on requirements for biomethane, how to measure biomethane and the quality of biomethane delivered to the transmission system, distribution system or underground gas storage tanks
The Ministry of Industry and Trade provides, pursuant to § 53 (1) (j) and (k) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the amendment of certain laws:
Subject matter
This decree sets out the requirements for the quality, deorisation and pressure of the biomethane produced and how to measure the amount of biomethane and the quality of biomethane at the transfer point of the biomethane plant to the transmission system, distribution system or underground gas storage.
Biomethane quality requirements
(1) The producer of biomethane which produces biomethane in the process of anaerobic fermentation from biomass pursuant to the legislation governing the species and parameters of the supported renewable sources for electricity, heat or biomethane production and the determination and storage of documents ensures that the biomethane at transfer points to the transmission system, distribution system or underground gas storage tank meets the quality parameters of biomethane (3).
(2) Biomethane from a biomethane factory connected to an underground gas container constructed in natural rock structures must be inert to and not harmful to the environment of the rock structures.
(3) In the absence of compliance with any of the measured and evaluated quality parameters of biomethane identified as continuously measured, meaning measurements carried out at a maximum time interval of 10 minutes, the biomethane manufacturer shall ensure, by means of a measuring, evaluating and closing device which is part of the biomethane production plant, an automatic stop of the supply of biomethane to the transmission system, distribution system or underground gas storage.
(4) Renewal of the supply of biomethane after its previous interruption due to failure to comply with one of the quality parameters of biomethane (3) is possible on the basis of the submitted proof of the result of a one-off measurement of the quality parameter of biomethane or the results of continuous measurements demonstrating compliance with this quality parameter by the biomethane manufacturer and in agreement with the dispatching of the operator concerned.
(5) The average value of GCV at the connection point or in individual quality zones for the preceding month shall be published by the relevant operator in a way that allows remote access. The indication of the quality zone to which the biomethane plant will be connected shall be indicated in the connection contract.
Deorisation requirements
(1) For the production of biomethane connected to the distribution system, the de-centralisation of biomethane is ensured by the distribution system operator. For biomethane production connected to the transmission system or to the underground gas storage tank, no deorisation shall be carried out.
(2) For the production of biomethane connected to the distribution system, the producer of biomethane allows the operator of the distribution system to inject the deoring agent into the extractive gas (1) owned by the producer of biomethane.
(3) Odorisation of the biomethane produced shall not require a higher dose of deorification than normal in the quality zone.
Pressure requirements for biomethane produced
(1) The range of transmission pressure produced by biomethane is determined to correspond to the pressure conditions at the connection point.
(2) The biomethane manufacturer shall measure the transfer pressure value at least once per second and shall transmit the measured data to the relevant operator in a manner specified by the relevant operator in the connection contract at least once per hour.
(3) Part of the biomethane manufacturing plant is a fast-track safety closure to increase pressure at the transfer point to the transmission system, distribution system or underground gas storage tank above the maximum allowable pressure specified by the relevant operator in the connection contract, and a return valve to prevent the gas flow back from the transmission system, distribution system or underground gas storage facility into the biomethane production facility at a lower pressure of biomethane from the biomethane production than the pressure in the transmission system, distribution system or underground gas storage tank.
(4) For a biomethane plant for which connection to a closed part of the distribution systemis required), the distribution system operator shall verify, on the basis of the data provided in the request for connection of the biomethane production plant, whether the minimum hourly output from that closed part of the distribution system, reduced during the last 3 years by the supply of other biomethane or gas production products to which the connection contract to that part of the distribution system has been concluded ("minimum hourly output"), the required maximum hourly output of the production plant. The output of the biomethane plant shall not exceed the minimum hourly consumption of the closed part of the distribution system.
Method of measuring the quantity and quality of biomethane
(1) The methods of measuring individual quality parameters of biomethane are set out in Annex 2 to this Decree.
(2) The minimum frequency of measurement of quality parameters of biomethane produced from biomass divided into groups is given in Annex 3 to this Decree.
(3) Prior to the start of the supply of biomethane from the new biomethane plant or when the biomethane production plant is changed, the biomethane manufacturer shall submit to the competent operator the results of the measurement of quality parameters of biomethane, depending on the biomass used in accordance with Annex 3 to this Regulation.
(4) In the case where biomass is used in the manufacture of biomethane, classified into different groups in accordance with Annex 3 to this Regulation, the frequency of measurements shall be determined by a group with a higher number. If a biomass group with a higher number than the biomass previously used starts to be used for the production of biomethane, the biomethane manufacturer shall, within the fifth week following the start of its use, ensure that all one-off measurements are carried out as at the start of the biomethane production and shall transmit the results to the competent operator no later than 30 calendar days after the measurement.
(5) The measurement dates of one-time quality parameters shall be notified by the biomethane manufacturer in electronic form to the relevant operator at least 15 calendar days before their implementation and shall allow the relevant operator to participate in the measurements. The values of the single-measurement quality parameters of biomethane shall be transmitted by the biomethane manufacturer to the competent operator no later than 30 calendar days after the measurement.
(6) The manufacturer of biomethane shall transmit to the competent operator at least once per hour the values of the continuous measurement and the quantity of biomethane delivered to the transmission system, distribution system or underground gas storage unit, in the manner specified in the connection contract.
(1) The biomethane manufacturer will allow the competent operator to carry out control measurements of single-measurement quality parameters of biomethane.
(2) The type of measuring device by which the producer of biomethane measures the quantity of biomethane supplied and the conditions for measuring the quantity are laid down by other legislationm3). Prior to the start of the supply of biomethane to the transmission system, distribution system or underground gas storage tank, the relevant operator shall provide measuring equipment by which the biomethane manufacturer measures the amount of biomethane, anti-tampering devices.
(3) All measuring equipment for measuring the quantity of biomethane supplied and for measuring its quality parameters used for calculating and operating the GCV must comply with the requirements of another legislation4). The measurement of one-time quality parameters of biomethane is provided by the biomethane manufacturer at the accredited laboratory.
(4) The manufacturer of biomethane shall allow the competent operator to take samples of biomethane and to check the measuring equipment for continuous measurement, the measuring equipment of the quantity and pressure of the biomethane supplied and the part of the equipment of the biomethane production plant between that measuring device and the transfer point.
(5) In the case of connection of a biomethane plant to a transmission system, distribution system or underground gas storage facility through another gas production plant, the measuring device shall be so placed as to separately measure the quantity of biomethane produced per production plant.
Efficacy
This Decree shall take effect on 1 January 2013.

Explanatory notes:
Biomass Group No 1 is all biomass species classified in Category 1 and from Category 2 biomass species referred to in points (a) to (e) under another regulatory provision (1).
Biomass group 2 is those biomass species classified in category 2 as referred to in points (f) to (k) under another legislation1).
Biomass group 3 is those biomass species classified in category 2 as referred to in points (l) to (n) under another legislation1).
The frequency of measurements for one-off quality parameters of biomethane may be higher if the measured values are close to the limit value given in Annex 1 to this Decree by less than 5%, the shortest measurement frequency being once every 3 months.
