Ordonnance on quantities and types of flavourings, conditions of use, health requirements and conditions of use of quinine and caffeine

DECLARATION
of 16 July 2004
on the requirements for the quantities and types of food flavourings, their conditions of use, their health requirements and the conditions for the use of quinine and caffeine
According to Article 19 (1) (a) and (b) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll. and Act No. 146 / 2002 Coll., hereinafter referred to as "the Act":
§ 1
Basic concepts
For the purposes of this decree and in accordance with the law of the European Communities (1):
(a) aroma - a food flavouring containing flavouring substances, flavouring preparations, reaction flavouring preparations, smoke flavouring preparations, individually or in combination;
(b) flavouring substance - a chemically defined substance which acts on human olfactory or olfactory and taste receptors and induces the sensation of smell and taste, individually or in combination;
(c) natural flavouring substance - a substance obtained by physical processes (e.g. distillation and solvent extraction), enzymatic or microbial processes from raw materials of plant or animal origin as such or modified for human consumption,
(d) a naturally identical flavouring substance - a substance obtained by chemical processes (synthesis or isolation steps of a chemical nature) which is chemically identical to a substance naturally present in sources of plant or animal origin;
(e) artificial flavouring substance - a substance obtained by chemical processes (synthesis) which is not chemically identical to substances present in sources of plant or animal origin,
(f) flavouring preparation - a preparation obtained by physical, enzyme or microbial processes from the raw materials referred to in (c) which is not a chemically defined substance and which acts on human olfactory or olfactory and taste receptors and induces a sense of smell, smell and taste;
(g) reaction flavouring preparation - a preparation obtained by heating a mixture of starting materials which may not be aromatic in themselves at a temperature not exceeding 180 ° C for a period not exceeding 15 minutes. At least one of the starting materials must be a nitrogen with a functional amino group and another is reducing sugar, or sugars,
(h) smoke flavouring preparation - the preparation obtained by extraction from pyrolysis (thermal decomposition) of the starting materials used in the traditional process of smoking foodstuffs,
(i) maximum authorised quantity of non-toxic substances (2) intended for flavourings - the quantity determined by numerical value,
(j) the quantity necessary - the quantity strictly necessary to achieve the intended technological effect and while maintaining the principles of good manufacturing practice;
(k) "FL" number - the number assigned to the flavouring substance from the database system called "FLAVIS."
Requirements for substances intended for the production of flavourings
§ 2
(1) Substances obtained by physical processes (e.g. distillation or solvent extraction), chemical processes (e.g. synthesis or isolation steps of a chemical nature), enzyme or microbial processes from food raw materials of plant or animal origin or modified for human consumption, shall be used for the manufacture of flavourings.
(2) Only substances which do not pose a health hazard to consumers and whose use does not mislead consumers may be used for the production of flavourings.
(3) Aromatic preparations resulting from the action of enzymes on foodstuffs and food ingredients may be used for the flavouring of foodstuffs according to the principle of the necessary quantity.
(4) Where the amount of aroma in a food is determined, the maximum level is used as a limit value. The maximum quantity allowed shall be determined by a numerical value or by the necessary quantity to achieve the intended technological effect while maintaining good manufacturing practice.
(5) Foodstuffs (for example, herbs, spices, mushrooms) referred to in special legislation3, and substances which exclusively have a sweet, acidic, bitter or salty taste, as well as substances of plant or animal origin which are characterised by their own flavouring but which are not used for food flavourings, are not considered as flavourings.
§ 3
(1) Substances listed in Annexes 1 to 4 may only be present in flavourings in quantities, purity and under the conditions set out in those Annexes;
(a) Annex No 1 sets out the substances of origin of plant or animal (for example, essential oils, extracts, oleoresins), as defined by the number of the Aromatic Manufacturers Association;
(b) Annex 2 sets out substances for which confidentiality has been requested by EU Member States in order to protect the intellectual property rights of their manufacturers;
(c) Annex 3 sets out food flavourings for infants and children;
(d) Annex 4 lays down chemical requirements for flavourings and aromatised foodstuffs and microbiological requirements.
(2) The conditions of use of caffeine and quinine in food production are set out in Annex 5.
§ 4
Substances that can be used as part of flavourings
(1) To ensure the stability of flavourings, only antioxidants and preservatives referred to in special legislation4 may be used, marked E 200, E 202, E 203, E 210 to E 228, E 300, E 301, E 302, E 304, E 306, E 307, E 312, E 320, E 321. For this purpose, these substances may only be used in the quantity necessary to ensure the durability of the aroma.
(2) Maltodextrine, native and modified starches, food and food ingredients are used as carriers and solvent flavourings. In addition, carriers and solvents of flavourings referred to in special legislation4 may be used for this purpose under the conditions specified therein. Benzyl alcohol may also be used as a solvent. The content of this substance in a food for consumption must not exceed 100 mg. I-1 for soft drinks and 300 mg. Kg-1 for other foods.
