of 10 December 2003
implementing the Law on genetic resources of plants and micro-organisms
The Ministry of Agriculture provides pursuant to Article 27 of Act No. 148 / 2003 Coll., on the conservation and use of genetic resources of plants and micro-organisms of importance for nutrition and agriculture and amending Act No. 368 / 1992 Coll., on Administrative Charges, as amended, (Act on Genetic Resources of Plants and Microorganisms) ("the Act ') for the implementation of Sections 4 (5), 11 (3), 12 (1), 17 (3) and 19 (4) of the Act:
Presumption for collection, evaluation, documentation and preservation of genetic resources and collections of genetic resources
(K § 4 (5) of the Act)
Professional assumptions
(1) The professional qualifications of the applicant for inclusion in the National Programme ("the applicant") are:
(a) secondary education with a graduate examination or higher vocational training in agriculture and forestry or ecology and environmental protection or duly completed higher education in agricultural or natural sciences;
(b) 3 years of experience in research, breeding, varietal testing or conservation and exploitation of genetic resources, part of which must be in the field of conservation and exploitation of genetic resources.
(2) In addition to the technical assumptions referred to in paragraph 1, the applicant shall also demonstrate its own publication activity in the field of genetic resources for decision-making purposes under Article 5 of the Act.
(3) Where the applicant is a legal person, the professional qualifications referred to in paragraphs 1 and 2 shall be met by the statutory authority or its representative responsible for ensuring the requirements arising from paragraphs 11 to 20 of the Act.
Technical assumptions
(1) The technical equipment of the applicant pursuant to Article 4 (2) (h) of the Act must correspond to the quantity of preserved genetic resources, the requirements for their collection, evaluation, documentation and preservation and depend on the type of genetic resource. The applicant shall indicate in the application:
(a) technical equipment for the evaluation of genetic resources, in particular those of laboratories intended to provide laboratory tests on genetic resources;
(b) in the case of plant genetic resources, the parcels on which field tests will be carried out; if the applicant is the tenant of the land, the lease contract on the land must be concluded for at least 15 years after the application for permanent crops and 5 years for other cultures,
(c) technology suitable for the regeneration of genetic resources and the preservation of vegetative plant genetic resources;
(d) in the case of genetic sources of micro-organisms, technical equipment for preservation by cryopreservation or lyophilisation. Where the genetic source of the micro-organism cannot be retained by cryopreza or lyophilisation, the applicant shall indicate in the application a different method of reducing its metabolic activity and demonstrate the storage of the collection item in at least two separate independent technical installations. A central laboratory of the authorised person or laboratory of another legal person may serve as a backup independent establishment. Where the genetic source cannot be reduced by metabolic activity, the applicant shall indicate the method of safe storage at normal temperature and the relevant technical equipment.
(2) In order to maintain the documentation referred to in Article 17 of the Act, the applicant shall be equipped with technical and programme equipment enabling access to the genetic resources information system.
Documents
The application pursuant to Article 4 of the Act shall be accompanied by:
(a) proof of completion of the required education;
(b) proof of the nature and duration of the required practice;
(c) a list of the applicant's publication activities in the field of genetic resources;
(d) an extract from the cadastral of real estate to the parcels listed in the application, if it is for plant genetic resources and if the applicant is the owner of those parcels or has other authorisation under special legislation (1) to dispose or manage them, or any other document on the basis of which he is entitled to use the land; in the case of a parcel of land, an officially certified copy of the smuggling contract.
The size of the sample of the genetic resource and the extent of the data to be provided on the genetic resource by the participant in the National Programme to the person responsible for its written call
(Paragraph 11 (3) of the Law)
Size of sample genetic source of plants
(1) The size of a sample of a plant genetic resource provided by a participant in the National Programme for the Evaluation of Collections, Sample Restoration and Long-Term Conservation shall ensure sufficient individuals to maintain the original genetic basis of the plant genetic resource and the reserve from which samples of plant genetic resources are provided to other participants in the National Programme and legal or natural persons to whom a sample of genetic resources has been provided on request (hereinafter referred to as the "beneficiary").
