DECLARATION
of 29 November 2021
on the protection of animal species requiring special care
According to Article 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 312 / 2008 Coll., Act No. 291 / 2009 Coll., Act No. 359 / 2012 Coll. and Act No. 501 / 2020 Coll., ("the Act ') for the implementation of Article 13 (11) of the Act:
§ 1
Subject matter
(1) The Order provides for:
(a) animal species requiring special care;
(b) care requirements and requirements for premises and equipment for keeping animal species requiring special care.
(2) The care requirements and the requirements for premises and equipment for the breeding of animal species requiring special care referred to in Sections 4 and 5 do not apply to the selected species of deer and apes referred to in Section 14a (4) of the Act.
§ 2
Definition of terms
For the purposes of this decree:
(a) the breeding area of any premises in which species of animals requiring special care are kept, including an apartment;
(b) an internal breeding area designed for the breeding of species of animals requiring special care situated within the building; in particular, breeding tanks referred to as terrariums, aquaterariums, paldarium, flexaria and shelf-life shall be considered as an internal breeding area in poisonous snakes or crocodiles;
(c) an outdoor breeding area designed and enclosed for the breeding of species of animals requiring special care located outside the construction; In particular, outdoor enclosures and outdoor breeding tanks shall be considered as an outdoor breeding area;
(d) a shelf system designed for the rearing of snakes, in which individual breeding tanks are stored in standing positions in a drawer way above them.
§ 3
Animal species requiring special care
(1) There are animal species in the reptile class (Reptilia) requiring special care
(a) all poisonous species;
(b) crocodiles (Crocodylia) of all species.
(2) There are species of birds (Aves) requiring special care
(a) all species of the Casuariiformes, with the exception of the genus Dromaius,
(b) of the order "Accipitriformes" of the families "Accipitridae" of the genera Aquila, Hieraaetus, Pithecophaga, Spizaetus, Harpia and Haliaetus,
(c) of the order of the owl (Strigiformes) of the family of the owl (Strigidae) of the genus Bubo, all species,
(d) of the short-walled (Gruiformes) family of cranes (Gruidae) of the genus Grus, all species;
(e) of the order of the brodives (Ciconiiformes) of the family Ardeidae of the families Ardea, Ardeola and Egrett of all species.
(3) There are species of mammalian class (Mammalia) requiring special care
(a) all species of primate (Primates),
(b) from the order of the beast (Carnivora), all species including fin-fish (Pinnipedia), with the exception of domesticated species of the dog (Canis familiaris), cat (Felis catus), ferret (Putorius furo) and animals kept as captive animals under the Hunting Act (1);
(c) from the order of the octopus (Proboscidea) of all species,
(d) of the order of solipeds (Perissodactyla) of all species, with the exception of species identified or registered under the Breeding Act (2);
(e) from the order of the biungulates (Artiodactyla), all species, with the exception of species identified or registered in accordance with the Breeding Law (2), animals kept as captive animals under the Hunting Act (1), tramps (Lama glama) and lamas (Vicugna pacos).
§ 4
General requirements concerning the care of animal species requiring special care
Breeders of animal species requiring special care shall:
(a) provide freedom of movement for animals, taking into account their natural needs, so that they are not subjected to unnecessary suffering;
(b) place separately animals which:
1. are characterised by persistent intolerance or are themselves exposed to the permanent aggressive behaviour of other animals,
2. are at the stage of heat, pregnancy, childbirth or other biological activity if their condition requires a separate location;
3. are ill, suspected of being infected or infected or have injuries requiring separate location;
(c) ensure, at least once a day, an inspection of animals, breeding premises and equipment for keeping animals and immediately remove any defects detected so as not to endanger the health and life of animals;
(d) have stable or mobile lighting available to enable the inspection to be carried out;
(e) ensure the feeding and feeding of animals in accordance with the physiological needs of the species.
