on the Mining Rescue Service
Pursuant to § 6 (6) (a) and § 7 (9) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll.:

ČÁST PRVNÍ

GENERAL PROVISIONS
§ 1
Subject matter
This decree provides for the provision of the mining rescue service, its organisation and tasks, in particular to carry out work to save human lives and property in major operational accidents (accidents), including the provision of first aid in the underground, and the principles of the action of the mining rescue workers; Furthermore, it lays down requirements to ensure safety and health at work and the competence of members of the Mining Rescue Corps.
§ 2
Interpretation of terms
For the purposes of this decree, it shall be considered as:
(a) a mine operating unit which, as a general rule, constitutes a separate technical unit from the point of view of ventilation, irrespective of what it is called by the organisation; the mine is also an underground construction in an underground mining activity,
(b) a mine with simple conditions of a non-coal mine, a mine in exploration, construction, securing or disposal, and a mine in which special interference with the crust is carried out, 1)
(c) diving activity descent below water level and activity in this environment using breathing diving apparatus and equipment;
(d) the planned non-emergency intervention is a summary of the planned work and activities which can only be carried out by mining rescue workers, taking into account the conditions in which they are to be carried out;
(e) a serious operational accident involving, or likely to be, a serious threat to the lives and health of persons or property, in particular mining fire, explosion of gases and coal dust, mine shock, rupture of rocks and gases, eruption of oil and natural gas, a cave-in of mining works, a flow of water and mud or chickens, and a disturbance in ventilation or mining equipment ("accidents"),
(f) the base of the area defined for the entry into and rest of mining rescue workers, which is also used for the temporary storage of respiratory devices and other equipment of mining rescue workers between interventions and which is connected to the commander of the mining rescue service or dispatcher;
(g) rescue action shall be carried out by mining rescue workers consisting of a summary of the operations to be carried out or carried out by mining rescue workers and the necessary related activities, including preparation for intervention, movement to the organisation or part of the affected accident, rest between the base interventions and the other tasks ordered by the Chief of the Mining Rescue Corps,
(h) intervention by mining rescue workers in rescue operations or planned non-emergency action consisting of a summary of the actions ordered since leaving the base or other place until they return to the base or other designated place;
(i) the difficult microclimatic conditions of a working environment in which the physical parameters of the surrounding environment make it difficult or impossible to remove metabolic heat from the human body and from an environment with a noise exceeding 100 dB and exposure to radiant heat above 250 ° C, for which reason it is necessary to limit the duration of residence in such an environment; difficult microclimate conditions are always in the mining environment when the wet temperature of the mine air reaches 26 ° C or more.

