DECLARATION
Ministry of Transport and Communications
of 5 December 2000
amending Decree No. 101 / 1995 of the Ministry of Transport Coll., issuing the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport
The Ministry of Transport and Communications provides, pursuant to § 66 (1), for the implementation of § 45 (3) and § 48 (1), in an agreement with the Ministry of Health pursuant to § 66 (2) and in an agreement with the Ministry of Interior pursuant to § 66 (3) of Act No. 266 / 1994 Coll., on Railways, as amended:
Čl. I
Decree No. 101 / 1995 Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, is amended as follows:
1. in Paragraph 4 (2), including footnote 3, the following shall be added:
"(2) Emergency preventive inspection shall be carried out at the request of the railway operator or railway transport4) for persons referred to in § 1 (1)
(a) on the basis of the regulations of the railway administration, 3)
(b) if their activity has shown shortcomings in the health situation which may jeopardise the safety of the runway or railway transport,
(c) in circumstances where there is evidence of a change in medical fitness for the activity carried out, in particular at the initiative of any treating physician, or prior to the start of the activity after a disease for which a change in medical fitness cannot be excluded or for more than eight weeks;
(d) upon direct participation in an emergency, if requested by the authority responsible for the emergency investigation pursuant to special regulations, 5)
(e) prior to the taking up of an activity for which a medical assessment has been carried out, after the cessation of work lasting more than six months.
3) § 45 paragraphs 4 and 5 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll. '
2. Paragraph 6 (4) reads as follows:
"(4) The medical assessment is a basis for railway operators and railway transport operators in negotiating the type of work in the employment contract. 7) '.

„§ 8
(1) Persons aged 21 may drive railway vehicles or cableway installations unless otherwise specified.
(2) Driving a motor driving vehicle and a special driving vehicle on a special track (metro) can be used by persons who have reached the age of 18 years.
(3) To drive a railway vehicle on a tram track only for handling trips in depots can persons who have reached the age of 18. '
4. in Paragraph 9 (1) (a), including footnote 10a, the following shall be added:
"(a) full secondary vocational education10) acquired in the field of education, classified in the group of disciplines 26, according to the Single Classification of the fields of education and, where appropriate, the Classification of tribal fields of education, 10a)
10a) Measures of the Czech Statistical Office of 16 June 1998 on the introduction of the Classification of Tribal Fields of Education, notified in amount 68 / 1998 Coll. '
5. in Article 9 (2) (a):
"(a) secondary vocational education11) acquired in the field of education classified in the group of disciplines 26, according to the Single Classification of fields of education and, where applicable, the Classification of tribal fields of education, 10a)."
6. in Article 9 (3) (a):
"(a) secondary vocational education11) acquired in the field of education classified in the group of disciplines 26, according to the Single Classification of fields of education and, where applicable, the Classification of tribal fields of education, 10a)."
7. in Article 9 (4) (a):
"(a) full secondary vocational education10) obtained in the field of education classified in the group of fields 24 or 26 according to the Single Classification of fields of education or, where appropriate, in the group of fields 23 or 26 according to the classification of basic fields of education, 10a)."
8. in Article 9 (5) (a):
'( a) secondary vocational education11) acquired in the field of education classified in the group of fields 24 or 26 according to the uniform classification of fields of education or, where applicable, in the group of fields 23 or 26 according to the classification of the classes of training, 10a) '.
9. in Article 9 (6) (a):
"(a) secondary vocational education11) acquired in the field of education classified in the group of fields 24 or 26 according to the Single Classification of fields of education or, where appropriate, in the group of fields 23 or 26 according to the classification of groups of education, 10a)."
10. In Article 9 (8), the words "self-propelled railway vehicle, designed for the maintenance, repair and reconstruction of the runway or for the control of track condition, the removal of accidents and incidents, 'are deleted.
