GOVERNMENT REGULATION
of 20 September 2006
laying down certain conditions for the implementation of certain exceptional measures to support the market in eggs and poultry
The Government orders pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., and pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll.:
Subject matter
This Regulation (1) provides for certain conditions under which the State Agricultural Intervention Fund3 ("the Fund ') grants subsidies for the following measures, following the directly applicable regulation of the European Communities (2) (hereinafter referred to as the" Regulation of the European Communities'):
(a) destruction of hatching eggs as prescribed by the European Community4);
(b) reprocessing of hatching eggs in accordance with the Regulation of the European Communities (5);
(c) destruction of chicks of poultry as prescribed by the European Community6),
(d) the early slaughter of part of the breeding flock according to the regulations of the European Community7),
(e) voluntary extension of the sanitary break over 3 weeks, as prescribed by the European Community8),
(f) voluntary reduction of production by reduction of the deployment of the pups in order to reduce density according to the European Community9).
Subsidy for destruction of hatching eggs
The applicant for a grant for the destruction of hatching eggs (4) may be a natural or legal person who:
(a) is a business10);
(b) is registered in the central register; 11)
1. as a hatchery operator; or
2. as a breeder who has a registered poultry holding.
(1) An application for a subsidy for the destruction of hatching eggs (4) shall be submitted by the applicant in accordance with Article 2 of the Fund before 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) an indication of the number and category of eggs by species of poultry (4) for which the applicant applies for this subsidy;
(d) a certified copy of the proof of destruction of the hatching egg (4) indicating the quantity of hatching eggs destroyed and the date of their destruction;
(e) a certified copy of the certificate of origin of the flock (11), provided that the applicant is the person referred to in Article 2 (b) (2).
(3) Where only a document containing the weight of the hatching eggs destroyed (4) is available to the applicant for the grant for the destruction of the hatching eggs, without indication of the number of hatching eggs destroyed, he shall submit a certified copy of that document to the Fund at the same time as the application referred to in paragraph 1; The Fund shall convert this figure into the number of pieces of hatching eggs destroyed as set out in the Annex to this Regulation.
(1) The Fund shall grant the applicant for a subsidy for the destruction of hatching eggs (4), provided that the conditions for granting it are met under this Regulation and the European Communities Regulation (2).
(2) Where the total number of pieces of hatching eggs referred to in applications for the destruction of hatching eggs (4) exceeds the maximum number of hatching eggs according to the Regulation of the European Communities (12), the Fund shall reduce proportionally the number of hatching eggs to be granted to individual applicants under paragraph 1.
Subsidies for reprocessing hatching eggs
The applicant for a grant for reprocessing of hatching eggs (5) may be a natural or legal person who:
(a) is a business10);
(b) is registered in the central register; 11)
1. as a hatchery operator; or
2. as a breeder who has a registered poultry holding.
(1) An application for a grant for reprocessing of hatching eggs (5) shall be submitted by the applicant in accordance with Article 5 of the Fund by 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) the number of domestic chicken eggs (5) for which the applicant applies for this subsidy;
(d) a certified copy of the proof of reprocessing of hatching eggs (5) indicating the quantity of hatching eggs processed and the date of reprocessing, if the applicant himself has reworked them;
(e) a certified copy of the certificate of origin of the flock (11), provided that the applicant is the person referred to in Article 5 (b) (2).
(3) Where the applicant for the grant for reprocessing of hatching eggs (5) has sold hatching eggs for reprocessing (5), he shall submit to the Fund, at the same time as the application referred to in paragraph 1, a certified copy of the proof of sale of hatching eggs for reprocessing (5) with the number of hatching eggs sold, the date of sale of hatching eggs and the price for which the hatching eggs were sold for reprocessing.
(4) Where only a document containing the weight of the hatching eggs processed (5) is available to the applicant for the conversion of hatching eggs, without indication of the number of hatching eggs processed, he shall submit a certified copy of that document to the Fund at the same time as the application referred to in paragraph 1; The Fund shall convert this figure into the number of reworked pieces of hatching eggs as set out in the Annex to this Regulation.
(1) The Fund shall grant the applicant for a grant for reprocessing of hatching eggs (5), provided that the conditions for granting it under this Regulation and the European Communities Regulation (2) are met.
