amending Government Regulation No 479 / 2009 Coll., on determining the consequences of a breach of cross compliance of the granting of certain aid, as amended, and certain related Government Regulations
The Government orders pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Amendment of the Government Regulation on closer conditions for implementing measures of the common organisation of the market in wine
In Annex No 2 to Government Decree No. 245 / 2004 Coll., on establishing closer conditions for the implementation of measures of the common organisation of the market in wine, as amended by Government Decree No. 83 / 2006 Coll., Government Decree No. 82 / 2009 Coll., Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;
(b) slightly eroded shall ensure that maize, potatoes, beet, beet, soya, sunflower and sorghum crops are established only using soil protection technologies.
These conditions need not be complied with on a continuous surface with an area of less than 0,4 ha of agricultural land, the longer side of which is oriented in the direction of plantations with a maximum deviation from the pedigree of up to 30 ° and below which the agricultural land belt at a minimum width of 24 m is situated, which breaks the drains passing through the broad-line crop area and on which the applicant grows grassland, multiannual forage or other than broad-line crops, provided that the applicant can apply this procedure on only one such defined area or the sum of such areas does not exceed the area of 0,4 ha of agricultural land. '
Transitional provision
Applications submitted under Government Regulation No. 245 / 2004 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Regulation No. 245 / 2004 Coll., as effective until the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for granting separate sugar payment to sugar growers
In the Annex to Government Decree No. 45 / 2007 Coll., establishing certain conditions for granting separate sugar payment to sugar growers, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;
(b) slightly eroded shall ensure that maize, potatoes, beet, beet, soya, sunflower and sorghum crops are established only using soil protection technologies.

Applications submitted pursuant to Government Regulation No. 45 / 2007 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No. 45 / 2007 Coll., as effective until the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for granting the single area payment of agricultural land and certain conditions for providing information on the processing of agricultural products originating in land put up for rest
In the Annex to Government Regulation No 47 / 2007 Coll., on the establishment of certain conditions for granting the single area payment for agricultural land and certain conditions for providing information on the processing of agricultural products originating in the land put up for rest, as amended by Government Regulation No 480 / 2009 Coll. and Government Regulation No 369 / 2010 Coll., point 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year

Transitional provision
The procedure for applications submitted under Government Regulation No. 47 / 2007 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Regulation No. 47 / 2007 Coll., as effective until the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land
In Annex 2 to Government Decree No 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and in Natura 2000 areas on agricultural land, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;

Transitional provision
Applications submitted pursuant to Government Regulation No 75 / 2007 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 75 / 2007 Coll., as amended by the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for the implementation of agri-environmental measures
Government Regulation No. 79 / 2007 Coll., on the conditions for the implementation of agri-environment measures, as amended by Government Regulation No. 114 / 2008 Coll., Government Regulation No. 45 / 2009 Coll., Government Regulation No. 83 / 2009 Coll., Government Regulation No. 480 / 2009 Coll., Government Regulation No. 78 / 2010 Coll., Government Regulation No. 112 / 2010 Coll., Government Regulation No. 369 / 2010 Coll., Government Regulation No. 282 / 2011 Coll., Government Regulation No. 61 / 2012 Coll., and Government Regulation No. 263 / 2012 Coll., are amended as follows:
1. In Article 8 (4) (f), the words "with this dominant species of fruit trees or, where appropriate, of fruit bushes' shall be inserted after the word" orchard '.
2. In Article 9, at the end of paragraph 15, the dot is replaced by a comma and the following point (i) is added:
"(i) need not fulfil the condition set out in point 9 of Annex 2 to this Regulation.";
3. In Paragraph 9, at the end of paragraph 16, the dot is replaced by a comma and the following point (h) is added:
"(h) may not fulfil the condition set out in point 9 of Annex 2 to this Regulation."
4. In Article 9, at the end of paragraph 17, the dot is replaced by a comma and the following point (j) is added:
"(j) maintains a clear border between dry steppic grass and heaths in the field."
5. In Article 14 (1), the words "or (j) 'shall be added at the end of the text in point (h).
(6) footnotes 33, 34, 36 and 37 are deleted, including the footnotes.
7. In Annex 2, point 2:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;

'
8. In Annex 3, points 8 to 10 read:
"8. the condition provided for in Article 55 of Regulation (EC) No 1107 / 2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79 / 117 / EEC and 91 / 414 / EEC and Article 49 (1) (a) of Act No 326 / 2004 Coll., as amended
9. The condition laid down in Sections 61 (1) and 64 (4) (a) of Act No. 326 / 2004 Coll., as amended
10. condition laid down in § 86 of Act No. 326 / 2004 Coll., as amended. "
9. In Annex 3, point 11 is deleted.
10. In Annex 10, points B and C read:

