GOVERNMENT REGULATION
of 16 December 2008
amending Government Regulation No 104 / 2005 Coll., establishing a catalogue of activities in the Security Corps, as amended by Government Regulation No 517 / 2005 Coll.
The Government orders pursuant to § 116 (2) of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps:
The Annex to Government Regulation No 104 / 2005 Coll., establishing a catalogue of activities in the Security Corps, is amended as follows:
1. In Part 1. Specific activities 1.1. The customs administration of the Czech Republic in the 3rd tariff class item 1 reads:
"1. Implementation of the technical tasks of the customs authorities in the area of supervision or control within the respective individual agendas linked to other agendas. ';
2. In Part 1. Specific activities 1.1. The following point 4 is added to the Customs Administration of the Czech Republic in the 3rd tariff class:
"4. Implementation of control activities in the infrastructure performance charging system or control of highway coupons. Implementation of control activities in the framework of state professional supervision in road transport. Disclosure and resolution of offences entrusted to customs, including their handling in block proceedings. The implementation of primary administrative acts aimed at dealing with detected offences or other administrative offences and the transfer of the documents obtained to deal with them to the competent services of the Customs Administration of the Czech Republic."
3. In Part 1. Specific activities 1.1. The customs administration of the Czech Republic in the 4th tariff class item 1 reads:
"1. Security of the surveillance or control agenda within the scope of the customs authority, such as checks on goods, means of transport, checks and checks on the existence and authenticity of documents and other records relating to goods subject to customs supervision or tax proceedings. ';
4. In Part 1. Specific activities 1.1. The customs administration of the Czech Republic in the 4th tariff class item 2 reads:
'2. Preparation of decisions on the placing of goods of a commercial nature under customs procedures for export and transit or release of goods which are not of a commercial nature into customs procedures for the importation, export and transit of goods or for the execution of essential operations in the field of the detection of criminal offences and the search for goods escaped or withdrawn during the supervision of customs authorities. ';
5. In Part 1. Specific activities 1.2. The prison service of the Czech Republic reads:
'1.2. Prison Service of the Czech Republic
1. tariff class - referee
1. Performance of guard service on guard towers.
2. The performance of a watch service when accompanying vehicles or persons inside a detention centre, prison or detention centre (hereinafter referred to as the Institute).
3. The performance of guard duty in the guard and intervention patrol under professional guidance.
4. The service of judicial guards at the entrance to the courthouse, prosecutors or ministries.
5. Transport of prisoners or inmates.
2. tariff class - Chief Official
1. The performance of a guard's service in escorting prisoners outside a detention facility, prison or institute under professional guidance.
2. The performance of a guard service in a prison, prison or institute under professional guidance.
3. Performance of supervisory services in prison, prison or institute under professional guidance.
4. The performance of activities in order to ensure order and security at the place of service of the judicial guards under professional guidance.
5. Transport of prisoners or inmates with partial performance of escort activity.
3rd tariff class - assistant
1. The performance of guard duty in detention, prison, external security or in an institution or in escorting prisoners.
2. The exercise of the supervisory service in a defined section, which is part of a supervisory post where the supervisory service (hereinafter referred to as the "designated section ') is performed in a detention prison, prison or institute, in a defined section of an unguarded workplace or demonstration sentenced in a defined section of a detention prison, prison or institute.
3. The performance of a guard or supervisory service in the demonstration of prisoners in prison or prison.
4. Performance of activities in order to ensure order and security at the place of service of the judicial guards.
5. A guard or escort service with a service dog.
4th tariff class - Senior Assistant
1. Security of guard services in the defined section of the detention prison, prison or institute or in the defined section of the external guarded workplace (entrances and entrances) or exercise of guard services in the escort of particularly dangerous prisoners (exceptional and life imprisonment, organised crime, etc.).
2. Provision of supervisory services in prison, prison, institution or unguarded workplace.
3. Provision of guard or supervisory services for the demonstration of prisoners in prison, prison or the demonstration of prisoners in an institution.
4. Ensuring the rights and obligations of the accused and convicted in a prison or prison.
5. Provision of activities on duty guards or independent exercise of activities at the operational centre in the judicial facility.
6. Coordination of transportation of prisoners and inmates.
7. Performance of special cynological activities in searching for narcotic drugs and psychotropic substances in prison, prison or institution.
5th tariff class - inspector
1. Coordination and control of the performance of supervisory, watchkeeping or escort services in the exchange or transport of prisoners or inmates or occupational cynology, including activities in the preparation and use of psychotropic and addictive substances.
2. Coordination and control of the exercise of watch service in the buildings of the courts and in ensuring order and security at the places of service of the judicial guards.