(3) In the case of bulk flavourings, it may be used as an anti-caking agent in the necessary amount of the substance referred to in the specific legislation4) for food.
(4) The following amino acids, or their sodium or potassium salts, may also be used as a part of the flavouring flavour: L- alanine, L- arginine, L- asparage acid, L- citrulin, L- cysteine, L- cystine, L- histidine, L- isoleucine, L- leucine, L- lysine, L- methionine, L- phenylalanine, L- serin, taurine, L- threonine, L- tyrosine, L- valine, for flavouring preparation of aromatised foods.
(5) In a food intended for consumption, the individual amino acids or their salts referred to in paragraph 4 (calculated as amino acid) shall not exceed 300 mg. These quantities shall be related to foods prepared for consumption according to the manufacturer's instructions, if any.
(6) Additives other than those mentioned in paragraphs 1 and 2 may be used for the production of flavourings only in foodstuffs covered by specific legislation4, under the conditions laid down therein.
(7) Food and food raw materials, substances used for food production and microbial cultures used for food production may be used to produce flavourings obtained by microbial processes.
(8) Food, food raw materials, food-producing substances and food-producing enzymes may be used to produce flavourings obtained by enzymes.
(9) Only non-treated wood for the manufacture of smoke flavourings may be used.
(10) Only amino acids and their mixtures, hydrolysates resulting from protein hydrolysis and monosaccharides, disaccharides and polysaccharides may be used for the manufacture of reaction flavourings.
(11) Only wood vinegar, manganese oxide and sulphuric acid can be used to produce rum ether.
§ 5
Labelling of flavourings not intended for sale to the consumer by information of food safety importance
(1) The word "natural" or any other word of similar importance may be used only for flavouring substances whose flavouring component contains exclusively flavourings referred to in § 1 (c) or flavouring preparations referred to in § 1 (f).
(2) Where the designation of a flavouring (5) contains a reference to a food or flavouring source, the word "natural" or any other word of similar importance shall not be used unless the flavouring ingredient has been isolated by appropriate procedures or traditional food preparation exclusively or almost exclusively from the food or flavouring source.
(3) Aromas must bear on the package the following particulars legibly, clearly and indelibly:
(a) by a trading firm or by the name of a legal person, or by the name and surname of a natural person who is the manufacturer, packer or importer, and its address;
(b) the name of the flavouring substance, including the word "aroma," possibly associated with other words characterising the flavouring referred to in Article 2 or giving its specific name;
(c) the designation "for food" or the indication of a group of foodstuffs or an individual food for which the aroma is intended,
(d) the indication of the lot or the date of manufacture;
(e) the labelling of the categories of flavouring substances listed in descending order according to their weight and, for these purposes, the following categories shall be distinguished:
1. natural flavouring substances,
2. flavouring substances naturally identical,
3. artificial flavouring substances,
4. flavouring preparations,
5. reaction aromatic preparations;
6. smoke flavourings,
(f) indication of the quantity (6) in units of mass or volume,
(g) particulars of the maximum quantity of each ingredient or group of ingredients for which a specific legislation4) the maximum quantity in the food (food group) for which the aroma is intended. Such data may be replaced by a declaration on the packaging that, at the specified dosage, the manufacturer guarantees compliance with the requirements of the specific legislation4).
(4) In the case of mixtures of flavourings or mixtures of the following substances with other substances referred to in Section 2, they shall be marked in descending order of weight in the mixture:
(a) a flavouring according to § 1 (b) to (h);
(b) the names of each of the other substances or raw materials and, where appropriate, their international code number (E number).
(5) The particulars referred to in points (e), (g) and (5) of paragraph 3 may also be indicated only in the documentation relating to the delivery of the aroma, provided that it is supplied at the same time or before delivery, if it appears in a visible place on the packaging or container of the product concerned "intended for the manufacture of foodstuffs, not intended for retail sale."
(6) The data must be given in the Czech language, unless other measures have been taken to ensure that the customer is informed. This provision shall not prevent such particulars in several languages.
§ 6
Labelling of flavourings intended for sale to the consumer by information relevant to food health
(1) For flavouring substances intended for sale to the consumer, the provisions of Section 5 (1) (2) (a), (c), (d) and (f), (4) (5) (6) of the Ordinance and specific legislation5), (7) shall apply as regards their labelling.
(2) In addition to the particulars referred to in paragraph 1, the packaging shall bear the following particulars:
(a) instructions for the use of the flavouring if omission would prevent the proper use of the flavouring;
(b) an indication of the date of minimum durability,
(c) data on storage or storage where the nature of the product so requires.
Final provisions
§ 7
Aromata and food produced using flavourings put into circulation before the date of entry into force of this Decree shall be assessed in accordance with existing legislation.
§ 8
Decree No. 52 / 2002 Coll., laying down requirements on the quantities and types of food flavourings, their conditions of use, their health and the conditions of use of quinine and caffeine, is hereby repealed.
§ 9
This Decree shall take effect on 1 August 2004.

