on the details of the transfer of forest reproductive material, the registration of the origin of the reproductive material and the details of the restoration of forest areas and the afforestation of land declared as land intended to fulfil forest functions
According to Article 29 (7) of Act No. 289 / 1995 Coll., on Forests, and amending and supplementing certain laws (Forest Act), as amended by Act No. 314 / 2019 Coll., ("the Act '):
Details of the transfer of forest reproductive material
(1) The transfer of forest reproductive material means the transfer from the source to the site of use in the artificial restoration of forest areas and afforestation of land declared as land intended to fulfil forest functions.
(2) Unless it is possible to cover the need for reproductive material within the same natural forest area (1), its transmission may be carried out in compliance with the rules set out in Annex 1 to this Decree.
(3) Transmission may be carried out within the height zones designated by the forest vegetation scale (2). Unless it is possible to cover the need for reproductive material within a given stage, it may be transmitted in the manner set out in Annex 2 to this Decree.
(4) The rules for the use of imported reproductive material of douglasky tisolista and giant fir from the United States of America and Canada are set out in Annex 3 to this Decree.
(5) If it is not possible to cover the need for reproductive material in the context of the carry-overs provided for in paragraphs 2 and 3, the Ministry of Agriculture may, on the basis of an expert opinion prepared at its request, grant an exemption for the use of seed material from the appropriate authorised resources of the European Union States. The quality requirements for recognised sources of reproductive material outside the Czech Republic must comply with the criteria set out in another legislation3).
(6) The use of reproductive material derived from seed sets, parents of the family, orthets, clones or clones shall comply with the conditions laid down in the decision or proof of recognition of the source of reproductive material4).
(7) The rules on the use of forest renewal reproductive material in gene bases declared under another legislation (5) are not affected by this decree in order to preserve and reproduce the domestic gene pool of forest trees in these territories.
Details of the restoration of forest areas and afforestation of land declared as land to fulfil forest functions
(1) For artificial forest renewal and afforestation, only reproductive material of suitable species of forest species meeting the conditions of transmission for a particular planting site referred to in Article 1 and for which the origin is established may be used.
(2) The number and quality of planting material of forest trees or, where appropriate, individuals from the natural restoration or sieve of each species of forest wood shall be chosen in such a way as to achieve a secured forest crop and, at the same time, to achieve an appropriate species composition of forest land. The species of forest trees which perform the functions of the forest function at the site shall be considered as suitable for the habitats. In particular, the timber referred to for the target economic file in another legislation6). The minimum number of individuals of each species per hectare of land for forest renewal and afforestation is given in Annex 4 to this Decree.
(3) The land, newly declared as a land intended for the performance of forest functions, is considered to be wooded if at least 90% of the minimum number of viable species of suitable timber is grown on it evenly spread over the area.
(4) The land shall be considered to be renewed if it grows on at least 60% of the minimum number of viable individuals of suitable wood, evenly spread across the area.
(5) The obligation to comply with the mandatory provisions of the minimum percentage of the meliorative and strengthening timber referred to in Article 24 (2) of the Act in the recovery of the crop must be fulfilled at the latest at the end of the period specified for reinsurance under Article 31 (6) of the Act.
(6) The uniform distribution of individuals across the area need not be observed when mountain forests are reacquired at eighth and ninth stages, low and medium-sized forests, and in cases of requirements resulting from the functional orientation of the forest for the category of conservation forests and for the category of special destination forests. The uniform distribution of individuals across the area may also not be observed on a calamite shin which exceeds the permissible size of the bare mower referred to in Section 31 (2) of the Act and is renewed by means of preparatory trees.
(7) Forestry resulting from afforestation or forest renewal shall be considered to be secured if the following conditions are met:
(a) the individuals are equally individually or group-by-group in the area and at least 80% of the minimum number for renewal or afforestation referred to in Annex 4 to this Decree;
(b) individuals exhibit a permanent height increase; and
(c) the animals are degraded by the negative effect of the roar and are not significantly damaged.
(8) For artificial forest renewal and afforestation, vegetatively propagated reproductive material shall be used only if it complies with the requirements for the category of selected or qualified reproductive material or, where appropriate, tested reproductive material, while maintaining sufficient clone representation.
Details of the registration of origin of reproductive material
The records of origin of reproductive material used for artificial forest renewal and afforestation shall be kept according to the type of wood, the registration number of the recognised unit, the cultivation method, the quantity, the planting sites or the sieve and the time the reproductive material was used. The model of the register of origin of reproductive material used for artificial forest renewal and afforestation is set out in Annex 5 to this Decree.
Transitional provision
Reproduction material obtained, produced or equipped with accompanying documentation before the date of entry into force of this Order may be transferred in accordance with Decree No. 139 / 2004 Coll., as effective before the date of entry into force of this Order.
Repeal
Decree No. 139 / 2004 Coll., laying down details of the transfer of seeds and seedlings of forest trees, the registration of the origin of the reproductive material and the details of the restoration of forest areas and the afforestation of land declared as land intended to fulfil forest functions, shall be deleted.
Efficacy
This Decree shall take effect on 1 January 2022.

Rules on transfers of forest reproductive material between natural forest areas within the Czech Republic
1) Natural forest areas 1 - 34 are listed in the Hercyn region, natural forest areas 35 - 41 are listed in the Carpathian region.
2) The transfer of forest reproductive material between the Hercyn and Carpathian regions is not permitted except for the following exceptions:
(a) Mutual transmission between the Hercyne and Carpathian regions shall be permitted only between immediately adjacent natural forest areas.
(b) In the case of a beech, it is permissible to transfer reproductive material from Carpathian to the Hercyne region without restriction.
c) In the case of economically important entroduated trees Douglas tisolists and Jedle huge transmission within the Czech Republic (natural forest areas 1 - 41) without restrictions.
(3) The following rules shall apply to transfers of reproductive material of these trees:

1. The number of individuals per ha on renewal or afforestation shall be derived by the product of the minimum number of hectares by a percentage of the planned representation of the timber recovered or afforested.
2. In the case of roofed seeds and seedlings, those minimum hectares may be reduced by up to 10% by the number of recovered or afforested individuals.
3. The minimum number of rejuvenated or afforested individuals per hectare may be reduced by up to 20% by the use of seedling or packaging. Semi-rotational or rotational means a plant grown by at least double education, or a combination of roasting and cutting roots or incorporation into packaging.
4. For low and medium forest, individual, viable stump or root shoots are considered as separate individuals.
5. The minimum number of individuals of tree willows and nurseries shall apply only to the renewal or afforestation of planting material of vegetative origin.

MODEL Registration of origin of reproductive material used for artificial forest renewal and afforestation
1. In the case of renewal, the lowest spatial distribution unit of the forest shall be indicated. In the case of afforestation, land parcel and cadastral territory shall be indicated.
2. The acronym of the wood planted or planted shall be indicated.
3. In the case of a source of reproductive material which does not come from a recognised unit, the designation of the lowest spatial distribution unit of the forest of its origin shall be given.
4. For seed material to be indicated - raw material or pure seed.
In the case of planting material, it shall be given - space-rooted or cryogenic, indicating whether the material is propagated vegetative (V) or generative (G).
5. For seed material, the weight in kg shall be given.
For planting material the quantity shall be given in 1000 pieces.