3. Ensuring the rights and obligations of accused and convicted persons located in crisis departments, convicted persons located in departments with mental and behavioural disorder, permanent non-classified departments, in departments for protective treatment in constitutional form and inmates in the institution.
4. Self-ensuring the operation of an operational centre in a detention or prison.
5. Methodological management of teaching and training of service dogs, methodical management of dogs and processing of training programmes.
6. tariff class - Chief Inspector
1. Comprehensive coordination and control of supervisory and guard services or escort services or judicial guards.
2. Self-ensuring the rights and obligations of the accused, the exercise of disciplinary authority over the accused and the handling of disciplinary offences against the accused.
3. Ensuring the activities of the Training Centre of the Service Cynology.
7th tariff class - Commissioner
1. Preparation and solution of system measures, procedures and principles for the performance of the prison guard's service in a detention prison, prison or institution or judicial guards in order to ensure order and security at the place of service of the judicial guards.
2. Coordination and provision of security measures in the organization units of the Czech Prison Service in the performance of tasks in dealing with emergency situations or incidents.
3. Processing of principles and procedures for the exercise of custody or the execution of a custodial sentence or security detention.
4. Processing of uniform principles and procedures for the performance of prison or judicial guards.
5. Self-performance of the activities of the entrusted authority of the Czech Prison Service under specific legislation in the prevention, detection, documentation and investigation of criminal activities of members of the Czech Prison Service who are involved in detention or prison including cooperation with the Czech Police in the prevention and detection of criminal activity in the exercise of custody or in the execution of prison sentences.
8th tariff class - Chief Commissioner
1. Coordinating the performance of the tasks of the entrusted authority of the Czech Prison Service and carrying out the activities of the entrusted authority of the Czech Prison Service in accordance with specific legislation in the prevention, detection, documentation and investigation of the actual and legally highly complex criminal activity of members of the Czech Prison Service, who are involved in the prevention and detection of criminal activity in the custody or the execution of a prison sentence.
2. Coordination and direction of direct performance of prison guards in detention, prison or institution or judicial guards at the place of service.
3. Coordination and determination of the way in which the detention or prison sentence is to be enforced. Coordination and determination of the way in which the performance of security detention is implemented in the Institute.
4. The execution of conceptual and coordination activities and the share of the setting of guidelines for the exercise of custody, the execution of a custodial sentence and the execution of security detention or the performance of the service of prison and judicial guards.
9th tariff class - council
1. Separate performance of the activities of the entrusted authority of the Czech Prison Service and coordination of the tasks of the entrusted authority of the Czech Prison Service according to specific legislation in the prevention, detection, documentation and investigation of the criminal activities of members of the Czech Prison Service with competence throughout the Czech Republic and at the General Directorate of the Prison Service of the Czech Republic including cooperation with the Czech Police in the prevention and detection of criminal activity in the exercise of custody or the execution of a custodial sentence with effect throughout the Czech Republic.
2. Self-execution of activities related to the processing of the concept and coordination and direction of the exercise of custody or the execution of a custodial sentence and security detention.
3. Separate execution of activities related to the processing of the concept and coordination of the guidelines for the performance of the prison and judicial guards.
4. A separate exercise of activities related to the processing of concepts and coordination and comprehensive provision of activities in detention, prison or institute.
10th tariff class - top board
1. Establishment of the concept and coordination of guidelines for police activities in the Czech Prison Service in the prevention, detection, documentation and investigation of criminal activities of members of the Czech Prison Service including cooperation with the Czech Police in the prevention and detection of criminal activity in the exercise of custody and in the execution of a custodial sentence with effect throughout the Czech Republic.
(2) Establishment of the concept and coordination of the guidelines for the exercise of custody and the execution of prison sentences and the execution of security detention.
3. The establishment of the concept and coordination of the guidelines for the performance of the prison and judicial guards.
4. Determination of the concept, coordination and comprehensive provision of detention, prison or institute.
11th tariff class - High Council of State
1. Comprehensive coordination of the Prison Service of the Czech Republic. "
6. In Part 1. Specific activities 1.3. The following point 4 is added to the 4th grade police of the Czech Republic:
"4. Performance of basic cynological activities in police departments. '
7. In Part 1. Specific activities 1.3. The following point 8 is added:
"8. Self-performance of special cynological activities for criminal proceedings in police services."