ORGANISATION AND TASKS OF BAN SAFEGUARD SERVICES
§ 3
Máňská zdražská služba
The Mining Rescue Service consists of the mining rescue stations, which are the main mining rescue stations and racing mining rescue stations, and the mining rescue corps of these stations and the State Mining Administration.
§ 4
Tasks of the Mining Rescue Service
(1) The mission of the Mining Rescue Service is to carry out work and rapid and effective interventions to:
(a) saving human lives and property in accidents, including the provision of first aid in the underground;
(b) the handling of accidents;
(c) the removal of the consequences of accidents.
(2) In addition to the tasks referred to in paragraph 1, the Mining Rescue Service
(a) carry out other activities in a non-breathable or healthy environment and other special and risky work, such as work at height and above or below water level;
(b) cooperate with organisations in emergency prevention and health and safety at work and operational safety, in particular by carrying out random inspections of their workplaces and checks on means of coping with accidents and, where appropriate, staff training and training;
(c) carry out the tasks and duties arising from specific legislation.2)
§ 5
Main Mining Rescue Station
The main mining rescue station is established for territorial units established by the Czech Mining Office. The main mining rescue station is set up by 3) an organisation which has an obligation to provide mining rescue service, 4) (hereinafter referred to as "the organisation") or several organisations designated by the Czech Mining Authority (hereinafter referred to as "the organisation") that perform mining or mining activities in the territory. Other organisations within the scope of the Main Mining Rescue Station shall conclude an agreement with its founder or the Main Mining Rescue Station indicating the amount of their contributions to the cost of setting up, equipping and operating the Main Mining Rescue Station. 5)
§ 6
Tasks of the main mining rescue station
(1) In addition to the tasks referred to in Section 4, the Main Mining Rescue Station shall carry out the following additional tasks:
(a) ensure a permanent emergency for mining rescue workers, including specialists and the necessary techniques, to the extent specified by the Staff Regulations (§ 26) of the Main Mining Rescue Station, and to this end process the timetable for the entry of mining rescue workers into a permanent emergency service associated with training and training;
(b) ensure the provision of first aid in the underground, on the smooth mines of Class II danger professional first aid (6);
(c) conduct basic training and practical training for new mining rescue workers and, where appropriate, other persons according to the curriculum approved by its Director; issue a medical certificate or certificate, where appropriate, on the qualifications acquired;
(d) conduct training and practical training of members of the mining rescue corps and, where appropriate, other persons, including training of mining rescue workers in difficult conditions (in the heat chamber, in the pipe, in the mine, in the training centre or elsewhere);
(e) repair, control and test self-rescue, breathing and artificial pulmonary ventilation ("resuscitation apparatus") and their accessories, checking and testing instruments and rescue techniques; the procedure for carrying out this activity shall be determined by the Director;
(f) provide for specific tests of self-rescue, breathing and recovery devices and rescue techniques necessary to verify their technical parameters and operational reliability in the foreseeable conditions, to clarify the circumstances of accidents associated with their use or failure, and, where appropriate, to verify them in exceptional circumstances; the content and content of these tests shall be approved by the Director of the Main Mining Rescue Station,
(g) express its views on the rules of service of the mining rescue stations before their submission for approval;
(h) manage methodically and check at least once a year the operation of the mining mining rescue stations;
(i) control facilities and means of emergency prevention in organisations;
(j) control plans for major operational accidents (7) (hereinafter referred to as "emergency plan") in organisations and, at the request of the organisation, participate in the preparation and annual checks of emergency plans;
(k) monitor and exploit research and development in the field of mining rescue;
(l) on the basis of a decision taken by the Director of the Main Mining Rescue Station or at the request of the Organisation, participate in a rescue operation carried out by the Mining Mining Rescue Station;
(m) train and test staff and other organisations intended for the issue, maintenance and repair of detection and indication equipment for the inspection of mining air constituents, staff for the training of users of detection and indication equipment;
(n) supplies or provides gas laboratories with reference (branding) gases.
(2) The main mining rescue station determines the fitting-out of the organization of indicator and detection devices and self-rescue, breathing and life-saving devices, including their accessories.
(3) The main mining rescue station processes an annual report on its activities and sends it to the Czech Mining Office and the district mining offices with jurisdiction in the territory for which it was established.
§ 7
Racing mining rescue station
(1) A plant mining rescue station establishes an organisation
(a) on a deep-sea mine,
(b) on a coal quarry,
(c) which has workplaces on which drilling and geophysical work is carried out, where flammable or harmful gases, water under pressure or oil are expected to occur, or on which the extraction, treatment or underground storage of liquid minerals and gases is carried out in natural rock structures or underground areas, or special interference with the earth's crust, or where such workplaces are in a state of security, or where they dispose of wells or probes;
(d) which conquers minerals by leaching or obliterating the consequences of such extraction;
(e) which carries out mining activities underground and has an obligation to provide mining rescue services. 8)
(2) A racing mining rescue station may be set up as common to several organisations or parts thereof referred to in paragraph 1, following the recommendation of the main mining rescue station and with the agreement of the district mining authority (9).
(3) Following the recommendation of the main mining rescue station and with the agreement of the district mining authority (9), the establishment of a mining rescue station may be waived if another mining rescue station or directly the main mining rescue station are performed.
§ 8
Tasks of the racing mining rescue station
(1) In addition to the tasks referred to in Section 4, the Racing Mining Rescue Station shall carry out the following additional tasks:
(a) provide an emergency for mining rescue workers and the necessary techniques within the scope specified by the Staff Regulations of the Mining Rescue Station;
(b) conduct training and practical training of mining rescue workers;
(c) ensure the entry of mining rescue workers to permanent emergency services at the main mining rescue station according to the schedule of arrivals prepared by the main mining rescue station;
(d) participate in the preparation and annual checks of emergency plans;
(e) control facilities and means of emergency prevention;
(f) repair, control and test self-rescue devices, breathing appliances and life-saving appliances and their accessories, checking and testing instruments and rescue techniques, according to the methodology developed by the main mining rescue station [Paragraph 6 (1) (e)];
(g) inform the main mining rescue station without delay of any rescue operation using breathing apparatus and of the use of self-rescue devices;
(h) immediately notify the main mining rescue station of the announcement and termination of emergency conditions at the workplace within its jurisdiction.
(2) Immediately after the onset of the emergency, a racing mining rescue station with a permanent emergency shall inform the main mining rescue station of its composition.
(3) An annual report of its activities shall be drawn up by the Racing Mining Rescue Station and sent to the main mining rescue station within one month of the end of the calendar year.

