DECLARATION
of 21 July 2004
on labelling of the nutritional value of foodstuffs
According to Article 19 (1) (d) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll. and Act No. 146 / 2002 Coll., hereinafter referred to as "the Act":
(1) This decree sets out, in accordance with European Community law, the method of calculating and labelling the nutritional (nutritional) value of foodstuffs put into circulation to the final consumer or to mass caterers.
(2) This decree does not apply to:
(a) bottled waters covered by specific legislation2),
(b) food supplements governed by specific legislation3),
(c) foodstuffs intended for particular nutritional uses covered by specific legislation4).
For the purposes of this decree:
(a) labelling of the nutritional value - all particulars on the packaging indicating:
1. energy value,
2. nutrients, namely proteins, carbohydrates, fats, fibre, sodium, vitamins or minerals, as listed in the Annex, occurring in foodstuffs in significant quantities; a significant amount means a value of vitamins and minerals higher than 15% of the recommended daily dose in 100 g or 100 ml food or in a single package or individual portion of food. The recommended daily doses of vitamins and minerals are set out in the Annex,
(b) nutrition claims - claims as referred to in law 5),
(c) protein or protein in the food - total nitrogen content determined by the Kjeldahl x 6,256 method),
(d) carbohydrate - any carbohydrate which is metabolised by man, including polyols;
(e) sugars - all in food present monosaccharides and disaccharides without polyols,
(f) fats - total lipids, including phospholipids,
(g) saturated fatty acids - fatty acids without double binding,
(h) monounsaturated fatty acids - fatty acids with one double cis-binding,
(i) polyunsaturated fatty acids - fatty acids with two or more double bonds which are separated by cis, cis- methylene group,
(j) fibre - polysaccharides with three or more monomer units which are not digested or absorbed in the small intestine of man, belonging to groups
1. edible polysaccharides naturally occurring in the food received,
2. edible polysaccharides which have been derived from food materials by physical, enzymatic or chemical means and which have a beneficial physiological effect as demonstrated by generally accepted scientific knowledge; or
3. edible polysaccharides having a beneficial physiological effect, as demonstrated by generally accepted scientific knowledge,
(k) the average value - the value most appropriate to express the amount of nutrient in the food, taking into account changes in the season, consumer habits and other factors which may cause the current value to fluctuate.
Nutrition claims may relate only to the energy value, nutrients referred to in § 2 (a) (2) and substances belonging to a group of such nutrients or being components thereof.
(1) The energy value is calculated using the following conversion rates for 1 g of substances:

| d) tuky (triacylglyceroly) | 37 kJ | = | 9 kcal |

| f) organické kyseliny | 13 kJ | = | 3 kcal |
| g) | 8 kJ | = | 2 kcal |
| h) erythritol | 0 kJ | = | 0 kcal. |
(2) The conversion rate for salatrims meaning energy-reduced fats classified as novel foods shall be fixed per gram of substance as follows:
Salatrims 25 kJ - 6 kcal.
The indication of the nutritional value is laid down in law 7). Where a nutrition claim is made on the labelling of a food put into circulation, on the submission and supply of that food or in advertising, with the exception of a generally targeted advertising event, the indication of the nutritional value is mandatory.
(1) If the nutritional value is indicated, the particulars must be given in accordance with Group 1 or Group 2 in the following order:
(a) Group 1
1. energy value,
2. protein, carbohydrate and fat content,
(b) Group 2
1. energy value,
2. protein, carbohydrate, sugars, fats, saturated fatty acids, fibre and sodium content.
(2) Where the nutrition claim relates to sugars, saturated fatty acids, fibre or sodium, the particulars shall be provided in accordance with the provisions of Group 2. In other cases, nutrition labelling shall be carried out in accordance with Group 1.
(3) The labelling of nutritional value may also include the following substances:
(a) starch;
(b) polyols,
(c) monounsaturated fatty acids;
(d) polyunsaturated fatty acids,
(e) cholesterol,
(f) the minerals and vitamins listed in the Annex, present in the food in significant quantities [§ 2 (a) (2)].
(4) Where a nutrition claim is made, the indication of substances or their constituents belonging to a group of nutrients referred to in paragraphs 1 and 3 shall be compulsory. Where the content of polyunsaturated (polyenous), monounsaturated (monoenous) fatty acids and cholesterol is indicated, the content of saturated fatty acids shall also be reported.
(1) Where free sugars, polyols or starch are indicated, the following data shall be immediately followed by data on the carbohydrate content of this arrangement and in the following units:

(2) Where the quantity and, where appropriate, the type of fatty acids and the cholesterol value are indicated, the following data shall be immediately followed by data on the total fat content of the following arrangement:

(1) The energy value and the content of nutrients or their constituents must be expressed numerically. The following units shall be used:

(2) Data should be provided for 100 g or 100 ml of food. These data may also refer to the administered dose, the quantity of which is indicated, or to one portion, provided that their number is given in the same package. The data on vitamins and minerals shall also be expressed as a percentage of the recommended daily dose as set out in the Annex. For vitamins and minerals, the quantity in the food shall be indicated on the packaging only if it exceeds 15% of the total recommended daily dose. Data on the percentage of recommended daily doses of vitamins and minerals may also be done graphically.
(3) The quantities indicated shall apply to the food in the state in which it is put into circulation or, where appropriate, to the food prepared for consumption as instructed by the manufacturer. The instructions shall be attached to the product and shall include detailed instructions for such preparation.
The values referred to in paragraphs 7 and 8 shall be given as average, based on the results:
(a) analyses by the food manufacturer;
(b) the calculation of known or current average values of the food ingredients used;
(c) calculation using generally accepted data or scientific knowledge.
(1) The information provided for in this Decree must be given in one place in the table with the assigned figures at the consumer packaging. Where space on the packaging does not allow it, information shall be provided in linear form. The printing of such data shall be done legibly and indelibly and shall be placed in a clearly visible place and shall not be subsequently glued, altered or obscured.
(2) The data must be in the Czech language. This provision shall not preclude the presentation of data in several languages.
Decree No 293 / 1997 Coll., on the method of calculation and presentation of nutritional (nutritional) value of foodstuffs and on labelling of possible adverse health effects, is hereby repealed.
This Decree shall take effect on 1 August 2004.
