DECLARATION
of 12 December 2017
amending Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended
The Ministry of Agriculture provides pursuant to Article 33 of Act No. 154 / 2000 Coll., on Breeding, Breeding and Registration of Livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll., Act No. 130 / 2006 Coll. and Act No. 60 / 2017 Coll., for implementation of Sections 22 (13) and 23c (4) of the Act:
Decree No. 136 / 2004 Coll., laying down the details of the labelling of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll., Decree No. 213 / 2009 Coll., Decree No. 202 / 2010 Coll., Decree No. 64 / 2013 Coll. and Decree No. 5 / 2016 Coll., are amended as follows:
1. In Article 2, at the end of point (l), the dot is replaced by a comma and the following point (m) is added, including footnote 37:
'( m) non-breeding fish of aquaculture animals susceptible to diseases (37).
37) Article 23 (2) of Act No 154 / 2000 Coll., as amended. '
2. Paragraph 7 (4) reads as follows:
"(4) The duplicate of the mark for the marking of runners shall contain data identical to those shown on the original mark. ';
3. In Paragraph 25 (2), the introductory part of the provision reads: "Any runner, including the slaughtered on the holding, must be marked before leaving the holding in which he hatched, namely '.
4. In Paragraph 26 (1), the words "50 mm wide, not less than 40 mm wide 'are replaced by the words" 25 mm wide, not less than 9 mm wide'.
5. Paragraph 26 (2) reads as follows:
"(2) The mark used for the marking of runners shall contain:
(a) country of origin designation - letters "CZ" for the Czech Republic,
(b) an alphanumeric code expressing part of the registration number of the holding where the runner hatched; and
(c) the competent authority code. ';
6. In Article 27, at the end of paragraph 1, the sentence "In this case, the holding in which the runner hatched shall be deemed to be the place of destination in accordance with Article 26 (2) (b)."
7. In Article 27, at the end of paragraph 2, the sentence "In this case, the holding in which the runner hatched shall be considered to be another holding in accordance with the first sentence of paragraph 26 (2) (b)."
8. In Article 27, the following paragraph 3 is added:
"(3) Where runners are transferred from another Member State or imported from third countries directly to slaughterhouses, they shall not be identified. ';
9. In Article 39 (7), the words "Part B" shall be inserted after the words "movement certificate of bovine animals."
10. Paragraph 56, including the title, reads:
Register of runners on the holding
(1) For each farm and species, the runner-up shall keep a register of runners on the holding in writing on the forms provided by the mandate4) or in the form of a computer database (§ 32).
(2) Each register of runners on the holding must include:
(a) the name and, where appropriate, the names and surname or business name of the breeder;
(b) the registration number of the holding;
(c) the address of the holding; and
(d) the type of runner.
(3) The register of runners on the holding shall record for each holding:
(a) the number of runners of that species held on the holding;
(b) any change in the number of runners of that kind held on the holding, in particular hatching, transfer, death, loss, culling or domestic slaughter of runners, with the recording of:
1. the number of runners affected by the change;
2. the date of the change;
3. in the case of movements of runners, the registration number of the holding, establishment of the slaughterhouse, rendering plant or user establishment from which or where the runner has been moved, or the country code, where applicable, if the runners are moved from or to another Member State or imported or exported from a third country.
(4) The supervisory authorities (15) record in the register of runners on the holding the checks carried out, namely the date of the inspection, the name and, where appropriate, the names, surname and signature of the person who carried out the check and the name of the supervisory authority.
(5) The model of the register of runners on the holding is set out in Annex 10. "
11. In Section 57, the word "animals' is replaced by" runners'.
12. Paragraph 57 (1) is deleted.
Paragraphs 2 to 7 shall be renumbered paragraphs 1 to 6.
13. in Paragraph 57 (1):
"(1) Each breeder, trader, slaughterhouse operator, rendering undertaking, user establishment or assembly centre shall transmit to the authorised person (4) the data referred to in Article 56 (3) in the report on the hatching of runners, their mortality, loss, slaughter and transfer."
14. in Paragraph 57 (2), (4) to (6), "animals" is replaced by "runners."
15. in Paragraph 57 (3), "2" is replaced by "1."
16. in Paragraph 58 (2), the words "stables registers" shall be replaced by "register of runners on the holding" and the word "animals" shall be replaced by "runners."

Register of animals in the central register database
In the animal register, in addition to the information referred to in § 29, the runners shall be registered:
(a) the number of runners of that species held on the holding on the last day of the calendar month;
(b) a change in the number of runners held on the holding, hatched, moved, killed, killed or lost by runners, recording
1. the number of runners affected by the change;
2. the date of the change;
3. in the case of movements of runners, the registration number of the holding, the establishment of the slaughterhouse, the trader, the rendering undertaking, the user establishment or the assembly centre from which or where the runners have been moved, or the country code, if any, if it is a runner imported or exported from a third country. ';
18. In Paragraph 61 (1), the part of the sentence behind the semicolon, including the semicolon, is deleted.
19. Paragraph 77 (5) is deleted.
20. At the end of the text of the heading § 80, the words "on 1 September of the calendar year 'shall be added.
21. The following Section 80a is inserted after Section 80:
Reporting of establishment or cancellation of location during the year
(1) Where an unregistered bee breeder intends to start rearing bees, he may, at any time during the year, send an authorised person (4) a report of the number of hives and the location of the habitats listed in Annex 15. This is without prejudice to the procedure laid down in Paragraph 80.
(2) In the case where a registered bee breeder intends to transfer the hives to a place not yet registered as a habitat, or cancels a previously registered habitat, he may at any time during the year send the authorised person (4) a message of location of the habitats listed in Annex 16. This is without prejudice to the procedure laid down in Paragraph 80. '
22. In Paragraph 81, at the end of the text of paragraph 2, the words "and location reports' are added.
23. in Paragraph 82 (e), the words "1 September of the calendar year" shall be deleted;
24. In Paragraph 82, at the end of point (f), the dot is replaced by a comma and the following points (g) and (h) are added:
"(g) if the natural person is a stranger, in addition to the particulars referred to in (a), (b), (c), (d), (e) and (f), the identity document number and the State which issued the document,
(h) if the legal person or the natural person of the alien is involved, in addition to the particulars referred to in (a), (b), (c), (d), (e) and (f), the identification number, the State which issued the identification number and the State which issued the document. "
25. in Article 83 (e), the words "and bees until" shall be deleted;
26. In Article 83, at the end of point (e), the dot is replaced by a comma and the following point (f) is added:
"(f) in the case of bees, in the case of Article 80 and Article 80a (1) reports within 60 working days and in the case of Article 80a (2) reports within 10 working days.";
27. Annex 5 shall read as follows:
"Annex 5 to Decree No. 136 / 2004 Coll.
Cross-country marking
1. Model plastic stamps used for marking runners
2. Method of identification of runners with marks for marking of runners
Explanatory note:
Point A - injection site plastic marks into the right wing fold of runners
Point B - injection site of plastic marks in the skin of the neck at the lower neck of the runners'.
28. Annex 10 shall read:

Transitional provision
The runners of the designation provided for in Decree No. 136 / 2004 Coll., as effective before the date of entry into force of this Order, shall be deemed to be designated under Decree No. 136 / 2004 Coll., as effective from the date of entry into force of the provisions of Article 136 / 2004 Coll. I points 2 to 8, 10 to 18, 27 and 28 of this decree.
Efficacy
This Regulation shall enter into force on 1 January 2018, with the exception of Article I (2), (8), (10), (18), (27) and (28), which shall take effect on 1 April 2018.