11. in Article 9 (8) (a):
"(a) secondary vocational education11) acquired in the field of education classified in the group of fields 24 or 26 according to the Single Classification of fields of education or, where appropriate, in the group of fields 23 or 26 according to the classification of groups of education, 10a)."
12. In Article 9, the following paragraph 9 is added:
"(9) The conditions of education and professional competence of persons to drive a special driveline are
(a) completed primary education, 13)
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part D, which is part of this Decree; the contents of the test in Part 1 of the Annex are limited to the operation of the tractor;
(d) operator training in the special part of the propulsion vehicle, maintenance and repair of at least four weeks;
(e) driving training in the driving and operating of a special driving vehicle of at least four weeks;
(f) a test of professional theoretical and practical knowledge before the administrative department. ';
13. the following Section 11a is inserted after Section 11:
„§ 11a
The conditions of education and professional competence of persons to drive on a tram only for handling trips in a depot are
(a) completed primary education, 13)
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part G, which is part of this Decree, is limited to handling trips in the depot;
(d) training in driving and operating of a driving vehicle on a tram track of at least 25 hours;
(e) training in the removal of propulsion vehicle operating failures on a tram track of at least 8 hours;
(f) knowledge of road traffic rules (14) within the scope of tram drivers;
(g) a test of professional theoretical and practical knowledge before the administrative department. "
14. in Article 12 (d):
"(d) training in the driving and operating of a trolleybus of at least 25 hours,"

„§ 16
(1) For the control of a driving vehicle of another type of the same traction, the competence shall be supplemented by an examination before the groove of the administration from the knowledge of the design, maintenance and control of that type of driving vehicle (additional test).
(2) For the control of cableway tracks of another type, the competence shall be supplemented by an examination before an administrative grooving authority from the knowledge of the design, maintenance and control of the cableway track (additional test).
(3) The condition for carrying out an additional test is:
(a) on a national track, on a regional track and on a tractor, training in a propulsion vehicle repair plant with a focus on a given type of propulsion vehicle of at least two weeks' duration, only if the first additional test is for electric power vehicles for another power supply system or multiple power supply systems, or motor propulsion vehicles with other power transmission, or for another type of special propulsion vehicle; no training is required for other additional tests;
(b) training on a special course aimed at knowledge of the design, maintenance and removal of vehicle failures of at least 25 hours;
(c) at a tram and trolleybus track training in the removal of operational defects of at least 15 hours;
(d) driving training in driving and operating of a given type of driving vehicle under supervision
1. in the case of railway tracks, except for a special track of at least two weeks;
2. for a tram, trolleybus or special track of at least 15 hours;
(e) on the rope track:
1. cableway management training (operation and maintenance of cableway, knowledge of ropes, detection and removal of failures, use of rescue equipment, operation of a replacement power source) of at least one week,
2. operator of cableway propulsion (control) under supervision of at least one week. ';
16. footnote 16 shall read:
"16) § 48 paragraph 1 of Act No. 266 / 1994 Coll., as amended by Act No. 23 / 2000 Coll. § 1 of Decree No. 100 / 1995 Coll., as amended by Decree No. 279 / 2000 Coll. '
17. in Article 17 (1) (a), including footnote 16 (a),
"(a) full secondary vocational education10) or higher education16a)
1. obtained in the field of education classified in the group of disciplines 24 or 26 according to the Single Classification of fields of education, or, where applicable, in the group of disciplines 23 or 26, or achieved in the study programmes of the group of disciplines 23 or 26, the classification of the classes of education for the revision of pressure, gas, lifting and transport equipment, containers and swap bodies and the welding of railway vehicles and rails;
2. acquired in the field of education classified in the group of disciplines 26 according to the Single Classification of fields of education, or by the Classification of Common disciplines of education10a) or achieved in the study programmes of the group of disciplines 26 Classification of Common disciplines of education for the revision of electrical equipment,
16a) § 44 of Act No. 111 / 1998 Coll., on Higher Education and on the amendment and addition of other laws (Act on Higher Education). '
18. in Article 17 (1) (b):
'(b) professional experience in the design or manufacture or operation of designated technical equipment
1. for at least one year if the applicant has a higher education, 16a)
2. for a period of at least three years, if the applicant has complete secondary vocational education, 10). "
19. in Article 17 (1) (e) (1), the words "wound structures" shall be deleted;
20. in Article 17 (1) (c), the words "under the supervision of a revision technician certified and experienced for at least five years" shall be inserted after the words "three months."
