laying down details on the implementation of alerts on the creation and termination of working relationships in civil certificates
The Federal Ministry of Labour and Social Affairs provides, pursuant to Paragraph 25 (3) of the Labour Code, in an agreement with the Federal Ministry of Interior and after consultation with the Central Council of Trade Unions:
Scope
The decree covers records of the creation and termination of the employment (teaching) ratio, the membership relationship to the production cooperative or to the single agricultural cooperative and the internal aspiration (hereinafter referred to as the "employment relationship ') carried out by organisations in civil certificates in cases provided for by the Government of the Czechoslovak Socialist Republic (1)
Record of employment relationship
(1) A record of the establishment of a working relationship shall be made by means of a longitudinal stamp of a height of up to 35 mm and a length of up to 60 mm indicating the name of the organisation with which the citizen is in a working relationship and the address of its registered office (hereinafter referred to as the "entry stamp"). In the issuing of the entry stamp, the official responsible for the organisation (hereinafter referred to as "authorised officer ') shall complete the date from which the citizen is employed in the organisation and sign the date of the entry and the entry.
(2) (2) the organisation to which those rights and obligations have been transferred shall adjust the record of the establishment of the employment relationship referred to in paragraph 1. The staff member shall make the adjustment by indicating under the entry stamp of the previous organisation the words "Organisational change on a date 'and adding to the date on which the rights and obligations of the worker's employment relationship have passed (i.e. the date on which the decision on organisational change took effect); the entry stamp shall be printed under this text, the entry stamp shall be crossed out in the section concerning the origin of the employment, the date of the entry and the signature of the entry.
(3) Where an organisation to which the rights and obligations of a citizen have been transferred do not have an entry stamp at the time of effective organisation change, the authorised staff member shall make the adjustment referred to in paragraph 2 manually by adding to the words "Organisational change on date" the date of transfer of rights and obligations, the name and address of the registered office of the organisation, the date of adaptation, the stamp of the organisation and the record.
(4) In accordance with the provisions of paragraphs 2 and 3, the organisation shall also, where the organisation has only changed its name or registered office.
Record of termination
(1) The record of the termination of the employment relationship shall be made by means of a longitudinal stamp of the dimensions referred to in Article 2 (1) indicating the name of the organisation and the address of its registered office ("exit stamp"). The authorised official shall complete the date of termination of the employment relationship, the date of the record and sign the record in the stamp.
(2) If there is an end to the membership or internal aspiration, the authorised official shall make appropriate adjustments to the stamp ("The membership ended on" or "Internal aspiration ended on").
This decree shall take effect on the day of its publication.
