey in advance to the legal person concerned and, where such prior notification is not possible, to notify the legal person concerned of the journey as soon as possible;
2. in the event that they have been notified, on the basis of the epidemiological investigation carried out, that they have been in close contact with a person who has been confirmed with COVID-19 ("risk contact"), without delay inform the legal person concerned,
3. respect the decision of the legal person concerned on the distribution of the obligation to work made under point VII. of this resolution;
IV. orders all the legal persons concerned:
1. ensure that all natural persons who have been ordered in accordance with point III at the time when they may be required to work. the order to stay in a place other than their place of residence, free decent accommodation and other necessary living conditions, including ensuring:
(a) the basic needs of those natural persons;
(b) adequate contact between such natural persons and family and close persons;
(c) the care of persons who are close to the natural person or of animals kept by the natural person who would normally be provided by that natural person in person and by that natural person as a result of restrictions on the freedom of movement referred to in point III. the resolution cannot be properly executed at the request of that natural person;
(d) the management of the assets of the natural person by that natural person due to the restriction of freedom of movement referred to in point III. the resolution cannot be properly executed at the request of that natural person;
2. to ensure the conditions for natural persons under point III / 2 of this resolution who have had risk contact so that such natural persons can comply with all the rules under this measure,
3. in the event that the legal person concerned finds that the natural person has had a risk contact in accordance with point III / 2 of this resolution, but does not have clinical signs of COVID-19 disease, and decides that the exercise of the work and / or work obligations of the natural person is necessary in view of its effective role in ensuring the operation of the critical infrastructure element operated by the legal person concerned, the legal person concerned and the natural person concerned shall proceed in accordance with point V. of this resolution; the legal person concerned shall notify that fact to the competent public health authority locally;
V. orders the Regional Sanitary Stations and the Sanitary Station of the City of Prague in the event that a natural person has been ordered to take quarantine measures and subsequently has been notified to the competent public health authority at a local level by the legal person concerned of the fact referred to in point IV / 3, amend the quarantine measures in order to enable the work and / or work of the natural person referred to in point VI;
VI. Orders all natural persons without clinical signs that have had risk contact to comply with the following rules for at least 10 days from risk contact:
1. a natural person works with an FFP2 class respirator without an exhalation valve;
2. a natural person uses one FFP2 class respirator for a maximum period of 4 hours;
3. a natural person uses a room for rest and meals without the presence of another person;
4. a natural person works to minimise contact with other persons;
5. the natural person limits the movement of the workplace to the necessary level;
6. at the beginning of work or duty immediately before commencing, a natural person shall measure his body temperature and monitor his or her health continuously with a view to possible clinical signs of COVID-19 disease; in the event of clinical signs of COVID-19 disease, the natural person shall suspend work or work duties without delay and notify the representatives of the legal person concerned;
VII. allows the legal persons concerned:
1. order the work of natural persons in such a way that their personal leave will be at least 105 hours in 3 weeks;
2. draw up a written schedule of duties and make the natural person aware of his or her change not later than 24 hours before the beginning of the period for which the duty is allocated to the natural person.