Chemical and microbiological requirements for flavourings
1. The maximum permitted levels (hereinafter NPM) of flavourings contaminants are given in Table 1:

Even if these NPM are complied with, the dosage of the aroma must be such that the NPM of contaminants, as set out in Annex 2 to the Specific Regulation, is not exceeded in the flavoured food. *
2. When food flavourings are used, the amount of polyaromatic hydrocarbons carried into the food at the highest dosage recommended by the flavouring manufacturer shall not exceed 0,03 μg (calculated as 3,4 benzo (a) pyrene) per kg of food. For foods which require an adjustment prior to consumption, this value applies to a food modified according to the instructions.
3. When flavourings are used, the maximum authorised quantities of naturally occurring substances listed in Table 2 shall not be exceeded in flavoured foods. These substances shall not be intentionally added to flavourings or foodstuffs. They may be present in foodstuffs either naturally or as a result of the addition of flavourings prepared from natural sources.

4. Flavouring substances shall not contain micro-organisms and microbial toxins causing a disease from foodstuffs in quantities that could endanger the health of persons.

Conditions of use of caffeine and quinine in food production
(1) Caffeine and quinine may be used for food production directly or as part of the aroma.
(2) Caffeine should be used as a chemical substance of caffeine or caffeine monohydrate.
(3) Quinin should be used as the chemical of quinine sulphate and quinine hydrochloride.
(4) The purity and identity of quinine and caffeine must comply with the requirements laid down for these substances by specific legislation. *)
(5) The maximum levels of caffeine and quinine in foodstuffs are set out in the table. The content of these substances in the concentrate for the preparation of a non-alcoholic beverage may not exceed a maximum level for that substance when prepared according to the instructions.
(6) This decree does not apply to caffeine, which occurs as a natural part of a food (for example, coffee, tea) or food ingredients if the food or food material is its only source.
