DECLARATION
of 14 December 2017
amending Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and implementation of certain other provisions of the Air Protection Act, as amended
The Ministry of the Environment provides pursuant to § 4 (9), § 6 (9), § 12 (8), § 16 (9), § 17 (7), § 32 (8) and § 34 (5) of Act No. 201 / 2012 Coll., on Air Protection, as amended by Act No. 87 / 2014 Coll. and Act No. 369 / 2016 Coll., ("the Act '):
Čl. I
Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and on the implementation of certain other provisions of the Air Protection Act, as amended by Decree No. 155 / 2014 Coll., Decree No. 406 / 2015 Coll. and Decree No. 171 / 2016 Coll., is amended as follows:
1. At the end of footnote 1, the sentence "Directive 2015 / 2193 / EU of the European Parliament and of the Council of 25 November 2015 on the limitation of emissions of certain pollutants to air from medium combustion plants' is added.
2. In Article 1 (1) (b), the words "the method of determining emission limits for odourless substances' shall be inserted after the words" specific emission limits'.
3. In Article 1 (1) (f), the words "a document on the control of the technical condition and operation of the combustion stationary source on solid fuels with a rated thermal input of 10 to 300 kW inclusive," shall be inserted after the words "emission measurement," and shall be inserted after the words "a document on the control of the technical condition and operation of the combustion stationary source on solid fuels with a rated heat input of 10 to 300 kW inclusive,"
4. In Article 2, at the end of point (e), the dot is replaced by a comma and the following point (f) is added:
"(f) nitrogen oxides (NOx) nitric oxide and nitrogen dioxide expressed as nitrogen dioxide.";
5. In Paragraph 3 (1) of the Introductory Part of the provision, the words "within 4 months at the latest 'shall be inserted after the words" shall be implemented'.
6. In Paragraph 3 (1) at the end of point (c), the comma is replaced by a dot and the words "within 3 months at the latest of the occurrence of any of these facts or within the time limit set in the permit for operation 'are deleted.
7. in Article 3, the following paragraph 2 is inserted after paragraph 1:
"(2) In the case of heat treatment of waste, the period referred to in paragraph 1 shall be only 3 months. ';
Paragraphs 2 to 8 shall be renumbered paragraphs 3 to 9.
8. In Article 3 (3), in the introductory part of the provision, the words "paragraph 1 'are replaced by" paragraphs 1 and 2'.
9. in Article 3 (3) (b) (1), the words "pursuant to Article 13" shall be inserted after the words "stationary sources."
10. in Article 3 (3) (b) (6), the text "3.8.3" shall be inserted after the text "3.7.1.";
11. in § 3 (3) (c) (1):
"1. for stationary sources treating waste with respect to the measurement of heavy metals, polychlorinated dibenzodioxins (PCDDs), polychlorinated dibenzofurans (PCDFs) and the measurement of gaseous inorganic fluorine compounds expressed as hydrogen fluoride, gaseous inorganic chlorine compounds expressed as hydrogen chloride and sulphur dioxide in application of point 4 or 5 of Part B of Annex 4 to the Act; However, 4 measurements shall be made during the first 12 months of operation. ';
12. in Article 3 (4), the introductory part of the provision "2" is replaced by "3."
13. in Article 3 (4) (c):
"(c) in (c) at least once every 6 months, except for the first 12 months of operation of a stationary heat-treatment waste source where one measurement is made every 3 months."
14. in Article 3 (5), "paragraph 2" is replaced by "paragraph 3";
15. in Article 3 (6), in the introductory part of the provision, the words "paragraph 2" are replaced by the words "paragraph 3."
16. in Article 3 (6) (a), the words "pursuant to Article 13" shall be inserted after the words "resources."
17. in Article 3 (6) (c), the text "3.8.3.," shall be deleted;
18. in Article 3 (6) (d), the words "3.8.3" are inserted after the words "3.7.1."
19. in Paragraph 3 (8), "paragraph 2" is replaced by "paragraph 3";
20. in Paragraph 3 (9), "paragraph 2" is replaced by "paragraph 3";
21. in Article 4 (5), the introductory part of the provision "2" is replaced by "3."
