DECLARATION
of 31 October 2025
laying down conditions for the cessation of waste liquid and gaseous fuel
The Ministry of the Environment and the Ministry of Industry and Trade provide, pursuant to § 9 (7), § 15 (5) (a) and § 94 (2) of Act No. 541 / 2020 Coll., on Waste, hereinafter referred to as "the Act":
§ 1
Subject matter
(1) The Order provides for:
(a) the types of liquid and gaseous fuel from waste which cease to be waste;
(b) the moment when the waste liquid and gaseous fuel ceases to be waste;
(c) the specific purposes for which liquid and gaseous fuel from waste may be used;
(d) requirements for waste entering the recycling or recovery process from which liquid or gaseous fuel is generated from waste;
(e) the process of treatment of waste under the recycling or recovery process during which liquid or gaseous fuel is generated from waste;
(f) the qualitative criteria which liquid and gaseous fuel from waste must meet in order to cease being waste;
(g) sampling and testing requirements;
(h) particulars of accompanying documentation;
(i) the data requirements for waste which is transferred to a recovery facility from which liquid or gaseous fuel comes out of waste; and
(j) requirements for keeping a continuous record of waste management in a recovery facility where liquid or gaseous fuel is produced from waste.
(2) This Decree does not apply to biogas coming out of a biodegradable waste facility which has ceased to be waste pursuant to Section 53 (1) of Decree No 273 / 2021 Coll., on the details of waste management.
§ 2
Requirements for liquid and gaseous fuels from Category I waste
(1) The requirements for ending the waste regime for liquid or gaseous fuel from Category I waste are as follows:
(a) liquid or gaseous fuel from waste of category I shall be produced only from waste which cannot be disposed of in a more appropriate manner in accordance with the waste management hierarchy and which at the same time satisfy the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council of 20 June 2019 on persistent organic pollutants;
(b) where liquid or gaseous fuel from Category I waste is produced from hazardous waste, the hazardous waste shall have only hazardous properties that will also have produced fuel and which are common to liquid and gaseous fuels that are not made from waste, or which have hazardous properties that are removed before the end of the fuel production process, and their disposal is confirmed in the framework of the evaluation of hazardous waste properties by law;
(c) liquid or gaseous fuel from waste category I is produced in a stationary waste recovery facility which is operated on the basis of a permit to operate an installation pursuant to Section 21 (2) of the Act,
(d) in the case of liquid fuel from Category I waste;
1. satisfy, regardless of how it is used, the requirements for the quality of liquid fuels pursuant to Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and implementation of certain other provisions of the Air Protection Act, as amended; the water content and calorific value parameter shall be fulfilled regardless of the fuel use method; and
2. the content of pollutants in the fuel shall not exceed the maximum permissible content of pollutants set out in Table 1.1 of Annex 1 to this Decree;
(e) in the case of gaseous fuel from Category I waste, the content of the pollutants in the fuel shall not exceed the maximum permitted content of the pollutants set out in Table 1.2 of Annex 1 to this Decree;
(f) liquid or gaseous fuel from waste of category I;
1. uses energy in the combustion stationary source which meets the requirements set for the combustion stationary source with a total rated thermal input greater than 5 MW in the Act on the Protection of the Souls (1) and in Decree No. 415 / 2012 Coll., or
2. shall be used outside the combustion stationary source as fuel under the Fuel Act (2); in such a case, meet the fuel requirements laid down in Decree No. 516 / 2020 Coll., on fuel requirements and the implementation of certain other provisions of the Fuel Act, as amended,
(g) in the case of liquid or gaseous fuel from Category I waste which has been produced by pyrolysis or gasification, the combustion of that fuel in a specific combustion stationary source shall not cause the same or higher emissions of nitrogen oxides, carbon monoxide and solid pollutants than those resulting from the combustion of the least polluting fuel on the market which could be incinerated in that combustion stationary source, and the emissions of polychlorinated dibenzodioxins and polychlorinated dibenzofurans shall not exceed the emission limit set for the heat treatment of waste pursuant to Decree No 415 / 2012 Coll.
(2) Compliance with paragraph 1 (g) is verified by one-off emission measurements under the Air Protection Act
(a) in the combustion test carried out before each start of the regular combustion of fuel of the same characteristics produced in one stationary installation; the combustion test shall be carried out with fuel from waste without additives; and
(b) subsequently, in the case of the combustion of that fuel, regularly at intervals once per calendar year, one-off emissions measurements shall be made when the fuel is fired from waste without additives.
