DECLARATION

amending Decree No. 48 / 2005 Coll., on basic education and certain formalities for compulsory education
The Ministry of Education, Youth and Sports provides, pursuant to Sections 38 (7) and 56 of Act No. 561 / 2004 Coll., on Pre-school, Basic, Medium, Higher Vocational and Other Education (Education Act):
Decree No 48 / 2005 Coll., on basic education and certain formalities for compulsory education, is amended as follows:
1. In Article 15 (6), at the end of point (c), the dot is replaced by a comma and the following point (d) is added:
"(d) not evaluated."
2. In Article 15 (7), the words "or if it is not assessed at the end of the second semester," shall be added at the end of point (c).
3. In Article 15 (7), the dot is replaced by a comma and the following point (d) is added:
"(d) not evaluated (a) unless it is possible to evaluate the pupil from one of the compulsory subjects provided for by the school curriculum at the end of the first semester."
4. Paragraph 16 (3) reads as follows:
"(3) The final evaluation shall be issued by the school to the pupil at the end of the first half of the school year in which he fulfils compulsory schooling. '.
5. In Section 16, paragraphs 4 and 5 are added, including footnote 13a:
"(4) The school will also issue an output assessment to the student in the fifth and seventh year of primary education if he is applying for secondary education. The school's output evaluation shall be issued within 10 working days of the submission of the application for secondary education, but first at the end of the first semester and no later than 5 working days after the last day set for the submission of the applications 13a).
(5) In the case of an application for admission to the field of education in which a talent test is provided as part of the admission procedure, the school shall issue the student an output evaluation within 10 working days of the submission of the application for secondary education, but not earlier than 30 October and not later than 5 working days after the last day set for the submission of applications 13a).

6. In Paragraph 18 (2), the words "in the school curriculum 'are replaced by the words" in the relevant years of the school curriculum'.
7. in Paragraph 18, the following paragraph 5 is added:
"(5) A pupil shall not perform the examination referred to in paragraph 1 (a), (b) or (c) if he is a pupil of a foreign school in whose training programme the educational content referred to in paragraph 1 (a), (b) or (c) is included in an agreement with the Ministry of Education, Youth and Sports or under an international agreement, and the pupil is evaluated by a foreign school in the relevant period for a certificate. In such a case, the principal of the school or other school registered in the school register chosen by the legal representative of the pupil shall not issue a certificate to the pupil for the relevant period. '
8. In Paragraph 21, the following paragraph 2 is inserted after paragraph 1:
"(2) A pupil who has completed compulsory schooling at a foreign school and continues to perform compulsory schooling at a school or other school registered in a school register chosen by the legal representative of the pupil and has not passed the examinations referred to in Article 18 (1), shall, in accordance with Article 18 (5), include the principal of that school in the relevant year on the basis of the opinion of the foreign school on the success of the completion of the relevant year of basic education."
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
9. In Article 21 (5), the words "paragraphs 1 and 2 'shall be inserted after the words" pursuant to Paragraph 18'.
Efficacy
This Decree shall take effect on 1 October 2006.
