amending Government Regulation No. 276 / 2015 Coll., on Compensation for Pain and Difficulties of Social Application caused by an accident at work or occupational disease, as amended by Government Regulation No. 224 / 2016 Coll., and Government Regulation No. 290 / 1995 Coll., as amended
The Government orders pursuant to § 271c (2) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 205 / 2015 Coll., and under § 107 (1) (e) of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 212 / 2016 Coll.:
Amendment of the Government's regulation on compensation for pain and social difficulties caused by accidents at work or occupational diseases
Government Regulation No. 276 / 2015 Coll., on the compensation of pain and difficulties in social application caused by accidents at work or occupational diseases, as amended by Government Regulation No. 224 / 2016 Coll., is amended as follows:
1. Paragraph 3 (1) reads as follows:
"(1) The value of the point shall be 1% of the average wage on the national economy established on the basis of data from the Czech Statistical Office for the first to third quarters of the calendar year preceding the calendar year in which the obligation to carry out the evaluation of pain and difficulties in social application arose. '
2. In Paragraph 3 (2), "1 points' is replaced by" point ';
3. In Paragraph 5 (4), the words "due to bone or bone fracture operations' are replaced by the words" arising from bone or bone fracture operations'.
4. In Article 7 (4), the word "after 'shall be inserted after the word" after' and the words "by simple deduction 'shall be added at the end of the text of the paragraph.
5. In Annex No 2, the following entry 2.11 is inserted in the table after entry 2.10.6:

| a) | v klinickém neurologickém vyšetření při hodnocení 7 parametrů, kterými jsou palpační bolestivost v lumbálním segmentu, Thomayerův příznak, Lasègueův příznak, alterace reflexů L2/4 nebo L5/S2, motorický deficit v příslušném myotomu, sensitivní deficit v příslušném dermatomu a EMG průkaz axonální leze v příslušném nervovém kořenu, a na základě tohoto vyšetření byla zjištěna abnormalita u osoby ve věku do 50 let alespoň ve 4 parametrech, ve věku od 50 do 60 let alespoň v 5 parametrech a nad 60 let věku alespoň v 6 parametrech, a současně | ||
| b) | v radiologickém vyšetření při hodnocení morfologických změn v segmentech L3/4, L4/5 a L5/S1, kdy v každém z těchto 3 segmentů se hodnotí 5 parametrů, kterými jsou snížení meziobratlové ploténky, protruze meziobratlové ploténky, Modicovy změny stupně II nebo III obratlových těl, posun obratlového těla a artróza meziobratlových kloubů, a na základě tohoto vyšetření byla zjištěna abnormalita u osoby ve věku do 50 let alespoň v 5 parametrech, ve věku od 50 do 60 let alespoň v 6 parametrech a nad 60 let věku alespoň v 7 parametrech z celkově 15 hodnocených parametrů | ||

6. In Annex 4, the following entry 2.11 is inserted in the table after entry 2.10.7:

Transitional provision
If the pain or discomfort caused by the social application was caused by an accident at work or an occupational disease before the date of entry into force of this Regulation and it was not decided before the date of entry into force of this Regulation to fix the compensation for the pain or compensation for the inconvenience of the social application, the compensation for the pain or compensation for the inconvenience of the social application under Government Regulation No. 276 / 2015 Coll., as effective from the date of entry into force of this Regulation, shall be fixed.
Amendment of the Decree on the list of occupational diseases
Government Decree No. 290 / 1995 Coll., establishing the list of occupational diseases, as amended by Government Decree No. 114 / 2011 Coll., Government Decree No. 168 / 2014 Coll. and Government Order No. 506 / 2021 Coll., is amended as follows:
1. In the Annex to Chapter II, entry 11 of the table, in the column "Occupational disease 'in point 2, the words" at evaluation' are replaced by the words "at each of the three segments to be assessed 'and the words" of the 15 parameters assessed in total' are added at the end of the text of point 2.
2. In the Annex to Chapter II, entry 11 of the table, in the column "Conditions of occupational disease ', the words" compression pressure' are replaced by the words "compression force '.
EFFECTIVE
This Regulation shall take effect on 1 January 2023.