(2) Where the total number of pieces of hatching eggs referred to in the applications for aid for reprocessing of hatching eggs (5) exceeds the maximum number of hatching eggs provided for in the Regulation of the European Communities (13), the Fund shall reduce proportionately the number of hatching eggs to be granted under paragraph 1 to individual applicants.
Subsidy for the destruction of poultry chicks
A natural or legal person may be an applicant for a subsidy for the destruction of young poultry (6)
(a) is a business10);
(b) is registered in the central register; 11)
1. as a hatchery operator; or
2. as a breeder who has a registered poultry holding.
(1) An application for a subsidy for the destruction of poultry chicks (6) shall be submitted by the applicant in accordance with Article 8 of the Fund by 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) an indication of the number and individual types of poultry (6) for which the applicant applies for this subsidy;
(d) a certified copy of the proof of destruction of poultry chicks (6) indicating the quantity of poultry chicks destroyed by poultry species and their date of destruction.
(1) The Fund shall grant the applicant for a subsidy for the destruction of chicks of poultry (6), provided that the conditions for granting it are met under this Regulation and the European Communities Regulation (2).
(2) Where the total number of chicks of poultry referred to in the application for a subsidy for the destruction of chicks of poultry (6) exceeds the maximum number of chicks of poultry according to the Regulation of the European Community (14), the Fund shall reduce proportionately the number of chicks of poultry for which such subsidy will be granted to individual applicants under paragraph 1.
Subsidy for early slaughter of part of the breeding flock
The applicant for the early slaughter of part of the breeding flock (7) may be a natural or legal person who:
(a) is a business10);
(b) is registered in the central register (11) as a breeder holding a registered poultry holding.
(1) The application for the early slaughter of part of the breeding flock (7) shall be submitted by the applicant in accordance with Section 11 of the Fund by 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) an indication of the number and individual types of poultry (7) for which the applicant applies for this subsidy;
(d) a certified copy of the early slaughter document of part of the breeding flock (7) indicating the quantity of poultry by poultry species and the date of entry into storage of poultry by individual tour;
(e) a certified copy of the certificate of origin of the flock (11).
(1) The Fund shall grant to the applicant for the early slaughter of part of the breeding flock (7) that subsidy if the conditions for granting it are met under this Regulation and the European Communities Regulation (2).
(2) Where the total number of poultry breeding flocks referred to in the applications for early slaughter of part of the breeding flock (7) exceeds the maximum number of animals slaughtered for reproduction in accordance with the Regulation of the European Communities (15), the Fund will reduce proportionately the number of poultry breeding flocks for which such grants will be granted to individual applicants pursuant to paragraph 1.
Subsidy for voluntary extension of the sanitary break over 3 weeks
The applicant for a voluntary extension of a sanitary break over 3 weeks (8) may be a natural or legal person who:
(a) is a business10);
(b) is registered in the central register (11) as a breeder holding a registered poultry holding.
(1) An application for a voluntary extension of the sanitary break beyond 3 weeks (8) shall be submitted by the applicant in accordance with Article 14 of the Fund by 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) an indication of the number of square metres of production area and the number of weeks (8) for which the applicant applies for this subsidy;
(d) an indication of the date of the last removal from storage before the sanitary break and the date of the subsequent entry into storage of the poultry after the extended sanitary break beyond 3 weeks on the platform (8) for which the applicant applies for this subsidy;
(e) a certified copy of the document indicating the production area used for poultry farming (8) for which the applicant applies for this subsidy;
(f) a certified copy of the document showing the date and number of poultry at the last removal from storage and subsequent entry into storage of the poultry after an extended sanitary break beyond 3 weeks on the platform (8) for which the applicant applies for this subsidy.
(1) The Fund shall provide the applicant for a grant for a voluntary extension of the sanitary break beyond 3 weeks (8) if the conditions for granting it under this Regulation and the European Communities Regulation (2) are met.
(2) Where the total number of square metres indicated in the application for a voluntary extension of the sanitary break exceeds 3 weeks (8), the Fund will reduce proportionately the number of square metres per applicant under paragraph 1 for which this subsidy will be granted.
Subsidy for voluntary reduction of production by reduction of youth deployment to reduce density
The applicant for a voluntary reduction in production by reducing the deployment of the pups in order to reduce the density (9) may be a natural or legal person who:
(a) is a business10);
(b) is registered in the central register (11) as a breeder holding a registered poultry holding.
