DECLARATION
of 18 October 2002
establishing the list and the precise specifications of oil, oil feedstocks and selected petroleum products that can be stored in emergency oil stocks, the methods for calculating the amount of oil reserves and the conditions for their storage
Under Section 2 (6) of Act No. 189 / 1999 Coll., on Emergency Oil Stocks, on dealing with oil emergency situations and on the amendment of certain related laws, hereinafter referred to as "the Act", the management of material reserves provides:
§ 1
Oil and oil feedstocks that can be stored in emergency oil stocks
In the emergency stocks of crude oil, only types of oil which can be processed in refineries within the territory of the Czech Republic under Customs Tariff (1) under subheading 2709 00 90 and semi-products for other refinery or petrochemical treatment - petrol intended for specific processing and petrol intended for chemical treatment under tariff heading 2710 11 11 and 2710 11 15 may be stored.
§ 2
Petroleum products that can be stored in emergency oil stocks
Only the following petroleum products may be stored in emergency oil stocks:
(a) motor gasoline;
(b) medium oils,
(c) gas oils;
(d) fuel oils
included in the Customs Tariff under heading 2710 and specified in the Czech Integrated Tariff Code of Subheadings with additional national codes.
§ 3
Calculation of the average 90-day consumption of selected petroleum products
(1) Emergency oil stocks of an average of 90 days of consumption of selected petroleum products must be achieved in each category of selected petroleum products under Section 2 (4) of the Act.
(2) The average 90-day consumption shall be calculated from the total consumption of selected petroleum products in a calendar year divided by the number of calendar days in that year multiplied by 90.
§ 4
Calculation of 90-day average net imports of crude oil, oil feedstocks and petroleum products
(1) The calculation consists of a comparison of the total imports of crude oil, petroleum feedstocks and petroleum products into the Czech Republic with their total exports from the Czech Republic for a calendar year taking into account the balance of primary petrol as follows:

(2) For calculation purposes:
(a) primary benzines shall be those intended for specific processing, tariff item 2710 11 11 and chemical processing petrol tariff item 2710 11 15;
(b) the condensates of natural gas shall be treated as liquid shares of natural gas (NGL) by a tariff item 2709 00 10;
(c) consider as other oil feedstocks all input components of refinery treatment, except oil, primary gasoline and NGL;
(d) consider all final petroleum products as petroleum products;
(e) in other cases, use the definitions published in the methodological manual on monthly oil and petroleum product reports issued by the Czech Statistical Office for action by the Czech Statistical Office for publishing the statistical survey programme for each calendar year.2)
(3) The source of data for the calculation of the average net imports is the statistical information of the Czech Statistical Office.
§ 5
Calculation of the amount of emergency oil stocks expressed on consumption days
(1) The amount of the emergency oil stocks in each category of selected petroleum products pursuant to Article 2 (4) of the Act, increased by the replacement of oil and petroleum feedstocks pursuant to Article 2 (5) of the Act, is divided by their average daily consumption per calendar year and the result is rounded up to whole numbers.
(2) In order to determine the total amount of the emergency oil stocks, the sum of the stocks of all categories of selected products calculated in accordance with paragraph 1 shall be divided by the sum of the average daily consumption of all selected petroleum products and the result shall be rounded up to the nearest integer.
§ 6
Calculation of the amount of the emergency oil stocks expressed as average daily net imports of crude oil and petroleum products
(1) In order to convert the amount of the emergency oil stocks into the number of average net daily imports of crude oil and petroleum products, they serve as a unit of calculation for tonne of oil.
(2) The calculation of the amount of the emergency oil stocks shall be carried out according to the following calculation formula:

(3) Paragraph 4 (2) and (3) shall apply for calculation purposes, provided that:
(a) liquefied petroleum gas (LPG) is considered to be liquefied propane and butane of tariff heading 2711 12 11, 2711 12 19 and 2711 12 94 and 2711 13 91 and 2711 13 97,
(b) medium oils of the other tariff heading 2710 19 41 shall be regarded as diesel and gas oils;
(c) petroleum products for non-energy purposes shall be considered as other products.
(4) For the determination of the number of days covered by the average net imports by the emergency oil stocks, this shall be applied from the results referred to in R and S, which shall indicate the higher number of days of the average net imports.
§ 7
Storage, filler and dispensing equipment and apparatus for addition
Emergency oil stocks may only be stored in storage facilities which fulfil the following conditions:
(a) the smallest authorised volume of 4,000 m3 except storage facilities for storage of heating oils where the smallest volume may be 500 m3;
(b) individual tanks shall be equipped with a device for continuous measurement of the contents of the tank;
(c) the storage facilities for petroleum products of less than 20 000 m3 volume shall be equipped with a reception and supply facility for filling in automotive tanks with a capacity of at least two sets of automotive tanks at one time with a capacity of 70 m3 per hour. In the case of storage facilities for the storage of heating oils by reception and delivery equipment for the reception from automotive or railway tankers and the supply to automotive and railway tankers,
(d) the storage facilities for petroleum products of more than 20 000 m3 capacity shall be equipped with a reception and supply facility for filling in automotive tanks with a capacity of at least four sets of automotive tanks at one time with a power of 140 m3 per hour, shall be connected to the rail network and equipped with a reception and supply facility for filling railway tanks, enabling 2 000 m3 of oil and products to be transported in 24 hours. In the case of storage facilities for the storage of heating oils by reception and delivery equipment for the reception from automotive or railway tankers and the supply to automotive and railway tankers,
(e) the reception and delivery facilities referred to in (c) and (d) shall be equipped with an oil product flow measuring device;
(f) oil storage facilities must be capable of connecting to the pipeline within the territory of the Czech Republic and must be equipped with an installation to measure the quantities of oil received and issued;
(g) equipment intended for dispensing emergency supplies to automotive tankers, railway tankers and for pumping into the pipeline or production network shall be ready to operate within 24 hours of receipt of the requirement of the Administration of State Material Reserve;
(h) if emergency stocks are not stored separately from other stocks, storage facilities shall allow for separate monitoring of emergency stocks and the preferred supply of emergency stocks, irrespective of other stocks stored. Handling of other stocks shall not cause the quantity of emergency stocks to fall or change their quality,
(i) the fuel storage equipment supplied by the manufacturer without additives shall be equipped with a device enabling the fuel to be supplied to the additive. The power of the equipment shall be in accordance with those required under (c) and (d);
(j) the storage facilities must allow for the sampling of emergency stocks to verify their quality according to Czech technical standard ČSN 656005. Control analyses of samples to determine the quality of stored emergency stocks shall be carried out in accredited laboratories. The level of compliance of the results of the control analyses must comply with Czech technical standard EN ISO 4559 (656003).
§ 8
Repeal
Decree No. 184 / 2000 Coll., establishing the list and precise specifications of oil, oil feedstocks and selected petroleum products which can be stored in emergency oil stocks, the methods for calculating the amount of the emergency oil stocks and the conditions for their storage, is hereby repealed.
§ 9
Efficacy
This decree shall take effect on the day of its publication.
