on the distribution and collection of detectors for searching for structures with higher levels of radiation from natural radionuclides and laying down the conditions for granting subsidies from the state budget
According to Section 47 (10) of the State Nuclear Safety Authority, for the implementation of § 46a (1) (a) and § 3 (b) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionising Radiation (Atomic Act) and on the amendment and addition of certain laws, as amended by Act No. 320 / 2002 Coll. and Act No. 1 / 2005 Coll.:
§ 1
Subject matter
This decree provides
(a) rules for the distribution and collection of detectors intended to search for structures with higher levels of radiation from natural radionuclides in their internal air (hereinafter "detectors");
(b) the conditions for granting subsidies from the State Budget (1) to identify the risk arising from the presence of radon and its conversion products in the internal air of buildings, to take measures to reduce that risk and to reduce the content of natural radionuclides in drinking water intended for public use (2).
§ 2
Distribution and collection of detectors
(1) Detectors for regional authorities are provided by the State Nuclear Safety Authority ("the Authority"). The regional authority provides distribution and collection of detectors.
(2) Detectors are designed to measure the volume activity of radon in
(a) housing or family homes (3) used permanently for housing;
(b) buildings of schools, school establishments and buildings serving to ensure social or health services in the long term of children and youth;
(c) buildings serving to provide social or health services other than those referred to in (b);
for the construction of which a building permit or a similar permit was issued by 28 February 1991 (hereinafter referred to as "permit ').
(3) The Regional Authority shall ensure that detectors are placed according to the distribution schedule agreed with the Office in the real estate referred to in paragraph 2, in particular in the cadastral territory of the municipalities where a high radon risk can be assumed according to geological forecasting maps.
(4) The collected detectors are transmitted by the Regional Office to the Office, which will ensure the evaluation of the data recorded by the Detectors and then transmit the results of the measurements to the Regional Office.
(5) The Regional Authority shall inform the owner or tenant of the property referred to in paragraph 2 in writing of the results of the measurements and, on the basis of the information provided by the Office, shall provide the owner or lessee with information on possible measures to reduce exposure and the conditions for obtaining a subsidy from the state budget to take measures to reduce exposure from natural radionuclides in the internal air of buildings.
Conditions for granting the subsidy
§ 3
(1) Subsidy for the adoption of measures to reduce the exposure from radon and its conversion products in the indoor air of buildings and natural radionuclides in drinking water may be granted only for the implementation of demonstrably effective measures referred to in paragraph 2 or 3 to the owner of:
(a) an apartment in an apartment or family house used for permanent housing, the construction of which has been authorised if the average of the volume activity values of radon from all living rooms and the kitchen of the apartment is more than 1000 Bq / m3 in the long term,
(b) the buildings of the school, the school establishment and the buildings used to ensure social or health services for the long-term residence of children and young people for whose construction a permit has been issued if, in the atmosphere of a residence room intended for the residence of children and young people, the average of the measured values of the volume activity of radon at the time of their stay is above 400 Bq / m3;
(c) buildings for the provision of social or health services not referred to in point (b) for which a permit has been issued if, in the atmosphere of a residence room, the long-term average of the measured volume activity values of radon under normal use is greater than 1000 Bq / m3;
(d) a public water duct if the content of natural radionuclides exceeds the limits laid down by the specific legislation4).
(2) The reduction of radon content in the building air below 400 Bq / m3 or at least 75% of the original value shall be considered an effective measure to reduce radiation from natural radionuclides.
(3) A reduction of radon and other natural radionuclides below the indicative values laid down by the specific legislation5 is considered to be an effective measure to reduce radiation from natural radionuclides in drinking water intended for public supply.
§ 4
(1) The grant of a grant for measures to reduce radiation from natural radionuclides for the items referred to in Article 3 (1) shall be subject to the presentation of results of measurements of the volume activity of natural radionuclides, project documentation to the extent appropriate to the construction law according to the type and scope of the measures and budget of the envisaged costs. For flats in a residential or family house pursuant to § 3 (1) (a), project documentation shall be provided only if the mean of radon volume activity exceeds 4000 Bq / m3.
(2) The condition for assessing the effectiveness of the measure is the submission of the results of the final measurement of the volume activity values of radon and, where appropriate, of other natural radionuclides which demonstrate that the effectiveness of the measure complies with the condition set out in § 3 (2) or (3). In addition, documentation of the measure implemented, including evidence of the costs incurred in implementing it, shall be provided.
§ 5
Efficacy
This Decree shall take effect on 1 January 2006.
