amending Government Regulation No. 77 / 2008 Coll., on the establishment of thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion into Czech currency of the amounts laid down in the Act on Public Procurement in Euro, as amended, and Government Regulation No. 78 / 2008 Coll., establishing financial limits for the purposes of the Concession Act, as amended

The Government hereby orders pursuant to § 159 (1) to implement § 12 (1) and § 154 of Act No. 137 / 2006 Coll., on Public Contracts, as amended, and § 34 (3) to implement § 14 (1) and § 15 (1) (b) of Act No. 139 / 2006 Coll., on Concession Contracts and Concession Procedure (Concession Act), as amended:

Amendment to Government Decree No. 77 / 2008 Coll., on the setting of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods procured by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of amounts set out in the Act on Public Procurement in Euro into Czech currency, as amended

Čl. I

Government Decree No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of the amounts laid down in the Act on Public Procurement in Euro into Czech currency, as amended by Government Decree No. 474 / 2009 Coll., Government Decree No. 276 / 2011 Coll., Government Decree No. 447 / 2011 Coll. and Government Decree No. 386 / 2012 Coll., is amended as follows:

1. In footnote 1, "(2011 / C 353 / 01) 'is replaced by" (2013 / C 366 / 01)'.

2. footnote 2 shall read:

"(2) Commission Regulation (EU) No 1336 / 2013 of 13 December 2013 amending Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds used in the procurement procedures.";

3. In § 2 (1) (a) and § 2 (2) (a), the amount "CZK 3 256 000" is replaced by "CZK 3 395 000."

4. In § 2 (1) (b) and § 2 (2) (b), the amount "5 010 000 CZK" is replaced by "5 244 000 CZK."

5. In § 2 (1) (c), § 2 (2) (c) and § 2 (4) (a), "10 021 000 CZK" is replaced by "10 489 000 CZK."

6. In § 2 (3) and § 2 (4) (b), the amount "125 265 000 CZK" is replaced by "131 402 000 CZK."

7. In § 3 (a), "86" is replaced by "87" and "18 789 000 CZK" is replaced by "19 003 000 CZK."

8. In § 3 (b), the amount "CZK 2 004 000" is replaced by "CZK 2 027 000."

9. In § 3 (c), "25 053 000 CZK 'is replaced by" 25 338 000 CZK'.

Amendment of Decree No. 78 / 2008 Coll., laying down financial limits for the purposes of the concession law, as amended

Čl. II

Government Regulation No. 78 / 2008 Coll., setting financial limits for the purposes of the concession law, as amended by Government Regulation No. 474 / 2009 Coll. and Government Regulation No. 447 / 2011 Coll., is amended as follows:

1. In footnote 1, "(2011 / C 353 / 01) 'is replaced by" (2013 / C 366 / 01)'.

2. footnote 2 shall read:

3. In § 2 paragraphs 1 and 2, the amount "CZK 125 265 000 'is replaced by" CZK 131 402 000'.