22. in Article 4 (6), the words "pursuant to Paragraph 13," shall be deleted and the words "electrochemical articles" shall be inserted after the words "or other continuous emission measurement instruments";
23. In Article 4, paragraph 8 is added:
"(8) One-off emission measurements shall be carried out on combustion stationary sources with a total rated thermal input of less than 50 MW under stable operating conditions and under representative and uniform load, and the results of one-off emission measurements shall not include values obtained at the time of putting the stationary source into service and when it is shut down. Where these sources use several types of fuel, emissions shall be measured when burning fuel or fuel mixture with probably the highest emission value and at a time that is representative of normal operating conditions. ';
24. in Article 5 (1) (c), the words "or other instruments for continuous measurement of emissions for measurements referred to in Article 4 (6)" shall be inserted after the words "articles."
25. in Article 7, the following paragraph 3 is added:
"(3) The value of the 95% confidence interval of the individual measured result determined in accordance with the procedure laid down in the Technical Standards Act on Technical Requirements for Products (2) shall not exceed the following emission limit percentages at the specific emission limit level: 10% for Carbon monoxide, 20% for Sulphur Oxide, 20% for Nitrogen Oxides, 20% for Ammonia, 30% for Solid Pollutants, 30% for Total Organic Carbon, 40% for Hydrogen Chloride, 40% for Hydrogen Fluoride, 40% for Sulfan and 40% for Sulphide. For stationary sources treating waste, this emission limit shall be the daily emission limit. ';
26. in Paragraph 8 (1), at the end of (a), the comma shall be replaced by a semicolon and the words "the half-hour average shall be taken to be the arithmetic mean of the minute mean values recorded for at least 20 minutes from the 30-minute period followed, the 10-minute average shall be that of the minutes mean values,"
27. in Article 8 (1) (d):
"(d) to obtain validated average half-hour and 10-minute average values, the value determined in accordance with the procedure laid down in Article 9 (7) shall be deducted from the measured result. Validated average values and their calculated average daily concentration values shall be used only for the assessment of compliance with emission limits in accordance with Article 9 (1), (2), (4) and (5). ';
28. in Paragraph 8 (2) (b), the part of the sentence behind the semicolon, including the semicolon, shall be deleted;
29. in Article 9, the following paragraph 4 is inserted after paragraph 3:
"(4) The emission limit for continuous measurement of emissions on stationary sources producing titanium dioxide shall be deemed to be met if no valid value at the averaging time level set out in Parts 5.2.9. and 5.2.10. of Annex No 8 to this Regulation exceeds the emission limit set here. ';
Paragraphs 4 to 7 shall be renumbered paragraphs 5 to 8.
30. in Article 9 (5), "paragraphs 1 to 3" shall be replaced by "paragraphs 1 to 4";
31. in the first sentence of Article 9 (7), the words "a" shall be replaced by a comma and the words "and in paragraph 5 shall be inserted after the words" paragraph 4 ";
32. in Paragraph 9 (7), the word "hourly," shall be deleted; the words "maximum 95% confidence interval of individual measurements, which shall not exceed the following percentage of the value of this emission limit at the level of the specific emission limit" shall be replaced by the words "the following percentage of the value of these results" and the phrase "For measured results higher than the emission limit value, the above percentage of the value of the specific emission limit shall be subtracted."
33. In Article 9, paragraphs 9 and 10 are added, including footnote 6:
"(9) In order to assess compliance with the specific emission limit set for a stationary source on the basis of the best available techniques conclusions, the periods referred to in those BAT conclusions shall be used instead of the periods referred to in paragraph 5, using the reference conditions set out therein, from the date of validity specified in the operating permit. If, in such cases, a specific emission limit is defined only as an annual average, at the same time no valid daily average concentration value under the reference conditions shall exceed 120% of the specific emission limit value.