(2) The size of a seed sample of a genetic source of plants transmitted to the authorised person to a gene bank for long-term conservation is laid down in Annex 1.
(3) The size of a sample of a vegetatively reproduced genetic source of plants is governed by technical possibilities. The minimum sample size of a vegetatively propagated genetic plant source is given in Annex 2.
(4) Where a participant in a national programme does not have sufficient seed or plant parts intended for reproduction or preservation, trees or shrubs for the size of a sample of a genetic plant source referred to in paragraph 2 or 3, or if a genetic plant source is threatened, a sample of a genetic plant source shall be provided only after the genetic plant source has overgrown and sufficient quantity is ensured.
(5) For seed samples of plant genetic resources transferred to the gene bank for preservation by the authorised person, the germination and purity provided for in specific legislation.2 is required.)
(6) Where it is not possible to achieve the germination and purity set out in accordance with paragraph 5, the minimum germination and purity requirements shall be as set out in Annex 3.
(7) The seed samples of plant genetic resources transmitted to the designated person for preservation to the gene bank must have a moisture and health status which do not reduce their biological value and which comply with a specific regulatory regulation.2)
(8) Semen samples of plant genetic resources transmitted for preservation abroad as security duplications, together with the required documentation, are transmitted through the designated gene bank.
Sample size of the micro-organism genetic source
The size of the sample of the genetic source of the micro-organism provided by a participant in the National Programme for long-term conservation purposes shall be determined in writing by the authorised person according to the current state of the genetic source of the micro-organism in order to ensure the original genetic basis of the micro-organism from which samples of genetic sources of the micro-organisms are provided to other participants in the National Programme and beneficiaries.
Scope of genetic resource data
(1) In the case of a plant genetic resource, the participant in the National Programme responsible for the person concerned shall, at the same time as the sample of the genetic resource, transmit the following data on the genetic resource:
(a) quantity provided, germination capacity, mass of thousands of seeds, type of collection to store a sample of a genetic source;
(b) passive data,
(c) descriptive data in the format by classifiers;
(d) in the case of a genetic source of plants preserved in situ or on farm, the place of occurrence or maintenance of that genetic source and the data characterising the site.
(2) In the case of a genetic source of the micro-organism, the participant in the National Programme entrusted to the person with a sample of the genetic source shall transmit data on the genetic source to the extent specified in Section 10.
Scope and method of evaluation of genetic resources
Evaluation of plant genetic resources
(1) The evaluation of plant genetic resources consists of a characterisation which serves to clearly identify plant genetic resources and an assessment of economic characteristics.
(2) Evaluation of one-year, two-year and persistent species of genetic resources of plants preserved ex situ is carried out in field tests and laboratory tests.
(3) Evaluation of genetic resources of plants preserved in situ is analogous to ex situ evaluation, but is based on the possibilities of evaluation at the natural habitat. By continuous regular monitoring of plant genetic resources, the status of the population and potential threat to plant genetic resources shall be checked.
(4) The evaluation of genetic resources of plants preserved ex situ or in situ shall be carried out by a member of the National Programme, who shall be responsible for the relevant species collection of genetic resources of plants. Where a national programme participant is unable to carry out an in situ conservation genetic resource evaluation, it may, with the consent of the authorised person, arrange for its evaluation by other appropriate means.
Evaluation of genetic sources of micro-organisms
(1) Evaluation of genetic sources of micro-organisms contains in particular their characteristics, which include taxonomic classification of the organism, morphological description, determination of biological, biochemical, molecular-genetic and technological properties. Genetic sources of micro-organisms are characterised by tests of the required properties in beneficial micro-organisms, pathogenicity or virulence in harmful micro-organisms and tests of resistance to chemical or physical factors. The vitality, homogeneity and stability of the properties for which the genetic resource is stored shall be verified on an ongoing basis, in particular after long-term preservation and recovery, which takes place according to the recovery plan.
