GOVERNMENT REGULATION
of 7 December 2009
determining, for the purposes of the Criminal Code, which plants or fungi are considered to contain a narcotic or psychotropic substance and which quantities are greater than small within the meaning of the Criminal Code
The Government orders pursuant to § 289 (3) of Act No. 40 / 2009 Coll., Criminal Code:
§ 1
Plants and mushrooms containing a narcotic or psychotropic substance within the meaning of Section 285 of the Criminal Code shall be considered as plants and mushrooms listed in Annex 1 to this Regulation.
§ 3
This Regulation shall enter into force on 1 January 2010.

List of plants and fungi to be considered as containing narcotic or psychotropic substances for the purposes of the Criminal Code
A. PLANTS
1. Cannabis plants (Cannabis sp.) - all species and varieties containing more than 0,3% of the substances of the tetrahydrocaninol group in the flowering or fruiting peak of the hemp plant (excluding grains) including leaves,
2. Cocaine (Erythroxylum coca).
B. HOUBY
Mushrooms containing psilocybin and psilicine
