GOVERNMENT REGULATION
of 25 November 2021
amending Government Regulation No. 30 / 2014 Coll., laying down binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended
The Government mandates pursuant to § 46 (9) of Act No. 289 / 1995 Coll., on Forests and on the amendment and amendment of certain laws (Forest Act), as amended by Act No. 501 / 2012 Coll., and pursuant to § 62 (2) of Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 501 / 2012 Coll. and Act No. 357 / 2014 Coll.:
Government Regulation No. 30 / 2014 Coll., on the establishment of binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended by Government Decree No. 308 / 2014 Coll., Government Decree No. 51 / 2015 Coll., Government Decree No. 209 / 2016 Coll., Government Decree No. 245 / 2018 Coll. and Government Decree No. 297 / 2020 Coll., is amended as follows:
1. In Article 2 (2), the words "the total amount of the financial contribution would be" shall be replaced by "the total amount of the financial contribution required in the application."
2. In Article 2 (7), "service" is replaced by "service" and "service" is replaced by "submission, but first from the beginning of the calendar year for which the notification is submitted."
3. In Article 2, paragraph 12 is added, including footnote 39:
"(12) Where the applicant is a legal person who records the beneficial owner in accordance with the law governing the registration of beneficial owners (39), the application shall be accompanied by a complete extract of the data on the beneficial owner of the legal person in force at the time of the application, which shall not be more than 3 months from the date of the application.

4. In Sections 3, 35 and 35a, at the end of the text of paragraph 1, the words "if they were one of those persons at the time of completion of the subject-matter of the allowance, the legal successors of such person or persons managing the estate shall be those persons'.
5. in § 3 (4), § 4 (3), § 12 (3), § 34 (4), § 35 (4), § 35a (4), § 35b (4), § 36 (2), § 43 (3) and in § 44 (3) the words "deliver the applicant" shall be replaced by "submit the applicant."
6. In Article 4 (1) and Article 12 (1), the words "if they were one of those persons at the time of completion of the subject-matter of the allowance, the legal successors of such person or persons managing the estate shall be those persons'.
7. in Article 4 (2), point (d) is deleted;
Points (e) to (i) shall be renumbered (d) to (h).
8. in Article 4 (2) (g) and Article 35b (3) (e), the word "or" shall be deleted;
9. In Article 4, at the end of paragraph 2, the dot is replaced by a comma and the following points (i) and (j) are added:
"(i) the mechanical preparation of the land before the renewal of the forest; or
(j) the placing of pliers on piles or bales, leaving it to be rendered in the forest. ';
10. in Articles 5 (2) (c), 6 (2) (d) and 7 (3), the word "basic" shall be deleted;
11. Footnote 10:
"10) Annex 4 to Decree No. 456 / 2021 Coll., on the details of the transfer of forest reproductive material, on the registration of the origin of the reproductive material and on the details of the restoration of forest areas and the afforestation of land declared as land intended for the performance of forest functions."
12. in Article 6 (2) (c):
"(c) the seed material of wood has been used which is suitable for the appropriate set of forest types according to another legislation (18);"
13. in Article 6 (2), the following point (d) is inserted after point (c), including footnote 13:
"(d) the rules for the transmission of forest reproductive material under another legislation (13) and Annex 12 to this Regulation have been complied with; and"
13) Decree No. 456 / 2021 Coll. '
Point (d) shall be renumbered as point (e).
14. in Article 7 (2) (b):
"(b) planting material capable of planting wood material which is suitable for the appropriate set of forest types under another legislation (18) has been used."
15. in Articles 7 (2) and 15 (2), the following points (c) and (d) are inserted after point (b):
"(c) the rules for the transmission of forest reproductive material under another legislation (13) and Annex 12 to this Regulation have been complied with;
(d) there is at least a minimum number of individuals per hectare laid down for timber by other legislation13) and ';
Point (c) shall be renumbered as point (e).
16. in Articles 7 (4) (b) and 15 (5) (b), the words "meliorating and strengthening timber" shall be replaced by the words "secured crops."