(10) The values relevant for the assessment of compliance with the emission limit shall not include data found at the time of emission measurement which is carried out in accordance with a permit under another legislation6) in order to obtain information on the level of pollution to determine the conditions of operation. The permitted duration of this condition shall not exceed 24 hours per calendar year.
6) Act No. 76 / 2002 Coll., on integrated pollution prevention and control, on integrated pollution register and on amending certain laws (Integrated Prevention Act), as amended. '
34. in Article 12 (1) (c), the words "fixed by one-off authorised measurements" shall be inserted after the words "the method referred to in (a) or (b)";
35. in Article 13 (a), the words "drying, burning or other heat treatment of articles or materials, in particular heating furnaces or heat treatment furnaces" shall be replaced by "for drying, burning or other heat treatment of articles or materials."
36. in Paragraph 13 (j):
"(j) crematorium,"
37. In Article 14, the sentence "These specific emission limits and state and reference conditions shall also apply to combustion stationary sources with a rated thermal input of 50 MW and above that have a change that may have an impact on the environment 'shall be added at the end of paragraph 2.
38. In Article 15, the following paragraph 6 is added:
"(6) Combustion stationary sources shall be put into service and deactivated as soon as possible. This requirement shall be deemed to be satisfied if the period of entry into service and decommissioning determined in accordance with a decision of the European Commission issued pursuant to Article 41 (a) of Directive 2010 / 75 / EU of the European Parliament and of the Council. ';
39. In Article 18, at the end of the text of paragraph 1, the words "for which fuel quality requirements are laid down in Annex 3 to this Decree 'are added.
40. At the end of the text of § 19, the sentence "This part of the decree does not apply to the heat treatment of waste carried out solely for the purposes of research and development or testing of new heat treatment processes if the quantity of waste treated is less than 50 tonnes per year and the aim is to improve the heat treatment process of waste. '
41. in Article 21 (a), the words "with the exception of petrol," shall be deleted;
42.In Paragraph 21 (c), the words "petrol and 'are deleted.
43. In Paragraph 24, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The method of establishing specific emission limits for odour-harming substances is set out in Annex 17 to this Decree. ';
44. In Article 26, the following paragraph 7 is added:
"(7) The elements of the document on the control of the technical condition and operation of the combustion stationary source on solid fuels with a rated thermal input of 10 to 300 kW inclusive, which serves as a heat source for the central heating hot water system, are set out in Annex 18 to this Decree. '
45. in Paragraph 29, paragraph 2 is deleted;
Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
46. in Article 29 (4), "1.1, 2.1 and 3.1" is replaced by "2.1.2, 2.2.2 and 2.3.2" and "1.2, 2.2 and 3.2" is replaced by "1.1.2, 1.2.2 and 1.3.2."
47. In Annex 1, Part I, the following row is added at the end of the table:

At the same time, the following entry under Table 1 is added:
"1) If the standard reference method for determining the pollutant is not used, another appropriate method shall be used. ';
48. Part II of Annex No 2 reads as follows:

„Část II

Specific emission limits for combustion stationary sources with a total rated thermal input greater than 0,3 MW and less than 50 MW
1. Specific emission limits applicable until 19 December 2018
For boilers, specific emission limits are related to the total rated thermal input and to normal state conditions and dry gas at the reference oxygen content of the waste gas 6% for solid fuels except biomass, 11% for biomass and 3% for liquid and gaseous fuels.
For reciprocating internal combustion engines, specific emission limits are related to the total rated thermal input and to normal state conditions and dry gas (for TZL on wet gas), at a reference oxygen content of 5% and do not apply to back-up energy sources and fire pumps operated at less than 300 operating hours per year. Gas engine means an internal combustion engine operating on the Otto cycle principle and using positive ignition or, in the case of a dual-fuel engine using compression ignition fuel.
For gas turbines, specific emission limits are related to normal state conditions and dry gas at a reference oxygen content of 15% and do not apply to back-up energy sources operated at less than 300 operating hours per year.
For thermal combustion stationary sources, specific emission limits are related to normal state conditions and dry gas at a reference oxygen content of 17%.