Applications submitted pursuant to Government Regulation No 79 / 2007 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 79 / 2007 Coll., as amended by the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies for afforestation of agricultural land
In Annex No 2 to Government Decree No. 239 / 2007 Coll., establishing the conditions for granting subsidies for afforestation of agricultural land, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 read as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;

Amendment of the Government Regulation laying down certain conditions for granting separate payment for tomatoes for processing
In the Annex to Government Decree No. 95 / 2008 Coll., laying down certain conditions for granting separate payment for tomatoes for processing, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year

Applications submitted pursuant to Government Regulation No 95 / 2008 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 95 / 2008 Coll., as amended by the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies for the conservation of the forest-based economic population under the Natura 2000 measure in forests
In Annex 3 to Government Decree No. 147 / 2008 Coll., on the establishment of conditions for the grant of subsidies for the conservation of the economic population of forest land under the Natura 2000 measure in forests, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year

Proceedings on applications submitted under Government Regulation No. 147 / 2008 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Regulation No. 147 / 2008 Coll., as amended by the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies on forestry-environmental measures
In Annex 4 to Government Decree No. 53 / 2009 Coll., on the establishment of conditions for granting subsidies on forestry-environmental measures, as amended by Government Decree No. 480 / 2009 Coll. and Government Decree No. 369 / 2010 Coll., paragraph 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;

Applications submitted under Government Regulation No. 53 / 2009 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Regulation No. 53 / 2009 Coll., as effective until the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for the payment of cows kept in a system of market milk production
In the Annex to Government Regulation No 87 / 2010 Coll., laying down certain conditions for the payment of cows kept in a system with market production of milk, as amended by Government Regulation No 369 / 2010 Coll., point 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;
(b) slightly eroded shall ensure that maize, potatoes, beet, beet, soya, sunflower and sorghum crops are established only using soil protection technologies.

The procedure for applications submitted pursuant to Government Regulation No 87 / 2010 Coll. initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 87 / 2010 Coll., as amended by the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for granting specific support to farmers
In Annex 2 to Government Decree No. 60 / 2012 Coll., establishing certain conditions for granting specific support to farmers, point 2 reads as follows:
'2. Applicant on the area of the soil block or part thereof, marked as land from 1 July of the relevant calendar year until 30 June of the following calendar year
(a) strongly eroded shall ensure that maize, potatoes, beet, seed, soya, sunflower and sorghum are not grown; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be respected only if they are grown with the seed of clover or clover;
(b) slightly eroded shall ensure that maize, potatoes, beet, beet, soya, sunflower and sorghum crops are established only using soil protection technologies.

Transitional provision
The procedure for applications submitted under Government Regulation No. 60 / 2012 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Regulation No. 60 / 2012 Coll., as effective until the date of entry into force of this Regulation.
Amendment of the Government Regulation on the establishment of vulnerable areas and action programme
In Section 11 of Government Decree No. 262 / 2012 Coll., on the establishment of vulnerable areas and action programme, paragraphs 1 and 2 read as follows:
"(1) On agricultural parcels marked from 1 July of the relevant calendar year until 30 June of the following calendar year, according to the land register maintained under another legislation (12), land is found
(a) maize, potatoes, beets, beans, soya, sunflower and sorghum crops shall not be grown with a strong erosion risk; cereal and oilseed rape crops on the area so marked shall be established using soil protection technologies; in the case of cereals, the condition of soil protection technologies in the setting-up of crops need not be complied with only if they are grown with the seed of clover or clover (13);
(b) slightly eroded broad-line maize crops, potatoes, beet, beet, soya, sunflower and sorghum shall be established only using soil protection technologies (13).
These conditions need not be complied with on a continuous surface with an area of less than 0,4 ha of agricultural land, the longer side of which is oriented in the direction of plantations with a maximum deviation from the pebbles of up to 30 degrees and below which the agricultural land belt of a minimum width of 24 m breaks the drains passing through the wide-line crop area and on which the applicant grows grassland, multiannual forage or other than broad-line crops, provided that the applicant can apply this procedure on only one such defined area or the sum of such areas does not exceed the area of 0,4 ha of the agricultural land.
(2) In order to protect water from pollution, maize, potatoes, beet, beet, soya, sunflower and sorghum crops with a gradient exceeding 7 degrees shall not be grown at a distance of less than 25 m from the surface water body. ';
Transitional provision
Proceedings under Government Decree No. 262 / 2012 Coll. initiated before the date of entry into force of this Regulation shall be completed under Government Decree No. 262 / 2012 Coll., as effective until the date of entry into force of this Regulation.
EFFECTIVE
This Regulation shall take effect on 1 January 2013.
