fixing the daily rate relating to the costs associated with the execution of house arrest and the use of the electronic control system and the method of payment thereof
According to Article 152 (2) of Act No. 141 / 1961 Coll., on criminal proceedings, the Ministry of Justice provides for judicial (criminal order), as amended by Act No. 306 / 2009 Coll.:
The daily rate of the cost of execution of house arrest and of the costs associated with the use of the electronic control system shall be CZK 50 per calendar day in which the sentenced has at least partly served the sentence of house arrest or in which an electronic control system has been used.
(1) The Court of First Instance shall, following the execution of the sentence of house arrest or the use of an electronic control system after the legal power of the decision setting out the obligation to pay the costs associated with the execution of the sentence of house arrest or the use of the electronic control system, invite the sentenced person to pay the amount charged by the court on behalf of the court within 30 days of the date of service, stating that if it is not paid within the prescribed period, it will be enforced under other legislation.
(2) In the absence of reimbursement of costs associated with the use of the electronic control system for the replacement of the link, the court may, taking into account the length of the sentence imposed or the estimated duration of the use of the electronic control system, decide on the obligation for the sentenced to pay the costs of the execution of the sentence or the use of the electronic control system after the execution of at least one month of the sentence or after at least one month of the use of the electronic control system. After the legal authority of such a decision, he shall always invite the defendant to pay the amount to be charged by the court on behalf of the court within 10 days of the date of service, indicating that, if not paid within the prescribed period, it shall be enforced under other legislation.
This Decree shall take effect on 1 January 2010.