2. Specific emission limits applicable from 20 December 2018 until 31 December 2024
The specific emission limits are related to the total rated thermal input and to normal state conditions and dry gas at the reference oxygen content of the waste gas 6% for solid fuels except biomass, 11% for biomass and 3% for liquid and gaseous fuels.
For piston engines, specific emission limits are related to the total rated thermal input and to normal state conditions and dry gas (unless otherwise specified), at a reference oxygen content of 5% and do not apply to back-up energy sources and fire pumps operated at less than 300 operating hours per year. Gas engine means an internal combustion engine operating on the Otto cycle principle and using positive ignition or, in the case of a dual-fuel engine using compression ignition fuel.
For combustion stationary sources whose operating hours do not exceed 500 hours per year, expressed as rolling average over a period of three calendar years, the specific emission limits specified in Tables 1.1.1, 1.2.1 and 1.3.1 apply.
For gas turbines, the specific emission limits are related to normal state conditions and dry gas at a reference oxygen content of 15% and do not apply to back-up energy sources operated at less than 300 operating hours per year and, in the case of nitrogen oxides, at a load of less than 70%.
For thermal air combustion stationary sources, the specific emission limits given in Table 2.1.2 refer to normal state conditions and dry gas at a reference oxygen content of 17%.
For stationary sources whose rated thermal input is less than 1 MW but the total rated thermal input is greater than 1 MW instead of emission limits according to Tables 2.2.1. and 2.3.1, emission limits shall be applied according to the total rated thermal input according to Tables 2.2.2. and 2.3.2.
The emission limits set out in Table 2.1.2 shall not apply to combustion stationary sources classified under code 1.4 of Annex 2 to the Act other than thermal air combustion sources.

3. Specific emission limits applicable from 1 January 2025
Specific emission limits refer to normal state conditions and dry gas at the reference oxygen content of the waste gas of 6% for solid fuels except biomass, 11% for biomass and 3% for liquid and gaseous fuels.
For piston engines, specific emission limits are applicable to normal state conditions and dry gas (unless otherwise specified), at a reference oxygen content of 5% and do not apply to back-up energy sources and fire pumps operated at less than 300 operating hours per year. Gas engine means an internal combustion engine operating on the Otto cycle principle and using positive ignition or, in the case of a dual-fuel engine using compression ignition fuel.
For combustion stationary sources whose operating hours do not exceed 500 hours per year, expressed as rolling average over a period of three calendar years, the specific emission limits specified in Tables 1.1.1, 1.2.1 and 1.3.1 apply.
For gas turbines, the specific emission limits are related to normal state conditions and dry gas at a reference oxygen content of 15% and do not apply to back-up energy sources operated at less than 300 operating hours per year and, in the case of nitrogen oxides, at less than 70% load.
For thermal combustion stationary sources with a rated thermal input of 5 MW and below, the specific emission limits specified in Table 3.1.2 are related to normal state conditions and dry gas at the reference oxygen content of 17%. In the case of tables 3.1.1, 3.2.1, 3.3.1 and 3.3.2, specific emission limits are related to the total rated power input and, in the case of tables 3.1.2 and 3.2.2, they are related to the rated thermal input of individual combustion stationary sources; This does not apply if the emission limit set in respect of the total rated thermal input from Part 1.1.1, 1.2.1 or 1.3.1 is more stringent, in which case the limit specified therein shall apply.
For stationary sources whose rated thermal input is less than 1 MW but the total rated thermal input is greater than 1 MW instead of emission limits according to Tables 3.2.1. and 3.2.2. emission limits shall be applied according to the total rated thermal input according to Table 2.2.2.
For stationary sources whose rated thermal input is less than 1 MW but the total rated thermal input is greater than 1 MW instead of emission limits according to Table 3.3.2, emission limits shall be applied according to the total rated thermal input according to Table 2.3.2.
The emission limits set out in Table 3.1.2 shall not apply to combustion stationary sources with a rated thermal input of less than 5 MW classified under code 1.4 of Annex 2 to the Act other than air combustion sources from 1.1.2030 onwards.
