GOVERNMENT REGULATION
of 8 February 2023
amending Government Regulation No 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended
The Government hereby orders pursuant to Section 22 (1) of Act No. 22 / 1997 Coll., on the technical requirements for products and on the amendment and addition of certain laws, as amended by Act No. 526 / 2020 Coll., ("the Act ') to implement Sections 2 (d) and 12 and 13 of the Act:
Government Decree No. 481 / 2012 Coll., on the restriction of the use of certain hazardous substances in electrical and electronic equipment, as amended by Government Decree No. 391 / 2016 Coll., Government Decree No. 101 / 2018 Coll., Government Decree No. 146 / 2019 Coll., Government Decree No. 121 / 2020 Coll., Government Decree No. 344 / 2020 Coll., Government Decree No. 334 / 2021 Coll. and Government Decree No. 120 / 2022 Coll., are amended as follows:
1. At the end of footnote 1, the sentences are added to separate rows
"Commission Delegated Directive (EU) 2022 / 1631 of 12 May 2022 amending, for the purposes of adapting to scientific and technical progress, Annex IV to Directive 2011 / 65 / EU of the European Parliament and of the Council as regards an exemption for the use of lead in superconductive cables and conductors from bismuth - strontium - calcium - cuprum - oxide and lead in their electrical connections. Commission Delegated Directive (EU) 2022 / 1632 of 12 May 2022 amending, for the purposes of adapting to scientific and technical progress, Annex IV to Directive 2011 / 65 / EU of the European Parliament and of the Council as regards an exemption for the use of lead in certain magnetic resonance imaging equipment. ';
2. In Annex 3, item 27, the word "applicable 'is replaced by the words" exemptions provided for in points (a) and (b) apply'.
3. In Annex 3, entry 27, the following points (c) and (d) are added:
"(c) in non-integrated MRI coils for which the certificate of conformity of the model was first issued before 23 September 2022; or
(d) in MRI equipment including integrated coils used in a magnetic field within a radius of 1 m around the magnetic isocentre which is part of magnetic resonance imaging equipment for medical purposes for which a certificate of conformity was first issued before 30 June 2024. ';
4. In Annex 3, entry 27, the final part of the provisions shall be added: "Exemptions referred to in points (c) and (d) shall apply until 30 June 2027. '.
5. In Annex 3, the following entry 48 is added:
'48. Lead in superconductive cables and conductors from bismuth - strontium - calcium - cuprum - oxide (BSCCO) and lead in electrical connections with these conductors. Expires on 30 June 2027. '
Efficacy
This Regulation shall take effect on 1 March 2023.
