of 19 April 1978
on the protected area of natural water accumulation on the Rye Island
The Government of the Slovak Socialist Republic orders pursuant to § 18 of Act No. 138 / 1973 Coll., on Water (Water Act):
The area of the Rye Island, which, by its natural conditions, constitutes a significant natural accumulation of groundwater and surface water, is declared as a protected area of natural accumulation of water (the "Protected Water Area ').
(1) This Regulation shall apply to the protected water management area; Paragraph 4 also applies to the territory of the Slovak Socialist Republic of Bratislava. 1)
(2) The protected water-management area is situated in the territory bounded by the Danube River on the section between the capital of the Slovak Socialist Republic of Bratislava and the municipalities of Palkovičovo, the Palkovich-Aszod channel after its confluence with the Little Danube, the Little Danube after the result of the Dry River, the Dry River, the Clear Water, the connecting channel at the municipality of Nová Dedinka and, again, the Little Danube after its departure from the Danube in Bratislava, including the watercourses mentioned in addition to the main trough of Dujeze.2)
(3) The territory of the protected water management area shall be indicated in the real estate register kept by the competent authorities of geodesy and cartography.
(1) It is necessary to create favourable conditions in the protected water management area for the production and conservation of groundwater and surface water resources and to ensure universal protection of those waters.
(2) In a protected water management area, economic, technical or other similar activities may be planned and carried out only in accordance with the mission and needs of that area. Consistency of economic interests with the requirements for the protection of groundwater and surface water shall be ensured in particular in the context of national economic plans and territorial planning documents.
(3) It shall be prohibited to:
(a) construction or expansion
1. industrial plants (objects) in which substances which threaten the quality or health of water (hereinafter referred to as "harmful substances") are used or produced, 3)
2. other plants (objects) producing waste water containing poisons or radioactive substances, 4)
3. oil and product pipelines transporting harmful substances, 5)
4. oil stores with a total capacity of more than 200 m3 and a capacity of individual tanks of more than 50 m3;
5. storage of other harmful substances, (6) the capacity of which exceeds the need for the plant's own operation (facilities, establishments);
(b) the setting up of industrial waste landfills containing harmful substances. 7)
(4) The water authorities, when issuing permits, endorsements and observations (8) to the construction, installation and, where appropriate, activities which may adversely affect the water conditions in the protected water-management area, are obliged to rely on the need to protect the waters of the whole protected water-management area; in these cases they shall proceed in close cooperation with the Slovak Water Inspection Agency. 9)
(5) In particular, the following shall be regarded as buildings, installations and, where appropriate, activities referred to in paragraph 4:
(a) large-capacity farms of livestock production10) and agrochemical centres;
(b) the use of liquid waste from large-capacity livestock farms for irrigation;
(c) landfill of solid urban waste.
(6) In agriculture and forestry, pesticides or other plant protection products may be used in the protected water management area and to destroy pests and weeds only to the extent provided for by the Ministry of Forestry and Water of the Slovak Socialist Republic in agreement with the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic and the Ministry of Health of the Slovak Socialist Republic.
(7) The investment activity in the national company Slovnaft Bratislava is governed by specific principles laid down by the Ministry of Industry of the Slovak Socialist Republic in agreement with the Ministry of Forestry and Water Management of the Slovak Socialist Republic.
(1) In the protected water-management area and in the territory of the capital of the Slovak Socialist Republic of Bratislava, worn oil which cannot be used without regeneration for its original purpose ("worn oils") must be treated in such a way that it cannot endanger the quality or health of the water in the protected water-management area.
(2) All oil oil consumers are obliged to capture and collect in watertight storage tanks (11) or in packaging and to ensure that they are not further degraded and polluting in the territory of the Slovak Socialist Republic of Bratislava, without separating the different species.
(3) Consumers of oil oils which cannot safely and economically use worn oils for their own purposes so as not to endanger the quality or health of the waters in the protected water-management area are obliged to remove the worn oils from the national undertaking Benzinol Bratislava. 12)
The Ministry of Forestry and Water of the Slovak Socialist Republic and the other competent water authorities shall supervise compliance with the provisions of this Regulation and shall check that the measures for the protection of groundwater and surface water in the protected water management area are being implemented, comply with the decisions made by them and shall, to the extent of their competence, impose measures to remedy the deficiencies identified. 13)
This Regulation shall be without prejudice to the interests of State defence and the protection of national borders, as well as those protected by specific provisions. 14)
This Regulation shall enter into force on 1 July 1978.
