DECLARATION
of 19 December 2013
amending the Decree implementing electoral laws
The Ministry of Interior provides, pursuant to Section 74 (c) of Act No. 491 / 2001 Coll., on elections to municipal councils and on the amendment of certain laws, and in agreement with the Czech Statistical Office pursuant to § 92 (1) (c) of Act No. 247 / 1995 Coll., on elections to Parliament of the Czech Republic and on amendments to certain other laws, as amended by Act No. 204 / 2000 Coll. and Act No. 230 / 2002 Coll., under § 69 (b) of Act No. 275 / 2012 Coll., on the election of the President of the Republic and on the amendment of certain laws, under § 70 (b) of Act No. 62 / 2003 Coll., on elections to the European Parliament and on the amendment of the Act No. 491 / 2001 Coll., on elections to the Commissions of the Communities, and on the Election of certain Acts under § 69 (b), on the Election of the President of the Act No. 130 / 2000 Coll.
Amendment to Decree No 233 / 2000 Coll.
Decree of the Ministry of Interior No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on the Election to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 212 / 1996 Coll., the Constitutional Court found under No. 243 / 1999 Coll. and Act No. 204 / 2000 Coll., as amended by Decree No. 80 / 2002 Coll., Decree No. 188 / 2002 Coll., Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 321 / 2009 Coll., and Decree No. 442 / 2009 Coll., is amended as follows:
1. Part two, including the title and footnotes 5, 6 and 7, shall be deleted.
2. The following Section 6a is inserted after Section 6:
The voting card form is a strictly negotiable form with security features against abuse. Each form shall bear a letter identifying the series starting with A and a six-digit digit of each series from 000001 to 999999. After the numbers of the series are exhausted, the series marked in alphabetical order. '
3. In Paragraph 8, the following paragraph 2 is inserted after paragraph 1:
"(2) The municipal office and the representative office shall keep an overview of the forms received, issued and damaged or degraded; damaged or degraded voting licence forms shall be destroyed by protocol. ';
Paragraphs 2 to 6 shall become paragraphs 3 to 7.
4. In Article 14b, the words "the time limit referred to in Article 2 (1) for 43 days," are deleted.
5. In Annex 2, model form 1:

Transitional provision
For the elections to the Senate announced before the date of entry into force of this Order, Decree No. 233 / 2000 Coll., as effective before the date of entry into force of this Order, shall apply.
Amendment to Decree No 152 / 2000 Coll.
Decree of the Ministry of the Interior No. 152 / 2000 Coll., on the implementation of certain provisions of Act No. 130 / 2000 Coll., on Regional Councils and on the amendment of certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 442 / 2009 Coll. is amended as follows:
1. In Paragraph 11 (2), at the end of point 6, the comma is replaced by a dot and point 7 is deleted.
2. In Article 11, the following paragraph 4 is added:
"(4) For elections to regional councils, the model of the form of the electoral licence and the procedure for the safekeeping of the form provided for in the Ministry of Interior Decree on the implementation of certain provisions of the Act on Elections to Parliament of the Czech Republic 24) shall be used.

(3) Paragraph 13, including footnotes 14, 15 and 16, shall be deleted.
4. In Annex 2, the model form 6, including the Annex to the model form 6, reads:

5. In Annex 2, the model form 7 is deleted.
Amendment of Decree No 59 / 2002 Coll.
Decree of the Ministry of the Interior No. 59 / 2002 Coll., on the implementation of certain provisions of Act No. 491 / 2001 Coll., on elections to municipal councils and on the amendment of certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll. and Decree No. 442 / 2009 Coll., is amended as follows:
1. Paragraph 2 (4) reads as follows:
"(4) In the capital of Prague and in the territorial subdivided statutory cities, the electoral districts are numbered in individual urban areas or urban districts. The constituency number shall be composed of the city or city district identification number and the respective constituency serial number. The town or district identification numbers shall be assigned by the registry administrator of the territorial identification, addresses and real estate to form a whole number series in such a city; the serial numbers of the constituencies shall consist of a separate uninterrupted number series from the number 1 in each urban area or district. ';
2. Paragraph 3 (6), including footnote 8, is deleted.
Paragraph 7 shall become paragraph 6.
3. In the second sentence of Article 4, the words "by comparing the permanent residence of national citizens of the Czech Republic and foreigners with the residence permit in the Czech Republic held by the municipal authority of the municipality with the extended scope 'are replaced by the words" using reference data from the population base register, data from the population information system and data from the alien information system'.
4. Article 5, including footnotes 10, 11, 12, 13 and 13a, shall be deleted;
5. In Annex 2, model form 3:

Amendment to Decree No. 409 / 2003 Coll.
Decree No. 409 / 2003 Coll., implementing Act No. 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, as amended by Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll. and Decree No. 442 / 2009 Coll., is amended as follows:
1. In Article 7 (1), point 2 is deleted.
Points 3 to 10 shall become points 2 to 9.
2. In Article 7, the following paragraph 4 is added:
"(4) For elections to the European Parliament, the model of the form of the Voting Card and the procedure for the preservation of the form provided for in the Ministry of Interior Decree on the implementation of certain provisions of the Election Act to the Parliament of the Czech Republic 16) shall be used.

3. In Annex 1, Model 2 is deleted.
Models 3 to 10 to date are referred to as models 2 to 9.
4. In Annex 1, in Model 4, the words "Annex A to Model 5 'are replaced by the words" Annex A to Model 4'.
5. In Annex 1, in Model 4, "Annex B 1 to Model 5 'is replaced by" Annex B 1 to Model 4', "Annex B 2 to Specimen 5 'is replaced by" Annex B 2 to Special 4', "Annex B 3 au modèle 5 'is replaced by" Annexe B 3 au modèle 4' and "Anlage B 4 zum Master 5 'is replaced by" Anlage B 4 zum Muster 4'.
6. In Annex 2, the model form 2, including the Annex to the model form 2, reads:

Amendment to Decree No 294 / 2012 Coll.
Decree No 294 / 2012 Coll., on the implementation of certain provisions of the law on the election of the President of the Republic, is amended as follows:
1. In Article 5 (1), the comma at the end of point (g) is replaced by a dot and point (h) is deleted.
2. In Article 5, the following paragraph 3 is added, including footnote 1:
"(3) For the selection of the President of the Republic, the model of the form of the electoral licence and the procedure for the safekeeping of the form provided for in the Ministry of Interior Decree on the implementation of certain provisions of the Act on Elections to the Parliament of the Czech Republic 1) shall be used.

EFFECTIVE
This Decree shall take effect on 1 January 2014.
