GOVERNMENT REGULATION
of 13 December 2023
amending Government Decree No. 308 / 2022 Coll., providing for an exemption from the non-acceptability of applications for residence permits in the Czech Republic lodged in representative offices, as amended by Government Decree No. 79 / 2023 Coll.
The Government hereby orders, pursuant to Article 5a (3) of Act No. 65 / 2022 Coll., on certain measures relating to armed conflict in the territory of Ukraine caused by the invasion of Russian troops, as amended by Act No. 175 / 2022 Coll. and Act No. 454 / 2023 Coll. ("the Act '):
Government Decree No. 308 / 2022 Coll., establishing an exception to the non-acceptability of applications for residence permits in the Czech Republic lodged at representative offices, as amended by Government Decree No. 79 / 2023 Coll., is amended as follows:
1. in Paragraph 1 (a):
"(a) award
1. a short-stay visa, if the applicant is a family member of a European Union citizen pursuant to § 15a (1) or (2) of the Act on the residence of foreigners in the Czech Republic and following such a citizen;
2. long-stay visas for family purposes,
3. diplomatic or special visa pursuant to § 40 of the Act on the residence of foreigners in the Czech Republic,
4. long-stay visas, if the applicant is a family member of the holder of a diplomatic or special visa pursuant to § 40 of the Act on the residence of foreigners in the Czech Republic; or
5. exceptional work visa pursuant to Section 31a of the Act on the residence of foreigners in the Czech Republic, if the applicant resides in Ukraine, '.
2. in Paragraph 1 (b), at the end of point 2, the word "or 'is deleted and the following point 3 is inserted after point 2:
"3. the pursuit of employment pursuant to § 42g of the Act on the residence of foreigners in the Czech Republic by a citizen of Ukraine who is a member of a government approved programme and has not been granted temporary protection or international protection by the Czech Republic, or."
Point 3 is renumbered point 4.
3. In Article 1 (b) (4), the words "requiring a high qualification 'shall be deleted; the words" or 42k' shall be inserted after the words "or 42k '; and the words" referred to in Article 5 (1) (c) or (d) of the Act' shall be replaced by the words "to which temporary protection or international protection has not been granted by the Czech Republic '.
4. In Article 1, at the end of the text of point (c), the word "or 'is deleted and the following point (d) is inserted after point (c):
"(d) the granting of a residence permit if the residence of the applicant is in the interests of the Czech Republic, or"
Point (d) shall be renumbered as point (e).
Efficacy
(1) This Regulation shall take effect on 1 January 2024.
(2) This Regulation shall expire on the date on which Article 5a of the Act expires.
