on the formalities for the application for the grant, modification, extension and cancellation of authorisations for the construction of selected gas installations, including the models of applications and the conditions for examining such applications
The Ministry of Industry and Trade provides pursuant to § 98a (1) (d) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 211 / 2011 Coll. and Act No. 165 / 2012 Coll.:
Subject matter
This Decree lays down the formalities for applications for the grant, modification, extension and cancellation of authorisations for the construction of selected gas installations (hereinafter referred to as "authorisations'), including the models of applications, and the conditions for examining such applications.
Application for authorisation to grant, extend and revoke
(1) An application for authorisation shall be submitted separately for each selected gas installation.
(2) The application for authorisation shall be submitted to all new selected gas installations, as well as in cases of reconstruction of existing selected gas installations, where the replacement of the plant increases their capacity, except for the transponder of selected gas plants.
(3) The model of the application for authorisation for the construction of a direct pipeline is set out in Annex 1 to this Regulation, the model of the application for authorisation for the construction of a gas storage tank is set out in Annex 2 to this Regulation, the model of the application for authorisation for the construction of a gas pipeline connecting the gas system to foreign gas systems is set out in Annex 3 to this Regulation, the model of the application for authorisation for the construction of a pressure line higher than 0,4 MPa is listed in Annex 4 to this decree, the model application for authorisation for the construction of a gas production plant producing gas (1) and biomethane (2) is set out in Annex 5 to this decree.
(4) An application for renewal shall be submitted by the authorisation holder and shall indicate the authorisation number, the required period of validity of the authorisation and the reason for its extension.
(5) An application for revocation shall be submitted by the authorisation holder and shall indicate the authorisation number and the reason for its revocation.
Assessment of applications
When deciding on an application for authorisation under § 2, the Ministry assesses:
(a) whether the construction of the selected gas installation is in line with the state energy concept;
(b) whether the construction of the selected gas installation complies with the territorial energy concept;
(c) the effectiveness, efficiency and economy of the proposed construction of the selected gas installation;
(d) the applicant's financial assumptions for the construction of the selected gas installation;
(e) the importance of the construction of the selected gas plant to enhance the safety and reliability of the operation of the gas system and the supply of customers;
(f) whether the construction of the selected gas installation complies with the environmental protection provided for in other legislation3),
(g) for biomethane production, whether their construction complies with the national renewable energy action plan.
Repeal
The following shall be deleted:
1. Decree No. 245 / 2001 Coll., on the details of granting state authorisation for the construction, modification, extension or cancellation of selected gas installations.
2. Decree No. 118 / 2005 Coll., amending Decree No. 245 / 2001 Coll., on the details of the granting of state authorisation for the construction, modification, extension or cancellation of selected gas installations.
3. Decree No. 52 / 2010 Coll., amending Decree No. 245 / 2001 Coll., on the details of the granting of state authorisation for the construction of selected gas installations, its amendment, extension or cancellation, as amended by Decree No. 118 / 2005 Coll.
Efficacy
This Decree shall take effect on 1 January 2013.