§ 5
General requirements for premises and equipment for the breeding of animal species requiring special care
(1) Breeders of animal species requiring special care must ensure that breeding premises:
(a) correspond to their size and equipment to the physiological, biological and ethological needs of the animals;
(b) be equipped with means to provide shelter for animals, allow natural movement and care for the body surface and prevent stereotypical behaviour; the premises must provide sufficient incentives for the animals to operate and to express themselves; the obligation to equip breeding premises with means of preventing stereotypical behaviour does not apply to reptile breeding;
(c) they are equipped with materials and articles which are harmless, non-irritating to the animals, cannot harm the animals and do not disturb their well-being, but at the same time allow regular cleaning or replacement;
(d) correspond to the requirements of each animal species for temperature and humidity conditions;
(e) have been sufficiently illuminated by daylight or artificial light in accordance with the biological characteristics of the animals, their fitness and health;
(f) be ventilable and without undesirable moisture; and
(g) have been equipped with tools and tools for handling animals according to a particular species of kept animals and the technology used.
(2) The breeder of animal species requiring special care must ensure that breeding premises are easily accessible and accessible to breeders. The breeder shall keep the premises intended for the rearing and surrounding of animals clean and regularly cleaned.
§ 6
Requirements for the protection and identification of premises for the breeding of poisonous snake and crocodile
The breeder of toxic reptile snake species (Reptilia) (the poisonous snake) or reptilia reptile animals (Crocodylia) (the crocodile) must ensure that:
(a) the breeding premises or the rooms or facilities in which the breeding premises are located are locked;
(b) the breeding premises are secured against the entry of persons different from the breeder, except:
1. the persons close to the breeder (3), the veterinarian, the person carrying out the capture and transport of the animals, the person to whom the care of the animal has been entrusted under Article 13 (5) of the Act, or the staff of the breeder,
2. other persons not referred to in point 1 who enter the breeding premises in the presence of the breeder or authorised staff of the breeder;
(c) all breeding tanks and outdoor enclosures are marked with written information on the species and number of animals kept.
§ 7
Care requirements and requirements for toxic snake breeding premises and equipment
(1) The breeder must ensure the following requirements concerning the care of the poisonous snake:
(a) the cub must be fed at least once a week until saturation as required by the animal; the adult snake must be offered at least once a month to saturation as required by the animal; the frequency of feeding must take into account the individual needs of the animal;
(b) all feces and food residues must be removed as soon as possible;
(c) the snake must have access to water which does not endanger its health,
(d) the water container must be cleaned regularly;
(e) a snake using bathing water must have a large water container so that it can curl in it; and
(f) a snake of a tropical species using plant water must be provided for drinking by the dew of breeding areas.
(2) If a poisonous snake is kept in the inner breeding area, the breeder shall ensure the following requirements:
(a) the breeding tank shall be made of solid and washable materials;
(b) the breeding tank must be bounded on all sides, including the ceiling, so that the animal cannot escape;
(c) for one snake on the ground, the internal breeding area shall be at least the dimensions listed in Annex 1 to this Decree in Table 1.1; this does not apply in the case of breeding referred to in paragraph 3; and
(d) for one tree snake, the internal breeding area shall be at least the dimensions listed in Annex 1 to this Decree in Table 1.2; This shall not apply in the case of breeding referred to in paragraph 3.
(3) If a poisonous snake is kept in a shelf system, the breeder shall ensure the following requirements:
(a) the shelf system shall be equipped with a local heating and thermostat device;
(b) there shall be no land-based snake over 100 cm long or tree snake over 50 cm long in the shelf system;
(c) each breeding tank shall have ventilation provided;
(d) for one snake on the ground, a breeding tank of at least the dimensions listed in Annex 1 to this Decree shall be in Table 1.3; and
(e) for one tree snake, a breeding tank of at least the dimensions listed in Annex 1 to this Decree shall be in Table 1.4.
