DECLARATION
Ministry of Education and Culture
of 1 June 1963
on compulsory and work copies
The Ministry of Education and Culture shall, in agreement with the ministries of the consumer industry, interior and finance according to § 4 of Act No. 94 / 1949 Coll., on the publication and dissemination of books, music and other non-periodic publications, under § 2 of Act No. 184 / 1950 Coll., on the publication of journals and on the Union of Czechoslovak Journalists, and under § 3 (5) of Act No. 53 / 1959 Coll., on the uniform system of libraries:
Basic provisions
(1) The obligation to submit copies for the purposes of this Order applies to printed matter (paragraph 2), issued or printed
(a) in the Czechoslovak Socialist Republic,
(b) abroad, if the publisher is established in the Czechoslovak Socialist Republic.
(2) Printed under this Decree means, in particular, books, music and other non-periodical publications *) Newspapers and journals, * *) reproduced by print or by other similar means, as well as other types of printed matter as agreed between the ministries of education and culture and the consumer industry.
(3) The obligation under this Order shall not apply to:
(a) printed matter which serves economic and social needs (formulas, price lists, blankets, family announcements, etc.), provided that they contain exclusively data consistent with the purpose of the printing material;
(b) collections of circulars intended for internal use and containing only the instructions of the authorities, other authorities and undertakings, as well as official files and their components;
(c) printed matter serving the internal or outlet needs of undertakings;
(d) printed matter reproduced by typewriter or reproduction machine, * * *)
(e) securities and stamps of all kinds.
Overprint
(1) For each issue of a non-periodic publication, the publishing house shall be entitled to print over a specified load of 100 copies (so-called overprint) intended for free use as:
(a) the compulsory copies referred to in Article 3;
(b) working copies pursuant to Section 4.
(2) Printed copies are not included in the overprint. †)
(3) The amount of overprint at newspapers and magazines is determined by the Czechoslovak headquarters of the book culture on a proposal from the publisher.
Compulsory copies
(1) After two compulsory copies of all printed matter, the Czechoslovak headquarters of the book culture in Prague and the State Library of the Czechoslovak Socialist Republic in Prague will receive one copy of the Slovak Matrix in Martina.
(2) In addition to the copies referred to in paragraph 1, the Czechoslovak headquarters of the book culture in Prague will receive two additional mandatory copies of printed matter issued in Czech regions.
(3) In addition to the beneficiaries referred to in paragraph 1, the Slovak head office of book culture in Bratislava shall receive three compulsory copies of printed matter issued in Slovakia.
(4) After one copy of all printed matter, except:
(a) postcards,
(b) curriculum;
(c) two-dimensional teaching aids;
(d) teaching texts reproduced only for the needs of individual schools;
e) Regional and local press (regional and district newspapers and racing magazines)
receive:
1. State Scientific Library in Pilsen,
2. Regional Library in České Budějovice,
3. State Scientific Library in Liberec,
4. State Scientific Library in Hradec Kralove,
5. State Scientific Library in Brno,
6. State Scientific Library in Olomouc,
7. State Scientific Library in Ostrava,
8. University Library in Bratislava,
9. Regional Library in Banská Bystrica,
10. State Scientific Library in Košice,
11. Basic Library of the Czechoslovak Academy of Sciences in Prague,
12. Library of the Slovak Academy of Sciences in Bratislava.
(5) Compulsory copies of newspapers and magazines, including regional and local press, will also be received by the National Museum Library in Prague.
(6) The beneficiaries referred to in paragraph 4 under No 1 to 10 shall also receive, after one compulsory copy of the regional and local press issued in the territory of the respective region.
(7) The Czechoslovak headquarters of the book culture determines which other institutions and bodies are to be sent compulsory copies of printed matter.
(8) The total number of compulsory copies of non-periodical publications must not exceed 55 copies at one issue.
Working copies of non-periodic publications
(1) Working copies of non-periodic publications are intended for publishing purposes
(a) review, for members of the Editorial Board, for promotion, etc.,
(b) exchange with other publishers in the country and abroad;
(c) for publishing archives,
(d) to the management body of the publishing house,
e) for publishing managers in the functions that will be determined by the Czechoslovak headquarters of the book culture.
(2) The total number of working copies may not exceed 45 copies per publication, 4,5% of the load when issued in less than 1000 copies; their number may only be increased by undrawn copies required (§ 3 (7)).
(3) The publishing house is required to keep a record of the management of work copies according to the instructions of the Czechoslovak headquarters of the book culture.
Working copies of newspapers and magazines
The division of working copies of newspapers and magazines is set every year by the publisher of the Czechoslovak headquarters of the book culture.
Common provisions
(1) Compulsory copies of printed matter printed in the Czechoslovak Socialist Republic shall be sent to the recipients referred to in § 3 (1) to (6) by the printer for cargo and from the publishing paper balance sheet quota (publisher); other mandatory and working copies (including printed printed abroad) are supplied to publishers' recipients.
(2) Printers shall be required to send to the recipients compulsory copies at the latest at the same time as the first copies from the printer; the copies must be impeccable and if the load contains at least part of the copies bound, the copies must be supplied together.
(3) Where publications are published in several language versions, compulsory copies pursuant to Paragraph 3 (1) shall be sent in all language versions; otherwise only one language version is sent, the most accessible language.
(4) Where the recipients referred to in paragraphs 1 to 6 of Section 3 do not receive a compulsory copy at the latest, with the start of the publication, they shall have the right to obtain it on the cargo of the organisation which is obliged to supply the copy.
(5) The recipients referred to in § 3 (1) to (3) shall be required to send the printing works by the fifth day of each month, which they have printed in the previous month. The publishing houses are required to send lists of non-periodic publications which they have published in the previous month to the same beneficiaries within the same period.
Final provisions
(1) They are repealed.
(a) Decree No 62 / 1950 of the Ú. l. I on compulsory copies and their surrender for official and academic purposes,
(b) Paragraph 3 (2) of Decree No 39 / 1951 U. l. I, which shall be the subject of press regulations, as amended by Decree No 191 / 1951 U. l. I,
(c) Paragraph 10 (1) of Decree No 97 / 1956 of the Ú. l., on the modification of copyright fees for literary works.
(2) This decree shall take effect on the day of its publication.
