DECLARATION
of 21 December 2022
amending Decree No. 196 / 2001 of the Ministry of Justice Coll., on the remuneration and replacement of notaries, trustees and notaries of the Czech Republic (notarial tariff), as amended
The Ministry of Justice provides for, pursuant to § 107 of Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended by Act No. 303 / 2013 Coll., and pursuant to § 516 (a) of Act No. 292 / 2013 Coll., on special legal proceedings:
Decree No. 196 / 2001 Coll., on the remuneration and substitutes of notaries, administrators of the estate and notarial chamber of the Czech Republic (notarial tariff), as amended by Decree No. 42 / 2002 Coll., Decree No. 403 / 2005 Coll., Decree No. 399 / 2006 Coll., Decree No. 167 / 2009 Coll., Decree No. 432 / 2013 Coll., Decree No. 162 / 2016 Coll., Decree No. 338 / 2016 Coll., Decree No. 341 / 2020 Coll., Decree No. 180 / 2021 Coll., Decree No. 318 / 2021 Coll., and Decree No. 417 / 2022 Coll., is amended as follows:
1. In Paragraph 13 (1), the words "up to 20 000 000 CZK 'are replaced by the words" up to 30 000 000 CZK', after the words "0,1% ', the words" up to 100 000 000 CZK of base... 0,05%' and the words "over 20 000 000 CZK 'are replaced by the words" over 100 000 000 CZK'.
2. In Article 13a (1), the words "up to 20 000 000 CZK 'are replaced by the words" up to 30 000 000 CZK', after the words "1,2% ', the words" of a remaining amount up to 100 000 000 CZK of the base... 0,9%', the words "CZK 3 000 'are replaced by the words" CZK 5 000' and the words "over 20 000 000 CZK 'are replaced by the words" over 100 000 000 CZK'.
3. In Paragraph 14 (1), the amount "CZK 1,000" is replaced by "CZK 1,500."
4. In Section I, under the heading A of the first annex, the amount "CZK 1 000 'is replaced by" CZK 2 000', the words "the list, at least CZK 2 000 'are replaced by the words" the list, at least CZK 3 000, in the case of notarial registration, which is the basis for registration in the register of trust funds, at least CZK 20 000' and the amount "CZK 10 000 'is replaced by" CZK 20 000'.
5. In the third sentence of Section I (A) (b) of the Annex, the amount "10 000 CZK 'is replaced by" 20 000 CZK'.
6. In section I of the heading A of the last annex, the amount "CZK 2,000" is replaced by "CZK 3,000" and the amount "CZK 1,000" is replaced by "CZK 2,000."
7. In the first sentence of point B (2) of Section I of the first Annex, the words "legal proceedings' are replaced by the words" decision on 'and the amount "10 000 CZK' is replaced by" 20 000 CZK '.
8. In Section I, under point B (2) of the third Annex, the amount "CZK 12,000 'is replaced by" CZK 20,000'.
9. In Section II, under D (1) and (3) of the Annex, "CZK 1,500 'is replaced by" CZK 2,000'.
10. In Section II, under point D (2) of the Annex, the amount "CZK 500 'is replaced by" CZK 1000'.
11. In point I (1) of Section II of the Annex, "CZK 800 'is replaced by" CZK 1,100'.
12. In Section II, under the heading R of the Annex, the amount "CZK 1 000 'is replaced by" CZK 1 200'.
13. In Section II of the entry S (1) and (2) of the Annex, the amount "300 CZK 'is replaced by" 500 CZK'.
14. In Section II, under heading U (1) of the Annex, the amount "CZK 1 000 'is replaced by" CZK 1 500'.
15. In Section II, under heading U (2) of the Annex, the amount "CZK 2 000 'is replaced by" CZK 3 000'.
16. In Section II of the entry ZA (1) of the Annex, "CZK 2,200 'is replaced by" CZK 2,500'.
17. In Section II of the entry ZA (2) of the Annex, "CZK 800 'is replaced by" CZK 1,300'.
18. In Section II of the entry ZA (3) of the Annex, the amount "CZK 1,200 'is replaced by" CZK 1,500'.
19. In Section II of the entry ZA (4) of the Annex, the amount "CZK 700 'is replaced by" CZK 1000'.
20. In Section II of the entry ZA (5) of the Annex, the amount "CZK 200 'is replaced by" CZK 500'.
Transitional provisions
1. In proceedings initiated before the date of entry into force of this decree, the notary shall be remunerated under Decree No. 196 / 2001 Coll., as effective before the date of entry into force of this decree.
2. For acts of notarial activity which the applicant requested to be carried out before the date of entry into force of this decree, the notary shall be remunerated according to Decree No. 196 / 2001 Coll., as effective before the date of entry into force of this decree.
Efficacy
This Decree shall take effect on 1 January 2023.
