on the determination of the methodologies for tests of difference, uniformity, stability and utility value of varieties
The Ministry of Agriculture provides pursuant to Article 30 (3) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and amending certain laws (Act on the circulation of seeds and seed), as amended by Act No. 178 / 2006 Coll.:
Preliminary provisions
This decree (1) implements the relevant provisions of the European Community2) and sets out the methodologies for field and laboratory tests for differences, uniformity, stability and use of varieties of agricultural species, varieties of vegetable species and vine varieties.
Variety testing methodologies
(1) Methodology setting out the essential requirements for the organisation and conditions of the tests, the method of evaluation and an overview of the characteristics of the varieties tested means:
(a) protocols for tests of difference, uniformity and stability in accordance with the directly applicable Regulation of the European Communities (3) (hereinafter referred to as "Protocols");
(b) guidelines for testing the difference, uniformity and stability of the International Union for the Protection of New Varieties of Plants (4) (hereinafter referred to as "test principles"),
(c) the methodology for testing the value of agricultural species used by the central control and testing institutes of agriculture (hereinafter referred to as "the methodologies for testing the value of use");
(d) the characteristics for testing and the requirements for carrying out tests for the difference, uniformity and stability of vine varieties (hereinafter referred to as "characteristics and requirements").
(2) The arrangements and conditions for tests of difference, uniformity, stability, or utility values, as appropriate, comply with the requirements for protocols, test principles, test methodologies of the value of use or the characteristics and requirements for the types of varieties listed in Annexes 1, 2 and 3.
(3) The test of difference, uniformity and stability shall cover all characteristics according to the protocols and, where appropriate, at least all characters marked with an asterisk in the test principles, unless the observation of characters is prevented by the expression of other characters and the expression of the character does not preclude the conditions of the environment under which testing takes place (5).
Methods for testing varieties of agricultural species
(1) For tests on the diversity, uniformity and stability of varieties of agricultural species listed in Annex 1, the test methodologies contained therein shall apply.
(a) in the protocols listed in Table 1.1 for the agricultural species listed in that table,
(b) in the principles of testing set out in Table 1.2 for the agricultural species in that table.
(2) Testing for the use value of a variety of agricultural species includes evaluation of yield, resistance to diseases and pests, response to physical factors of the environment and evaluation of qualitative characteristics of the variety6). For tests on the value of use of varieties of agricultural species, the methodologies for testing the value of use listed in Annex 1, Table 1.3 for agricultural species in this table shall be used.
Methods for testing varieties of vegetable species
For tests on the difference, uniformity and stability of varieties of vegetable species listed in Annex 2, the test methodologies contained therein shall apply.
(a) in the protocols listed in Table 2.1 for the vegetable species listed in that table,
(b) in the principles of testing set out in Table 2.2 for vegetable species in this table.
Methodology for testing vine varieties
The tests for the difference, uniformity and stability of vine varieties shall cover the characteristics and characteristics listed in Annex 3, Table 3.1 and shall meet the minimum requirements for carrying out those tests set out in Table 3.2.
Efficacy
This Decree shall take effect on 1 October 2006.