(3) For the purpose of demonstrating compliance with the requirement laid down in paragraph 1 (g), one-off emissions measurements shall be carried out under the Law on the protection of the air from the combustion of the least polluting fuel on the market which could be incinerated in a given stationary source to obtain a reference value for emissions of nitrogen oxides, carbon monoxide and solid pollutants.
(3) Liquid or gaseous fuel from waste category I shall cease to be waste when the technological process of its production is completed in a stationary waste recovery facility, compliance with the requirements of paragraph 1 is ensured, sampling and testing is carried out and accompanying documentation is prepared in accordance with § 5. The fuel to be used for the combustion test referred to in paragraph 2 (a) may cease to be waste without verifying compliance with paragraph 1 (g).
§ 3
Requirements for liquid and gaseous fuels from Category II waste
(1) The requirements for the termination of a waste regime for liquid or gaseous fuel from waste of category II which does not meet the requirements of Paragraph 2 (1) are as follows:
(a) liquid or gaseous fuel from waste of category II is produced only from waste which cannot be disposed of in a more appropriate way in accordance with the waste management hierarchy and which at the same time satisfy the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council;
(b) where liquid or gaseous fuel from Category II waste is produced from hazardous waste, such hazardous waste shall have only hazardous properties which will also have produced fuel and which are common to liquid and gaseous fuels that are not generated from waste, or which have hazardous properties that are removed before the end of the fuel production process, and their disposal shall be confirmed in the framework of the evaluation of hazardous waste properties by the legal procedure;
(c) liquid or gaseous fuel from Category II waste is produced in a stationary waste recovery facility which is operated on the basis of an installation permit pursuant to Article 21 (2) of the Act;
(d) liquid or gaseous fuel from waste of category II shall be immediately transferred from the waste recovery facility referred to in point (c) to a combustion stationary source with a total rated thermal input of more than 20 MW, to a waste incineration plant or to a rotary furnace for the production of cement clinker or rotary, shaft or other lime kilns in which energy is used and which meet the following conditions:
1. are operated on the territory of the Czech Republic,
2. are specifically defined in the accompanying documentation of liquid or gaseous fuel from waste;
3. are operated on the basis of an operating permit issued for the heat treatment of waste pursuant to the Air Protection Act, or on the basis of an integrated permit issued under Act No. 76 / 2002 Coll., on Integrated Pollution Prevention and Control, on the Integrated Pollution Register and on the amendment of certain laws (the Integrated Prevention Act), as amended, and
4. are part of a project subject to a permit under a building law,
(e) for energy use in stationary sources as referred to in point (d), the same requirements are laid down for the combustion of gaseous or liquid fuel from Category II waste under the Air Protection Act, Act No. 76 / 2002 Coll., Decree No. 415 / 2012 Coll. and according to the best available techniques (3) as if heat treatment of waste were taking place; and
(f) liquid or gaseous fuel from Category II waste is specifically defined as input material in the authorisation to operate the stationary source referred to in point (d) in which it will be used.
(2) Liquid or gaseous fuel from Category II waste ceases to be waste when the process of production of waste is completed in a stationary waste recovery facility, the requirements laid down in paragraph 1 are met and the accompanying documentation referred to in Section 5 is drawn up.
§ 4
Requirements for liquid fuel fuel fuel oil from waste oils
(1) The requirements for the cessation of waste treatment for liquid fuel fuel fuel fuel oil from waste oils are as follows:
(a) the liquid fuel of fuel oil from waste oils is produced exclusively from waste oils which cannot be disposed of in a more appropriate way in accordance with the waste management hierarchy and which at the same time satisfy the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council;
(b) the liquid fuel fuel fuel from waste oils is produced in a stationary waste recovery facility which is operated on the basis of an installation permit pursuant to Article 21 (2) of the Act;
(c) the liquid fuel fuel fuel fuel from waste oils meets the requirements for the quality of liquid fuels according to Decree No. 415 / 2012 Coll.; the water content and calorific value parameter must be fulfilled regardless of the fuel use method;
(d) the liquid fuel of fuel oil from waste oils meets the requirements of technical standard CSN 65 6691 Petroleum products - Waste oil fuel oils - Technical requirements and test methods;
(e) the liquid fuel fuel of fuel oil from waste oils shall be immediately transferred from the waste recovery facility referred to in (b) to the combustion stationary source, to the rotary furnace for the production of cement clinker or to the rotary, shaft or other lime kilns in which it is energetic and which meet the following conditions:
1. are operated on the territory of the Czech Republic,
2. are specifically defined in the accompanying documentation of liquid fuel fuel fuel fuel fuel oil from waste oils;
3. are operated on the basis of a traffic permit under the Air Protection Act or an integrated permit issued under Act No. 76 / 2002 Coll., which replaces it, and
4. are part of a project subject to a permit under a building law,
(f) for energy use in stationary sources referred to in (e), the same requirements for the combustion of liquid fuel fuel fuel fuel oil from waste oils are laid down as those laid down for the combustion stationary source with a total rated thermal input greater than 5 MW or for the rotary furnace for the production of cement clinker or rotary, shaft or other furnace for the production of lime in the Air Protection Act and Decree No. 415 / 2012 Coll.; and
(g) the liquid fuel fuel fuel from waste oils is specifically defined as the input material in the authorisation to operate the stationary source referred to in point (e) in which it will be used.