(4) Where a poisonous snake is kept in an outdoor breeding area, the breeder shall ensure the following requirements:
(a) in this area it is permitted to keep only a snake from areas with similar climatic conditions as in this outdoor breeding area;
(b) the space shall not be buried below the surrounding terrain unless adequate drainage is ensured;
(c) the walls of the premises shall be made of smooth materials and shall be embedded in the ground at least 0,5 m;
(d) the walls of the premises must be sufficiently high so that the animal cannot escape;
(e) the surrounding vegetation or surrounding objects shall not interfere in the outdoor breeding area;
(f) the outdoor breeding area shall be so designed as to provide for the snake
1. access to a place with direct sunlight,
2. suitable hiding place,
3. access to the shaded place throughout the day,
4. prevention of precipitation water accumulation; and
5. permanently dry place,
(g) for one snake on the ground, the breeding area shall be at least the size specified in Annex 1 to this Decree in Table 1.1; and
(h) for a single tree snake, the breeding area shall be at least the size specified in Annex 1 to this Decree in Table 1.2.
(5) The breeder of the poisonous snake must provide the following requirements for temperature, ventilation, humidity and lighting in the internal breeding areas:
(a) the ambient temperature shall correspond to the requirements of the species concerned;
(b) heating equipment, in particular floor heating or heating with heating lamps from above, shall be so located that part of the area is not heated; an animal requiring local heating must be able to heat the environment locally at 35 to 45 ° C; the heating equipment must be secured against the possibility of burning the kept animal;
(c) air exchange shall be ensured by ventilation holes designed to avoid draught;
(d) the humidity shall correspond to the requirements of the species concerned; and
(e) the breeding quarters for a snake with daily activity shall be illuminated at least 10 hours a day.
(6) The breeder of the poisonous snake must ensure the following requirements in the indoor and outdoor breeding areas as regards their equipment:
(a) where a substrate is used, it shall meet the physiological needs of the snake, in particular for species living partially or completely underground; the substrate must at least partially provide the snake with a dry environment; and
(b) the snake must have at its disposal:
1. a shelter located outside the heated part of the breeding area,
2. a rough object facilitating the stripping of the snake; and
3. objects allowing climbing in the case of tree snake breeding.
§ 8
Care requirements and requirements for crocodile breeding premises and equipment
(1) The breeder must ensure the following requirements concerning the care of crocodile:
(a) young children under the age of four must be fed at least once a week until saturation, the frequency of feeding must take into account the individual needs of the animal; and
(b) the adult animal must be fed once a month until saturation as required by the animal, or three to four times a month corresponding to the proportion of the total monthly feed according to the individual needs of the animal.
(2) When keeping a crocodile, the breeder must provide water tank and land in the indoor breeding area and in the outdoor breeding area.
(3) The breeder must ensure the following requirements for crocodile breeding areas, with the exception of the animals referred to in paragraph 4:
(a) where a water tank with a depth of up to 70 cm is part of the breeding area, the depth of the water tank shall be at least twice the height of the animal's body and the breeding area for one to two animals shall be at least the dimensions given in Annex 2 to this Regulation in Table 2.1;
(b) if a water tank with a depth exceeding 70 cm is part of the breeding area, the breeding area for one to two animals shall be at least the dimensions given in Annex 2 to this Regulation in Table 2.2;
(c) in justified cases, in particular in the case of separation of the animal from other kept animals as a result of a fight, quarantine or treatment, the animal may be kept in a water tank smaller than that referred to in (a) or (b) for up to 12 months, provided that its length exceeds by at least 15% the body length of the animal and the animal can be rotated without problems in the water tank;
(d) if the animal is kept behind the fence, the fence shall be smooth and high as at least two thirds of the total length of the longest kept animal, the height of the fence being measured from the floor of the land or upper edge of the water tank; the breeding tanks of less than two thirds of the total length of the longest kept animal shall be covered by a ceiling structure which prevents the escape of the animal; and
(e) in the case of crocodiles of body length above 2,5 m, a mobile separation bulkhead shall be available which can be separated during handling in the breeding tank; This does not apply in the case of breeding crocodile of the genus Tomistoma (Tomistoma) and gavial (Gavialis).