21. Paragraph 17 (4) reads:
"(4) Achieving the competence of persons to carry out in-service inspections and tests of designated technical equipment (" the inspector ') requires:
(a) higher education16a) achieved in the study programmes of the group of disciplines 23 or 26 Classification of the subjects of education, 10a)
(b) professional experience in the design, construction, assembly, repair, operation or execution of revisions of the relevant designated technical installations of at least five years. The practice of the revision welding technique is recognised only for the competence of the inspector of pressure equipment, containers, swap bodies, welding and defectoscopy,
(c) training to carry out inspections and tests of the relevant designated technical equipment in operation for a period of at least three months, under the supervision of an inspector certified;
(d) the examination of the technical knowledge of the designated technical equipment in question before the commission established by the Ministry of Transport and Communications. The content and professional orientation of the test is given in Annex 5, Part B, which is part of this Decree,
(e) competence in electrical engineering with qualifications
1. "person instructed" means the inspector of pressure equipment, gas equipment, lifting equipment, transport equipment, containers and swap bodies, welding and defectoscopy;
2. "person qualified" for an inspector of electrical equipment. "
22. Paragraph 18 (2), including footnote 17, reads:
"(2) The test may be carried out by an applicant who:
(a) establish his identity;
(b) submit an extract from the Register of Penalties which is not more than three months old to prove that he has not been convicted of a criminal offence committed negligently related to an activity authorised or committed intentionally. This extract does not need to be presented in the supplementary test according to § 16,
(c) provide evidence of compliance with the medical conditions under this Order;
(d) has submitted evidence of compliance with the conditions of professional competence under this Order (in the test run these documents are the certificate of professional competence);
(e) provide proof of payment of the administrative fee. 17)

23. In the first sentence of Part A of Annex 1, the words "and on the rope track 'are deleted.
24. In the first sentence of Part B of Annex 1, the words "and on the rope track 'are deleted.
25. In Annex No 1, Part C., the first sentence is as follows: "Conditions of medical fitness of applicants for a licence to drive a railway vehicle and persons driving a railway vehicle on a tramway track, trolleybus track and applicants for a licence to drive a cableway track and persons driving a cableway track on entry medical examinations."
26. In Annex 1, Part D, the first sentence is: "Conditions of medical fitness of persons driving a railway vehicle on the tram, trolleybus and cableway drivers during regular and exceptional preventive medical examinations'.
27. In Annex 4, Part A., point 1.4, the words "accident and 'are deleted.
28. In Annex 4, Part B., point 1.4, the words "accident and 'are deleted.
29. In Annex 4, Part D., point 1.4, the words "accident and 'are deleted.
30. In Annex 4, Part E., point 1.3, the word "accidents' is replaced by" incidents'.
31. In Annex No 4, Part F., point 1.1, the word "accidents' is replaced by" incidents'.
32. In Annex 4, Part G., point 1.3, the word "accidents' is replaced by" incidents'.
33. In Annex 4, Part H., point 1.3, the word "accidents' is replaced by" incidents'.
34. In Annex 4, Part I, point 1.3, the words "accident measures' are deleted.
35. In Annex No 5, Part A. (I) (1), the following is added at the end: "and Decree of the Ministry of Transport No. 101 / 1995 Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport '.
36. In Annex 5, Part B. (I) (7):
"7. Calculation of basic parameters and quantities by type of specified technical equipment."

This decree shall take effect on 1 January 2001.
