laying down requirements on the quality of fuels used for inland and maritime vessels in terms of air protection
The Ministry of the Environment provides pursuant to Sections 3 (14) and 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 695 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 385 / 2005 Coll. and Act No. 212 / 2006 Coll.:
§ 1
Subject matter
(1) This Regulation (1) implements the relevant European Communities2) and regulates air protection
(a) the quality requirements for fuels used on inland waterway vessels (3) and seagoing vessels (4) flying the flag of the Czech Republic (hereinafter referred to as "marine fuels"), the requirements for sampling and verification of the quality of marine fuels, the manner and date of reporting of the sulphur content of those fuels;
(b) certification of the quality of marine fuels.
(2) This decree does not apply to the use of marine fuels
(a) research and testing;
(b) intended for processing before their final incineration;
(c) for further processing in the refinery industry;
(d) in vessels relevant for the purpose of ensuring the safety of vessels or saving life at sea;
(e) in the situations necessary to cause damage to the vessel or its equipment, provided that appropriate measures are taken to prevent or minimise excessive emissions after the damage has occurred; and
(f) on vessels using approved emission reduction technologies (5).
§ 2
Basic concepts
For the purposes of this decree:
(a) any liquid fuel derived from oil suitable for use on board vessels and fuels listed in Annex 1;
(b) marine diesel, any marine fuel the density or viscosity of which corresponds to the density or viscosity value for the DMB and DMC classes listed in Annex 1;
(c) any marine gas oil of which the density or viscosity of which corresponds to the density or viscosity value for the DMX and DMA classes listed in Annex 1;
(d) by a distributor, a legal person or an undertaking natural person who places the first fuel on the market;
(e) the placing on the market of the supply or supply of marine fuels to third parties for use on board vessels anywhere in the sovereign territory of the Czech Republic, with the exception of the supply or supply of marine fuels for export in containers of vessels.
§ 3
Quality requirements for marine fuels
(1) The sulphur content of marine fuels used on seagoing vessels pursuant to Article 1 (1) (a) may not be more than 1,5% by weight in the Baltic Sea and its ports and North Sea ports and its ports. The sulphur content of marine fuels used on seagoing vessels on other seas shall be governed by the provisions of Annex VI to MARPOL 73 / 78 of the International Convention for the Prevention of Pollution from Ships 1973, including the Protocol to the 1978 Convention.
(2) The sulphur content of the marine gas oil first placed on the market of the Czech Republic must not exceed:
(a) 0,2% by weight until 31 December 2009,
(b) 0,1% by weight as from 1 January 2010.
(3) Sulphur content of marine fuels used from 1 January 2010
(a) inland vessels;
(b) seagoing vessels in ports of Member States of the European Union
shall not exceed 0,1% by weight.
(4) The change to the required marine fuel for seagoing vessels shall take place as soon as possible after the vessel has arrived at the port of the Member State of the European Union and any change to the original marine fuel shall take place as soon as possible before its departure.
(5) The provisions of paragraphs 3 and 4 shall not apply to cases:
(a) where, according to the published timetable, the vessel does not stay longer than 2 hours or all engines are switched off at the site and, for the whole period of time, draws electricity from the shore;
(b) inland vessels certified to comply with the International Convention for the Safety of Life at Sea and at Sea.
§ 4
Sampling and verification of the quality of marine fuels
(1) The distributor provides sampling to verify the quality of marine fuels. Sampling shall be carried out in accordance with the procedures set out in Annex 2.
(2) The analysis of the sample of marine fuel taken pursuant to paragraph 1 shall be carried out in accordance with the procedures laid down in Annexes 1 and 2 and the results shall be recorded (6).
(3) Monitoring of the sulphur content of marine fuels first placed on the market of the Czech Republic, which ensures the Czech Trade Inspection7) is carried out on a continuous basis by sampling of marine fuels from the distributor. Analyses of samples taken to monitor quality indicators of marine fuels shall be carried out by an accredited person (7), which shall issue an appropriate protocol on the outcome of the analysis.
(4) The procedures for verifying the quality of marine fuels used on seagoing vessels shall be laid down by the International Convention for the Prevention of Pollution from Ships 1973, including the Protocol to the 1978 Convention, and shall be checked by the authorities of coastal States.
§ 5
Certification of the quality of marine fuels
(1) A document certifying the quality of marine fuels (hereinafter referred to as the certificate) is issued by a distributor and is part of each supply of marine fuel. A sealed sample of the fuel supplied is also included in the certificate on the quality of the ship's fuel.
(2) The certificate on the quality of the marine fuel contains:
(a) if a legal person is involved, the distributor's identification data, the company's legal form, the address of the registered office, the identification number, if any; if it is an operating natural person, the name or, where applicable, the name and surname, the identification number, if assigned, the date of birth and the address of the place of permanent residence or the address of residence, or the place of business of persons who are not citizens of the Czech Republic;
(b) the type of marine fuel, its production name and combined nomenclature code 8),
(c) a declaration of compliance with the requirements laid down for marine fuel by this decree and the relevant technical standards, indicating the actual sulphur content, the date of the last quality control and the laboratory identification data which has been analysed;
(d) the weight of the ship's fuel supply;
(e) the date of loading of the marine fuel; and
(f) the name and surname of the person who issued the fuel certificate and the date of issue of the certificate.
§ 6
Reporting of sulphur content of marine fuels
The quantity and sulphur content of marine fuels shall be notified annually by the distributor to the Ministry of the Environment by 31 March for the previous calendar year in accordance with point 2 of Annex 3.
§ 7
Transitional provision
Paragraph 3 (1) shall apply:
(a) for the North Sea region as from 11 August 2007,
(b) for areas of other sea areas, including ports which are subsequently designated by the International Maritime Organisation as a sulphur emission control area, 12 months after the entry into force of this measure.
§ 8
Efficacy
This decree shall take effect on the day of its publication.

SAMPLING AND ANALYSIS PROCEDURES FOR SHIPS
(1) Sampling to meet the requirements of Section 4 to obtain a representative sample shall be carried out according to the procedure of ČSN EN ISO 3170 (65 6005) Liquid petroleum products - manual sampling. The sampling shall verify the occurrence of systematic errors within the meaning of that standard.
(2) Sample analysis procedures:
(a) The reference method for determining the sulphur content of marine fuels is CSN EN ISO 8754 (65 6035) Petroleum products - Determination of sulphur content - Method of X-ray fluorescence with energy dispersion and CSN EN ISO 14596 Petroleum products, determination of sulphur - long-wave dispersion fluorescent spectrometry
(b) The arbitration method for determining the sulphur content of marine fuels is CSN EN ISO 14596 Petroleum products, determination of sulphur - long-wave dispersion fluorescent spectrometry.
(c) Statistical interpretation of the verification of the sulphur content of marine fuels will be in accordance with ČSN EN ISO 4259 Petroleum products - Determination and use of conformity data in relation to test methods.
