GOVERNMENT REGULATION
of 19 December 2016
amending Government Regulation No. 173 / 1997 Coll., laying down selected products for conformity assessment, as amended
The Government orders pursuant to § 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll., Act No. 205 / 2002 Coll. and Act No. 34 / 2011 Coll., to implement § 12 (1) (a), § 12 (4) and § 13 (2) and (4) of the Act:
Government Decree No. 173 / 1997 Coll., establishing selected products for conformity assessment, as amended by Government Decree No. 174 / 1998 Coll., Government Decree No. 78 / 1999 Coll., Government Decree No. 323 / 2000 Coll., Government Decree No. 329 / 2002 Coll. and Government Decree No. 88 / 2010 Coll., are amended as follows:
1. in § 1 (2), § 3 (3) of the introductory part of the provision, § 6 (1) (f) and § 6 (2), the words "producer or importer" are replaced by the words "producer, importer or distributor."
2. In Section 2 of the Introductory Part of the Provisions, Sections 3 (1), (6) and (7) and in Section 4 (1), "Manufacturer or importer 'are replaced by" Manufacturer, importer or distributor'.
3. in § 2 (b), the text "§ 12 (4) (a)" is replaced by "§ 12 (3) (a)."
4. In Article 3 (1), the text "Article 12 (4) (b) 'is replaced by" Article 12 (3) (b)'.
5. in Articles 3 (2) and (5) and 6 (1) (a), the words "manufacturers or importers" shall be replaced by the words "manufacturers, importers or distributors."
6. in Articles 3 (4) (a) and 6 (1) (g), the words "producer or importer" shall be replaced by the words "producer, importer or distributor."
7. In Article 3 (7), the text "Article 12 (4) 'is replaced by the text" Article 12 (3)'.
8. In Article 6 (1) (c), "producer or importer 'is replaced by" producer, importer or distributor'.
9. in Article 6 (1) (g) and (h), "producer or importer" is replaced by "producer, importer or distributor."
10. In Annex 1, entry 2 reads as follows:

| 2 | zásahové požární automobily uvedené v jiném právním předpise upravujícím technické podmínky požární techniky, a to a) s celkovou hmotností do 3 000 kg, b) dopravní automobily s celkovou hmotností nad 3 000 kg v provedení základním, které nejsou vybaveny jiným než základním požárním příslušenstvím uvedeným v tabulce č. 1 přílohy č. 2 k vyhlášce č. 35/2007 Sb., o technických podmínkách požární techniky, ve znění vyhlášky č. 53/2010 Sb., c) automobilové jeřáby, nebo d) automobily vyprošťovací |
11. in Annex 2 (5) (c):
"(c) fire-fighting vehicles with a total mass exceeding 3 000 kg, except fire-fighting vehicles as referred to in Annex 1, item 2,"
12. In Annex No 2, entry 5, the following comma is added at the end of point (f) and point (g) is added:
"(g) fire containers used for the same purpose as fire trucks."
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Regulation shall enter into force on the 15th day following its publication.