17. Article 8 shall be deleted, including the title.
18. footnote 15 reads:
"15) § 2 (8) of Decree No. 456 / 2021 Coll. '.
19. in Article 9 (2) (b), the word "planting" shall be replaced by the words "artificial replanting of seed first."
20. Paragraph 11 (3) reads:
"(3) The financial contribution for the rearing of forest areas up to 40 years of age shall be granted no more than twice over the period of validity of the forest plan or forest economic curriculum. ';
footnote 38 is deleted.
21. in Paragraph 11a (2) (c), the words "30% area representation of the meliorative and strengthening timber" shall be replaced by the words "40% area representation of the trees which, for a given set of forest types under another legislation (18), are meliorative and strengthening timber,"
22. in Article 11a (3), "§ 6 (2) (b) and (d) or § 7 (2) (c)" is replaced by "§ 6 (2) (b) and (e) or § 7 (2) (d)";
23. in Article 11b (2), the following points (b) and (c) are inserted after point (a):
"(b) the wood listed in the application is suitable for the appropriate set of forest types according to another legislation (18);
(c) replanting has been completed to the extent necessary during the calendar year in such a way that the number of viable individuals is at least the minimum number of individuals per hectare laid down for timber by other legislation13), ';
Points (b) to (d) shall be renumbered (d) to (f).
24. in Article 11b (2) (f), the words "artificial renewal by planting first" shall be inserted after the words "carried out."
25. Paragraph 11b (3) reads:
"(3) The completion of the subject-matter of the financial contribution shall mean the completion of the follow-up of the planting of the forest in the relevant calendar year, as a general rule, the implementation of the protection of unfenced planting against the winter cull of animals or the control and, to the extent necessary, the repair of the fencing of the planting before the end of the calendar year. ';
26. In Paragraph 11b, at the end of the text of paragraph 4, the words "immediately consecutive 'are added.
27. in Article 11b (5), the word "individual" shall be replaced by the word "appropriate" and at the end of the text of the paragraph the words "at the time of completion of the financial contribution."
28. after Paragraph 11b, the following paragraphs 11c and 11d are inserted:
Mechanical soil preparation before forest renewal
(1) A financial contribution may be granted if the quality of the work carried out and its compliance with forest management legislation is confirmed by the forestry industry.
(2) The fulfilment of the subject-matter of the contribution shall be understood to mean the removal or agitation of the sod or the wall.
(3) A financial contribution shall not be granted in the case of mechanical soil preparation by milling, provided that the contribution referred to in Article 3 (3) (d) is simultaneously required.
Saving pliers to piles or bales with its keeping to the ground
(1) A financial contribution may be granted if the quality of the work carried out and its compliance with forest management legislation is confirmed by the forestry industry.
(2) The volume of the cleavage corresponds to the volume of the culvert. At the request of the competent regional authority, the applicant shall provide evidence of the volume of the broken down by invoice, forest economic records or other production technical documents. '
29. in Article 12 (2), point (d) is deleted;
Points (e) to (i) shall be renumbered (d) to (h).
30. in Article 12 (2) (g), the word "or" shall be deleted;
31. In Article 12, at the end of paragraph 2, the dot is replaced by "or 'and the following point (i) is added:
"(i) placing the pear on piles or pits with its leaving to be turned over in the forest."
32. In Article 12, the following paragraph 7 is added:
"(7) A financial contribution to increase the proportion of meliorative and strengthening trees shall not be granted in the case of a deciduous larch or a tisolist Douglas. ';
33.In Articles 13 (2) (d), 14 (2) (e) and 15 (4), the words "meliorating and strengthening timber" are replaced by the words "timber."
34. in Article 14 (2) (c):
"(c) the seed material of wood has been used which is suitable for the appropriate set of forest types according to another legislation (18);"
35. in Article 14 (2), the following point (d) is inserted after point (c):
"(d) the rules on the transfer of forest reproductive material under another legislation (13) and Annex 12 to this Regulation have been complied with;"
Points (d) and (e) shall be renumbered as points (e) and (f).
