GOVERNMENT REGULATION
of 18 December 2013
amending Government Decree No. 1 / 2000 Coll., on the Transport Regulations for Public Rail Freight, as amended by Government Decree No. 295 / 2000 Coll.
The Government orders pursuant to § 37 (7) of Act No. 266 / 1994 Coll., on Railways, as amended:
Government Decree No. 1 / 2000 Coll., on the Transport Regulations for Public Rail Freight, as amended by Government Decree No. 295 / 2000 Coll., is amended as follows:
1. In the introductory sentence, the words "to implement § 772 of Act No. 40 / 1964 Coll., Civil Code, as amended by Act No. 509 / 1991 Coll., and" and "§ 771 (1) of Act No. 513 / 1991 Coll., Commercial Code, and" shall be deleted.
2. footnote 1 shall read:
"1) Convention on International Carriage (COTIF), published under No 8 / 1985 Coll., as amended."
3. Paragraph 3 (1) is deleted.
Paragraphs 2 to 6 shall be renumbered paragraphs 1 to 5.
4. In Article 3, at the end of paragraph 1, the sentence "A loading list may be used instead of a bill of lading under the Civil Code in the national transport of goods."
5. In Article 4, the following paragraph 4 is added:
"(4) The time limit for the collection of the consignment shall be reduced to 1 month for dangerous goods and 1 week for live animals and goods which are rapidly damaged. After the expiry of these time limits, the carrier shall proceed under Paragraph 2581 (1) of the Civil Code. '
6. in Articles 5 (2) (b) and 22 (3) (b), the words "birth number" shall be replaced by "date of birth."
7. In Article 11 (2), the words "such a consignment shall be considered as unrecovered under a special legislature.3) 'shall be replaced by the words" it shall comply with Article 2581 (1) of the Civil Code.';
footnote 3 is deleted, including the footnote references.
8. In Article 11 (5), the words "the consignment is considered to be unrecovered under a special legislation 'shall be replaced by the words" it shall comply with Article 2581 (1) of the Civil Code'.
9. Article 12 shall be deleted, including the title and footnote 4.
10.Paragraph 17 (1) reads as follows:
"(1) The transport of deceased persons in rail transport shall take place as a fast-moving shipment. ';
footnote 12 is deleted.
11. in Paragraph 24 (4), the words "as with an unrecovered item" shall be replaced by the words "under Article 2581 (1) of the Civil Code."
12. In Annex 2, the words "birth number 'are replaced by the words" Date of birth'.
Efficacy
This Regulation shall take effect on 1 January 2014.