(2) The liquid fuel fuel fuel from waste oils ceases to be waste when the technological process of its production is completed, the requirements laid down in paragraph 1 are met and the accompanying documentation referred to in Article 5 is drawn up.
§ 5
Supporting documentation
The contents of the accompanying documentation, which must be provided with each individual supply of liquid or gaseous fuel from the waste at the latest at the time of exit from the establishment in which it was produced, shall be determined by:
(a) for liquid or gaseous fuel from waste of category I pursuant to Section 2 of Table 2.1 of Annex 2 to this Decree,
(b) for liquid or gaseous fuel from waste of category II pursuant to Section 3 of Table 2.2 of Annex 2 to this Decree,
(c) for liquid fuel fuel fuel fuel oil from waste oils, as defined in Section 4 of Table 2.3 of Annex 2 to this Decree.
§ 6
Waste data
(1) The information on waste which is transferred to a waste recovery facility for the production of liquid or gaseous fuel from waste pursuant to § 2, 3 or 4 shall include a justification for why waste cannot be disposed of in another way in accordance with the waste management hierarchy.
(2) The data on waste which is transferred to a recovery facility for the production of liquid or gaseous fuel from waste pursuant to § 2, 3 or 4 shall include data on the producer of waste and the origin of the waste, with the justification that the waste is deemed to meet the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council.
(3) Where it is not possible to demonstrate on the basis of data on the origin of waste that the waste will meet the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council, data on the content of persistent organic pollutants, the content of which cannot be excluded, including sampling and testing protocols or copies thereof, shall also be included.
§ 7
Interim registration
For each recorded data on the production of liquid or gaseous fuel pursuant to this Decree, a unique delivery identification number and a copy of the relevant accompanying documentation shall be included in the continuous record of waste of the operator's recovery facility. Each record of the production of liquid or gaseous fuel under this Decree shall be accompanied, within 1 week of delivery, by a document issued by the operator of a stationary source confirming receipt of the supply and containing a clear identification of the stationary source in which the liquid or gaseous fuel from the waste is recovered, by a unique delivery identification number and the weight and volume of fuel supplied in the supply. In the case of Category I fuel which is fuel and is not fired in a stationary source, a take-over document issued by the customer shall be attached within 1 week of delivery.
§ 8
Sampling and testing requirements
(1) Methods for sampling and carrying out tests must be representative and conclusive and must reflect as accurately as possible the actual fuel quality. The requirement under the first sentence is met if the appropriate method set out in Annex 3 to this Decree is used for that purpose.
(2) When performing the test, each individual test shall represent only the complete amount of completed homogeneous fuel placed in the storage or transport equipment.
(3) The samples of liquid or gaseous fuel taken pursuant to this Decree shall be kept for at least 6 months from their collection and marked in such a way as to indicate the period from which the complete quantity of completed homogeneous fuel to which the sample belongs originates.
§ 9
Notification of technical regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 10
Efficacy
This Decree shall take effect on 1 January 2026.

(1) In the case of fuel which will not be incinerated in a stationary source, the customer first to take over the fuel shall be given the data relating to the identification of the stationary source and the verification of the conditions referred to in Article 2 (1) (g) shall not be completed.
(2) The identification of the emission measurement document for the best available fuel combustion test and the evidence of the last one-off emission measurement for the combustion of the liquid or gaseous fuel concerned shall be provided.