8. In Part 1. Specific activities 1.3. The following point 16 is added to the sixth tariff class of the police of the Czech Republic:
"16. Performance of professional criminalistic and technical activities in the field of police cynology by application of the odour identification method. '
9. In Part 1. Specific activities 1.3. The police of the Czech Republic in the 7th tariff class point 10 reads:
"10. Coordination of activities in the security of protected persons or objects of special importance, including coordination of cooperation with other entities within the defined scope in police services with competence throughout the Czech Republic. '
10. In Part 1. Specific activities 1.3. The police of the Czech Republic in the 8th tariff class, point 10:
"10. Comprehensive coordination of activities in ensuring the protection of the life and health of protected persons or the protection of representative offices, designated buildings and residential buildings, including the establishment of the most demanding procedures and methods of protection. '
11. In Part 1. Specific activities 1.4. the following point 2 is added:
'2. The implementation of routine maintenance and minor repairs of techniques and the implementation of support and ancillary activities in the fighting and rescue operations. ';
12. In Part 1. Specific activities 1.4. The following point 2 is added to the Czech Fire Rescue Corps in 2nd tariff class:
'2. Driving vehicles with a maximum permissible mass of more than 3500 kilograms in the case of fire fighting, rescue or emergency, including their normal maintenance and minor repairs. ';
13. in Part 1. Specific activities 1.4. In point 1, the words "specialisation 'are replaced by the words" v'.
14. in Part 1. Specific activities 1.4. The Czech Fire Department in the 4th tariff class, point 1:
"1. Ensuring and coordinating firefighting and rescue work in intervention with the application of separate decision-making and with responsibility for the whole specified sections of activity."
15. Other activities in the Customs Administration of the Czech Republic, the Prison Service of the Czech Republic, the Police of the Czech Republic and the Fire Department of the Czech Republic in 2.2. Prison service of the Czech Republic in 2.2.1. The following point 4 is added:
"4. Ensuring information, publicity and press relations of the Czech Prison Service units to the public and mass media, including publicity activities and performance in mass media (press)."
16. Other activities in the Customs Administration of the Czech Republic, the Prison Service of the Czech Republic, the Police of the Czech Republic and the Fire Department of the Czech Republic in 2.2. Prison service of the Czech Republic in 2.2.1. The following point 3 is added:
'3. Creation of a concept of media policy and media strategies in the performance of activities in the Prison Service. '
17. Other activities in the Customs Administration of the Czech Republic, the Prison Service of the Czech Republic, the Police of the Czech Republic and the Fire Department of the Czech Republic in 2.3. Police of the Czech Republic in 2.3.12. Other activities in the 7th tariff class in point 5 are deleted.
18. Other activities in the Customs Administration of the Czech Republic, the Prison Service of the Czech Republic, the Police of the Czech Republic and the Fire Department of the Czech Republic in 2.4. Fire department of the Czech Republic in 2.4.5. Other specialised activities in the 8th tariff class in point 2 are inserted after the word "Providing '.
19. Other activities in the Customs Administration of the Czech Republic, the Prison Service of the Czech Republic, the Police of the Czech Republic and the Fire Department of the Czech Republic in 2.4. Fire department of Czech Republic 2.4.11. Other activities include:
"2.4.11. Other activities
2. tariff class - Chief Official
1. Providing support for emergencies or field exercises by producing and dispensing meals.
3rd tariff class - assistant
1. Performing underwater diving activities at a depth of 40 m in an environment that allows direct surface access.
2. Providing psychological assistance through simple lay procedures to mitigate the consequences of a traumatic event.
3. Service and maintenance of health service vehicles and their specific medical equipment, including the pursuit of emergency care activities in carrying out diagnostic-sorting activities at the site of intervention under professional supervision.
4. Ensuring support activities in the execution of explosive works, including handling of explosives without authorisation to detonate explosives.
5. Determination of technological processes and their calculation in the large-scale food production, including monitoring their compliance and production of diet foods, in the range of the dietary system mandatory in emergency medical institutions or in field exercises.
4th tariff class - Senior Assistant
1. Performing underwater diving activities in an environment that does not allow direct access to the surface, including performing underwater diving activities in a depth above 40 m
2. The exercise of climbing activities in high and above-free-depth interventions, with the application of separate decision-making and responsibility for a specified section of activity, including the separate conduct of regular training of firefighters specialising in high and low-level work.
3. Nursing care including the provision of peripheral venous entry performed in outpatient care in emergency or field exercises under professional supervision.
4. Implementation of small-scale shredding works, except destruction of objects in continuous construction and all factory chimneys.
5th tariff class - inspector
1. Implementation of large-scale shredding works including destruction of objects in continuous development and all factory chimneys, while ensuring the continued ability and management of cooperative activities.
2. Comprehensive organisation of activities related to the security of the operation of catering equipment or kitchen operation in emergencies or field exercises.
3. Specific nursing care performed without professional supervision in outpatient care and in emergencies or field exercises.
6. tariff class - Chief Inspector
1. prioritisation in the nursing process in emergency or field exercises. '
Efficacy
This Regulation shall enter into force on 1 January 2009.