(4) The breeder must ensure the following requirements for breeding areas for young and medium sized crocodiles which do not exceed 75 cm in length and for breeding of young large crocodiles of large species which do not exceed 110 cm in length:
(a) when keeping one to five pups separately from adult animals, the breeding area shall be at least the dimensions listed in Annex 2 to this Regulation in Table 2.3, the sixth and each additional crocodile kept separately from adult animals shall be increased in accordance with Annex 2 to this Regulation in Table 2.4;
(b) the depth of water in the water tank must be at least such as to cover the back of the cub lying at the bottom of the tank; with a higher water depth, a shallows shall be provided in the water tank at least 10% of the surface area of the water tank so that the cub can rest just below the surface;
(c) in the case of breeding with parents, a maximum of 10 pups may be kept without the requirement to extend the breeding area; for each additional cub, the area of the breeding area shall be increased in accordance with Annex 2 to this Regulation in Table 2.4; the cub shall be moved from the common breeding area no later than 75 cm; it may be kept simultaneously from two immediately following breeding seasons;
(d) if a filtration device is installed in the breeding area, it shall be secured against the infestation of the cub; and
(e) the cub must be able to come ashore.
(5) When keeping crocodiles in indoor and outdoor breeding areas, the breeder must ensure the following requirements as regards temperature, ventilation, humidity and lighting:
(a) the temperature of water and air shall be at least 24 ° C, except as referred to in (d) and (f);
(b) the relative humidity shall be at least 60%;
(c) the animal must be able to cool in water or in a shaded place where the temperature does not exceed 30 ° C;
(d) the alligator (Alligator) may be wintered at temperatures of 8 to 12 ° C for up to four months in a single breeding season; the breeder shall reduce the temperature gradually over one to two weeks; for a period of five to six weeks before the start of the temperature reduction, the alligator (Alligator) animal must be stopped feeding; the temperature increases after winter must be gradual;
(e) on land, the animal shall have the possibility of local heating on the surface of the heated site at 35 to 50 ° C, using floor heating systems, or from above using heating lamps or infrared lamps, or a combination of both; This shall not apply to crocodile (Osteolaemus) and caiman (Paleosuchus) animals with temperatures between 25 and 27 ° C;
(f) in the breeding of the pups referred to in paragraph 4, the water temperature shall be 28 to 32 ° C and the air temperature shall be 30 to 36 ° C, with the exception of the alligator (Alligator), the caiman (Paleosuchus) or the crocodile (Osteolaemus), in which the water temperature must be 24 to 28 ° C and the air temperature 26 to 32 ° C;
(g) all species may be kept in outdoor farming areas between 15 May and 15 September, while ensuring the temperature conditions referred to in points (e) and (f); and
(h) the indoor breeding premises shall be illuminated 10 to 14 hours a day; the lighting mode is ensured by natural conditions in the outdoor enclosures.
§ 9
Transitional provision
The administrative procedure for the authorisation of the breeding of animal species requiring special care pursuant to Article 13 (5) of the Act, which began before the date of entry into force of this Decree, shall be completed in accordance with existing legislation.
§ 10
Repeal
They shall be deleted:
1. Decree No. 411 / 2008 Coll., on the determination of animal species requiring special care.
2. Decree No. 205 / 2011 Coll., amending Decree No. 411 / 2008 Coll., on the determination of animal species requiring special care.
§ 11
Efficacy
This Decree shall take effect on 1 January 2022, with the exception of the provisions of Sections 7 (2) (c) and (d), 7 (3) (b), (d) and (e), 7 (4) (c), (g) and (h), 8 (3), 8 (4) (a) to (c), Annex 1 and Annex 2, which shall take effect on 1 January 2025.