(2) The evaluation of genetic sources of micro-organisms also includes a list of scientific publications related to collection items, national and international cooperation, the integration of the collection into international organisations for the protection of biodiversity and the registration of micro-organisms provided.
Scope and manner of documentation management by a participant in the National Programme
Genetic plant sources
(1) Documentation on genetic resources of plants, which is maintained by a participant in the National Programme in accordance with Section 17 of the Act, consists of:
(a) passive data;
(b) descriptive data;
(c) conservation data where a participant in the National Programme is responsible for the long-term conservation of plant genetic resources;
(d) data on genetic resources provided.
(2) The passport data shall contain information clearly identifying each plant genetic source and shall include an inventory of the conditions established by the genetic source provider concerning the use made of that source and the conditions for its provision to the next recipient.
(3) The description section contains the results of evaluation of all morphological, biological, economic and biochemical characteristics in the form of descriptors. Describe descriptors are native or species specific and define how to evaluate the expression of each character. The descriptor file shall consist of a classifier of a given genus or species. If the classifier is not available, the National Program participant shall prepare a minimum list of descriptors. The national programme participant shall also record and store the data contained in the descriptive section in the form of original metric values.
(4) Data on the conservation of plant genetic resources include:
(a) for seeds preserved in the gene bank, the basic storage data on the seed sample of the genetic resource stored;
(b) for vegetatively propagated collections of plant genetic resources in field collections, in vitro cultures or cryobance, the necessary information on a preserved plant genetic resource, such as the number of items in a sample of genetic resources, the date on which conservation is established, the date of regeneration and the method of preservation.
(5) The data on the genetic resources provided contain passive and descriptive data, data clearly identifying the recipient and the method of use.
Genetic sources of micro-organisms
(1) Documentation on the genetic source of the micro-organism, which is maintained by a participant in the National Programme in accordance with Article 17 of the Act, is kept for each item in the collection of genetic sources of micro-organisms.
(2) Documentation of the genetic source of the micro-organism shall include the following:
(a) the registration of the collection;
(b) the register number of the collection strain;
(c) a valid scientific name of the species, or the name of the intra-species category of the subspecies, variety, form of specialis, race,
(d) geographical origin, location, substrate, host;
(e) data on isolation, taxonomic classification and inclusion in the collection;
(f) culture conditions;
(g) the method and place of preservation or preservation;
h) the history of the strain, in particular the strain number in other collections, the change in taxonomic classification,
(i) the handling of the strain, in particular the date of last renewal and the date of inventory;
(j) an inventory of the conditions laid down by the genetic resource provider relating to the use made of that resource and the conditions for granting it to another recipient;
(k) data on the genetic resources provided, including data clearly identifying beneficiaries and how they are used.
(3) A participant in the National Programme records further information defining and characterising the strain of the micro-organism.
Size of sample of genetic plant source provided for breeding, research and education purposes
(1) The size of a sample of a genetic source of generatively propagated plants provided to the recipient is 30 to 50 germination seeds depending on the biological characteristics of the species.
(2) In the case of vegetative species, the size of one sample of genetic resource shall be between 3 and 10 regenerating parts as specified for specific plant species in Annex 4 to this Decree.
(3) One beneficiary shall receive, within one calendar year, a maximum of:
(a) 30 samples of genetic resources in generationally propagated species;
(b) 10 samples of genetic resources for vegetative species.
Size of sample of genetic source of micro-organism provided for breeding, research and education purposes
The determination of the number and size of the sample of the genetic source of the micro-organism provided by a participant in the National Programme shall be carried out by the collection manager or curator. The size of the sample depends on the type of retained genetic resource, the current state of the collection item and the technical possibilities of the owner of the genetic resource.
Efficacy
This Decree shall take effect on 1 January 2004.
