The Constitutional Court ruled on 11 July 2006 in plenary composed of Stanislav Balík, František Duchoň, Vlasta Formánková, Vojen Güttler, Pavel Holländer, Ivana Janů, Vladimir Krórka, Dagmar Lastovecká, Jan Musil, Jiří Nykodemí, Pavel Rychetský, Miloslav Excellent, Eliška Wagner and Michaela Židlická on the proposal of the Minister of Interior Mgr. František Bublan to repeal the general binding decree of the Statutory City of Havířov No. 4 / 2002 on the implementation of special protective exposition
as follows:
The general binding decree of the Statutory City of Havířova No. 4 / 2002 on the conduct of special protective extermination shall be deleted from the date of the publication of this finding in the Collection of Laws.

In accordance with Article 14 of Act No. 182 / 1993 Coll., on the Constitutional Court, as amended, the Court of First Instance took a different position on the decision of Judge Eliška Wagner.
