amending Act No 284 / 2009 Coll., on Payment, as amended, and other related laws
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on Czech Trade Inspection
Act No. 64 / 1986 Coll., on Czech Trade Inspection, as amended by Act No. 240 / 1992 Coll., Act No. 22 / 1997 Coll., Act No. 110 / 1997 Coll., Act No. 189 / 1999 Coll., Act No. 71 / 2000 Coll., Act No. 145 / 2000 Coll., Act No. 250 / 2001 Coll., Act No. 102 / 2001 Coll., Act No. 321 / 2001 Coll., Act No. 155 / 2002 Coll., Act No. 219 / 2012 Coll., Act No. 226 / 2003 Coll., Act No. 439 / 2003 Coll., Act No. 490 / 2005 Coll., Act No. 229 / 2006 Coll., Act No. 160 / 2007 Coll., Act No. 36 / 2008 Coll.
1. In Paragraph 2 (2), at the end of the introductory part of the provision, the word "whether 'is added.
2. in Paragraph 2 (2) (a), "compliance with the conditions laid down" is replaced by "compliance with the conditions laid down";
3. in Article 2 (2) (b) and (d) to (f), the word "whether" shall be deleted;
4. In Paragraph 2 (2) (c), the words "compliance with other conditions laid down 'are replaced by" compliance with other conditions laid down'.
5. In Article 2, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) the payee complies with the obligations laid down in the directly applicable European Union regulation governing interchange fees for card payment transactions (8).
8) Regulation (EU) 2015 / 751 of the European Parliament and of the Council of 29 April 2015 on interchange fees for card payment transactions. '.
Amendment to the Financial Arbiter Act
Act No. 229 / 2002 Coll., on Financial Arbiter, as amended by Act No. 558 / 2004 Coll., Act No. 57 / 2006 Coll., Act No. 264 / 2006 Coll., Act No. 281 / 2009 Coll., Act No. 285 / 2009 Coll., Act No. 180 / 2011 Coll., Act No. 241 / 2013 Coll., Act No. 278 / 2013 Coll., Act No. 336 / 2014 Coll. and Act No. 378 / 2015 Coll., are amended as follows:
1. in Article 1 (1) (a), the words "offering" shall be inserted after the words "at";
2. In Article 1, at the end of paragraph 1, the dot is replaced by a comma and the following points (i) and (j) are added:
"(i) a person who holds a payment account other than a payment account while keeping that account;
(j) the recipient of a one-off deposit when receiving or returning the deposit. ';
3. In Article 3, at the end of paragraph 1, the dot is replaced by a comma and the following points (i) and (j) are added:
"(i) the person who holds a payment account other than a payment account when holding that account;
(j) the recipient of the one-off deposit when receiving or returning the deposit. ';
Amendment to the Price Act
In Article 14 of Act No. 526 / 1990 Coll., on Prices, as amended by Act No. 484 / 2004 Coll., Act No. 403 / 2009 Coll. and Act No. 353 / 2014 Coll., the dot is replaced by a comma at the end of paragraph 2 and the following point (d) is added:
"(d) in determining whether a payment service provider does not infringe the provisions of the payment law relating to the amount of payment for services provided under the basic payment account (13)."
Footnote 13 reads:
"13) § 124t of Act No. 284 / 2009 Coll., on Payment, as amended by Act No. 452 / 2016 Coll. '.
EFFECTIVE
This Law shall take effect on the first day of the third calendar month following the date of its publication, with the exception of Article I (33) to (36), (40), (42) and (43) and Article III, which shall take effect on the 15th day following its publication.