36. in Article 15 (2) (b):
"(b) planting material capable of planting wood material which is suitable for the appropriate set of forest types under another legislation (18) has been used."
37. Paragraph 16 shall be deleted, including the title and footnote 30.
38. After Paragraph 21, the following Section 21a is inserted:

(1) A financial contribution may be granted if the quality of the work carried out and its compliance with forest management legislation is confirmed by the forestry industry.
(2) The volume of the cleavage corresponds to the volume of the culvert. At the request of the provider, the applicant shall demonstrate the volume of the broken down by invoice, forest economic records or other production technical documents. ';
Paragraph 35 (7) reads as follows:
"(7) The amount of the financial contribution for the preparation of forest plans shall be determined by the sum of the direct costs actually incurred per ha, up to a maximum of CZK 400 per ha, and the area of land intended for the performance of forest functions in hectares, as indicated in the accompanying note for the approved forest plan. The applicant who is the payer of value added tax and who claims to deduct value added tax on the performance received for the completion of the forest economic plan shall indicate the amount of the costs excluding value added tax for which he claims to deduct value added tax. '
40. In Paragraph 35b (1) of the introductory part of the provision, the words "if they were one of those persons at the time of completion of the subject-matter of the allowance, the legal successors of such person or persons managing the estate shall be those persons."
41. the words "and (g)" shall be added at the end of paragraph 2.
42. In Paragraph 35b, at the end of paragraph 3, the dot is replaced by "or 'and the following point (g) is added:
"(g) installation of a pheromone evaporator into a barrier trap."
43.In § 35b (6) (a):
"(a) the quality of the work carried out and its compliance with forest management legislation shall be confirmed by the forestry professional economy; and"
44. in Paragraph 36 (1), the words "user want22)" are replaced by the words "person who was a user want22) at the time when the subject of the financial contribution was fulfilled."
45. in Paragraph 36 (2), "the contribution referred to in § 41b" is replaced by "the contributions referred to in § 41a and 41b" and "the financial contribution referred to in § 41b" is replaced by "the financial contributions referred to in § 41a and 41b."
46. in Paragraph 37 (1) (i), "4 months" is replaced by "lack of food in winter."
47. in Paragraph 37 (3) (f), the word "metal" shall be replaced by "box" and the words "self-starting device" shall be inserted after the word "equipped."
48. In Paragraph 37, the following paragraph 5 is added:
"(5) The financial contribution referred to in paragraph 1 (c) shall not be granted in the territory of national parks. ';
49.Paragraph 41b (3), including footnote 40, reads:
"(3) A financial contribution may be granted to reduce the numbers of wild boar if, for the cuts referred to in the calculation of the contribution for the marketing year for which the contribution is requested,
(a) an examination for the presence of the musculature has been carried out by the competent authority40;
(b) the name and registration number of the hunting and marking of the seal are indicated in the order of their laboratory examination; and
(c) the production by the State Veterinary Administration of an unexamined or tail-free sample is not recorded, unless proof is provided of the supply of a caught piece to the customer who delivers the piece to the establishment in which the official veterinary inspection is carried out, or is presented for official veterinary inspection, provided that the seal of the piece is indicated in the document and that the consignment of the piece with the tail is confirmed by the customer.
40) § 27b paragraphs 6 and 7 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended. '
50. in Paragraph 41b, the following paragraph 4 is added:
"(4) The place of completion of the financial contribution for the reduction of wild pig numbers shall be the territory of the hunting ground in which the cuts referred to in the calculation of the contribution have been caught. ';
51. in Article 41d (1) and Article 41d (2) (b), the words "and parts thereof" shall be inserted after the word "establishment."
2. in Article 41d (2), the following point (b) is inserted after point (a):
"(b) a copy of the proof of approval or registration of the refrigeration equipment by the Regional Veterinary Administration;"
Points (b) and (c) shall be renumbered (c) and (d).

Explanatory notes:
