DECLARATION

of 23 July 2004

on the declaration of the National Natural Monuments of the Miroslav Hill and the establishment of its closer protection conditions

The Ministry of the Environment provides pursuant to § 79 (3) (b) and § 37 (1) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll., hereinafter referred to as "the Act ':

§ 1

Subject matter

(1) The National Natural Monument of the Miroslav Hill ("National Natural Monument") is announced.

(2) The object of protection is the rare remnants of the species-rich plant and animal communities of rocks and steppic lawns on the blind background in the southernmost tip of the Bohrava Highlands.

§ 2

Definition of national natural heritage

(1) The national natural monument is situated in the cadastral territory of Miroslav. The boundaries of the national natural monument are determined by closed geometric patterns with direct sides whose vertices are determined by coordinates given in the S-JTSK1 coordinate system). The lists of coordinates of closed geometric patterns and their individual vertices arranged as they follow in the pattern are contained in Annex 1. The indicative graphical representation of the territory of the national natural monument is contained in Annex 3.

(2) The map materials in which the territory of the national natural heritage is drawn are stored in the central list of nature conservation (Section 42 of the Act) at the Nature and Landscape Protection Agency and at Miroslav Municipal Office.

§ 3

Closer protection conditions for national natural heritage

Only with the consent of the competent nature conservation authority (§ 44 (2) and § 79 (3) (g) of the Act) can the national natural monument:

(a) make changes to the type of land or the way in which it is used (2);

(b) make changes to completed structures or to changes to structures before their completion (m3);

(c) adjust the road surface (4) using non-local natural material;

d) Marking cycling and walking paths 5),

(e) driving vehicles (6) into the territory of the national natural heritage; consent is not required for vehicles of the Czech Police and municipal police and other public and public authorities in the performance of public administration, rescue services, state defence and veterinary services, vehicles needed for the care of forest or agricultural land or crops; the approval is not further required for the entry of vehicles into the water building area by road on plot No 2960 / 1 in the cadastral territory of Miroslav; consent is also not required for cycling on motorcycling routes marked on the ground;

(f) to store, even temporarily, any materials including wood;

(g) carry out geological work linked to the intervention into the territory (7);

(h) to feed animals outside existing hunting facilities;

(i) to establish new hunting equipment;

(j) camp;

k) start fires.

§ 4

Protection zone

The protection zone of the national natural heritage is situated in the cadastral territory of Miroslav. The boundaries of the national natural heritage protection zone shall be determined by six separate enclosed geometric shapes with direct sides whose vertices are determined by the coordinates given in the current S-JTSK1 coordinate system). The lists of coordinates of enclosed geometric patterns and their individual vertices arranged as they follow in the pattern are contained in Annex 2. The indicative graphical representation of the territory of the protection zone of the national natural heritage is contained in Annex 3.

§ 5

This Decree shall take effect on 15 August 2004.