(1) An application for a voluntary reduction in production by reducing the deployment of young chicks in order to reduce the density (9) shall be submitted by the applicant in accordance with Article 17 of the Fund by 15 October 2006 using the form issued by the Fund.
(2) The application referred to in paragraph 1 shall include:
(a) a certified copy of the registration document for the applicant's business;
(b) a certified copy of the proof of the maintenance of the applicant's bank account;
(c) an indication of the number of pups deployed in the normal production cycle (arithmetic mean of 2 immediately preceding pledge tours that took place in the period before the end of the calendar month of January 2006) 9),
(d) an indication of the number of fewer offspring deployed during the relevant period (9);
(e) an indication of the difference between the number of pups deployed in the normal production cycle and the reduced number of pups deployed in the production cycle with the reduced number of pups deployed (9) for which the applicant applies for this subsidy;
(f) a certified copy of the document showing the number of pups deployed in the normal production cycle;
(g) a certified copy of the document indicating the number of pups deployed in the turnus9) for which the applicant applies for this subsidy.
(1) The Fund shall provide the applicant for a voluntary reduction in production by reducing the deployment of the pups in order to reduce the density (9), provided that the conditions for granting it are met under this Regulation and the European Communities Regulation (2).
(2) If the total number of poultry covered by the application for a voluntary reduction in production by reducing the deployment of pups for density reduction (9) exceeds the maximum number of individual poultry species according to the Regulation of the European Communities (17), the Fund shall reduce proportionately the number of pups deployed under paragraph 1 for which this subsidy will be granted.
Amount of subsidies
(1) Subsidy for destruction of hatching ovaries (4) under § 2 to 4 shall not exceed:
(a) CZK 4.26 per 1 hatching egg of chicken falling within CN code 04070019,
(b) CZK 8,00 per hatching egg of ducks falling within CN code 04070019,
(c) CZK 18,76 per hatching egg of turkeys falling within CN code 04070011;
(d) CZK 25.00 per hatching egg of geese falling within CN code 04070011.
(2) Subsidy for reprocessing of hatching ovaries (5) according to § 5 to 7 shall not exceed CZK 3.41 per hatching egg of the chicken falling within CN code 04070019. In case of sale for reprocessing, the amount of the subsidy is always reduced by CZK 0.85 per hatching egg or by the sale price if the price is higher than CZK 0.85.
(3) The subsidy for the destruction of chicks of poultry (6) provided for in paragraphs 8 to 10 shall not exceed:
(a) CZK 6.82 per chick,
(b) 15.35 CZK for 1 young duck,
(c) CZK 24.16 per chick of turkeys,
d) 42.63 CZK on 1 cub goose.
(4) The grant for the early slaughter of part of the breeding flock (7) under § 11 to 13 shall not exceed:
(a) CZK 68,00 per tonne for reproduction falling within CN codes 01059200 and 01059300,
(b) CZK 90,94 per duck for reproduction falling within CN code 01059910;
(c) CZK 375.00 per 1 goose for reproduction falling within CN code 01059920;
(d) CZK 285,00 per turkey for reproduction falling within CN code 01059930.
(5) Subsidy for voluntary extension of the sanitary break over 3 weeks (8) under § 14 to 16 shall not exceed:
a) CZK 13.07 for every 1 m2 and every 1 week for the breeding of chicken broilers,
b) 11.65 CZK for every 1 m2 and every 1 week for turkey farming,
c) 17.62 CZK for every 1 m2 and every 1 week for duck breeding.
(6) The aid for voluntary reduction of production by reducing the deployment of the pups in order to reduce the density referred to in paragraphs 17 to 19 shall not exceed:
a) CZK 5.68 for every 1 piece for breeding chicken broilers,
(b) CZK 35.24 per 1 head for turkey breeding,
c) 21.32 CZK for each 1 piece for duck breeding.
(7) The Fund shall reduce the amount of the subsidy referred to in paragraphs 1 to 6 proportionately if the sum of all eligible subsidy entitlements under the measures provided for in paragraphs 2 to 19 exceeds the amount fixed for these measures in the State budget in accordance with the rules of the European Community2).
Efficacy
This Regulation shall enter into force on 1 October 2006.
