GOVERNMENT REGULATION
of 11 December 2024
amending Government Regulation No 92 / 2015 Coll., on rules for the organisation of a service office, as amended by Government Regulation No 463 / 2023 Coll.
The Government orders pursuant to § 205 (a) of Act No. 234 / 2014 Coll., on Civil Service, as amended by Act No. 448 / 2024 Coll.:
In Government Decree No. 92 / 2015 Coll., on the rules for the organisation of a service office, as amended by Government Decree No. 463 / 2023 Coll., the following Sections 11a and 11b are inserted after Section 11:
"Characteristics of the post
(1) The characteristics of the post in the section concerning the description of the post shall include:
(a) an identification number of the post under the civil service information system or an identification number of the post under the office's operational information system;
(b) the designation of the official office and the organisational department;
(c) an indication of the branch or branches of the civil service;
(d) an indication of the grade; and
(e) the code of the most demanding administrative activity and its citation according to the catalogue of administrative activities or the designation of the most demanding administrative activity not specified in the catalogue of administrative activities; the code of the most demanding administrative activity including the citation of the most demanding administrative activity or the designation of the most demanding administrative activity shall be indicated for each branch of the public service.
(2) The characteristics of the post in the section concerning the description of the post may also include:
(a) an indication of the duration of the post;
(b) an indication of the place of work or the place of employment;
(c) an indication of the required education, provided that the service authority has determined that the post may be filled by a civil servant or a person who has obtained a lower education than that provided for in the Civil Service Act for that post,
(d) an indication of the prohibition of competition, where provided for in the place of employment;
(e) an indication of the requirement for citizenship of the Czech Republic, if specified for the post of service,
(f) an indication of the requirement of the field or training, if specified for the post of service;
(g) an indication of the requirement for the level of knowledge of a foreign language, if specified for the post of service;
(h) an indication of the requirement to have access to classified information under the legislation governing the protection of classified information, where provided for by the service post;
(i) an indication of the requirement for the duration of the previous performance of a national service or activities similar to those provided for in the post;
(j) an indication of any other requirement needed for the performance of the public service, if provided for in the post;
(k) an indication that the post is financed from sources other than the State budget; and
(l) other information as specified by the Office.
(3) The characteristics of the post in the section concerning the description of the activities required to be carried out at the post include other administrative and other activities required to be carried out at the post, marked as follows:
(a) activities carried out under conditions associated with neuropsychological stress and the likely risk of life and health or of the difficult performance of the public service including the degree of neuropsychological burden and the likelihood of life and health risk;
(b) activities carried out in a difficult working environment;
(c) night-time activities; and
(d) activities classified in the second, third or fourth categories according to the degree of occurrence of factors which may affect the health of workers and their risk to health under the legislation governing the protection of public health.
(4) The characteristics of the post in the section concerning the description of the activities to be carried out at the post may also include:
(a) an indication of the activities the execution of which requires the conclusion of an agreement on liability to protect the values entrusted to the public servant for billing; and
(b) other information as specified by the Office.
(5) The characteristics of the staff member may also include the part concerning the description of the duties relating to the performance of the activities required at the post. The characteristics of the post may include, in the part referred to in the first sentence:
(a) an indication of the authorisation to represent the representative, including the designation of the post of employment and the extent of the activities in which the representative is represented;
(b) an indication of the extent of eligibility to have access to classified information under the legislation governing the protection of classified information;
(c) an indication of the authorisation for the processing of personal data and an indication of the conditions and scope of that authorisation;
(d) an indication of the signing authorisation and an indication of the conditions and scope of that authorisation; and
(e) other information as specified by the Office.
(6) The administrative activities required to be carried out at the post shall be determined in accordance with the competence of the Office and taking into account its organisation and division between the departments of the Office.
The service authority shall present the characteristics of the post, if requested by the Ministry of the Interior or the competent central administrative office in connection with the submission of a draft systemisation or its amendments or proposals for the organisational structure of the service office or its amendments, or if requested by the administrative authority in the process of service relations. ';
Efficacy
This Regulation shall take effect on 1 January 2025.