EQUIPMENT AND LOCATION OF BAN SAFETY STANDS
§ 9
Equipment of the mining rescue station
Sufficient conditions for personnel, material and technical equipment and the operation of a mining rescue station are created by its founder.
§ 10
Equipment of the main mining rescue station
(1) The basic equipment of the main mining rescue station consists of:
(a) life-saving appliances, breathing appliances and life-saving appliances and their accessories;
(b) premises and equipment for checking, disinfecting, testing and repairing self-rescue, breathing and reviving apparatus and their accessories;
(c) measuring, detecting and indicating instruments;
(d) personal protective equipment (e.g. anti-shale suits, anti-chemical suits and refrigerating vests),
(e) means of communication, including rapid calls for rescue aid,
(f) medical technology and material;
(g) the technique and material chosen to combat foreseeable accidents;
h) means of transport for the departure of mining rescue workers for rescue and service vehicles;
(i) techniques and equipment for working at height and above free depth, or even below water level;
(j) computer techniques and means of photographic documentation and video recording;
(k) accommodation, teaching and training facilities and pipes; and
(l) infirmary, laboratories, garages, workshops and warehouses,
(m) premises and facilities for maintaining and improving the fitness of mining rescue workers.
(2) In addition to the equipment referred to in paragraph 1, the main mining rescue station, which is intended to carry out its tasks in deep-sea mines, shall also constitute a heat chamber.
§ 11
Equipment of the mining rescue station
The basic equipment of the mining rescue station consists of:
(a) breathing appliances and reviving appliances and their accessories,
1. on a coal mine with the exception of a lignite mine, at least 20 breathing appliances and 2 reviving appliances and their accessories;
2. on a lignite mine and on a coal quarry of at least 12 breathing apparatus and 2 reviving apparatus and accessories thereof,
3. at a mine with simple conditions and, in the cases referred to in § 7 (1) (c), (d) and (e), at least 6 breathing appliances and 1 revival apparatus and their accessories,
(b) premises and facilities for checking, disinfecting, testing and repairing breathing apparatus and reviving apparatus;
(c) measuring, detecting and indicating instruments;
(d) personal protective equipment;
(e) means of connection for the rapid assembly of mining rescue workers;
(f) means of transport for the rapid transport of mining rescue workers;
(g) teaching facilities;
(h) workshops and warehouses; and
(i) other equipment specified by the Staff Regulations.
§ 12
Breathing and reviving apparatus
(1) Only a person trained in its use (§ 6 (1) (c)) may use a breathing apparatus and a respirator.
(2) Breathing appliances and reviving appliances and their accessories must be maintained in an operational state; The Staff Regulations shall determine how many of these instruments may not be in standby condition. Devices not ready for intervention must be stored separately and marked so that there is no confusion with the devices ready for intervention.
(3) Oxygen breathing apparatus may only be used for intervention if specified by the Staff Regulations or at the command of the Chief of the Mining Rescue Corps.
(4) At least 3 replacement CO2 absorbers (hereinafter referred to as the "absorber ') and 3 refilled cylinders shall be provided for each oxygen breathing apparatus. It is necessary to have 3 spare filled cylinders ready for each air breathing apparatus. Oxygen may be used to fill the cylinders for oxygen breathing devices for breathing or breathing mixtures as specified by the manufacturer of the breathing apparatus and for air breathing appliances for hygienic air or other hygienic physiological breathing mixtures. Only the breathing mixture specified by the manufacturer may be used to fill the cylinders for life-saving devices.
§ 13
Objects and location of mining rescue stations
(1) The intention of the disposition solution of the newly established main mining rescue station and its location and major changes to the existing main mining rescue station building is approved by the Czech Mining Authority. 3) The design of the available solution of the newly established mining rescue station building and its location and major changes of the existing mining rescue station object is assessed by the main mining rescue station and approved by the district mining office.9) The provisions of this paragraph shall also apply to training facilities (pipes, exercise stalls, training stations, etc.).
(2) Objects and equipment intended for mining rescue services cannot be used for purposes which would impede the performance of the mining rescue service.
(3) The object of the mining rescue station and the access routes to it must be marked significantly.

HLAVA I

BAN SAFEGUARDS
§ 14
Members of the Mining Rescue Corps
The members of the Mining Rescue Corps are mining rescue workers and other staff designated to carry out the tasks of the Mining Rescue Service.
§ 15
Mining Rescue Corps Main Mining Rescue Station
The members of the Mining Rescue Corps of the Main Mining Rescue Station are:
(a) the Director and his representative;
(b) the main mechanic and his representative,
(c) technicians, mechanics, sergeant or specialists, where appropriate;
(d) doctors qualified in the field of mining and medical rescue (21) qualified in the field of mining (hereinafter referred to as "doctors and medical paramedics"),
(e) other mining rescue workers,
(f) where appropriate, additional staff assigned to carry out the tasks of the main mining rescue station.
§ 16
Mining rescue corps of racing mining rescue station
(1) The members of the mining rescue corps are:
(a) the manager and his representative;
(b) the leading mechanic, his representative and, where appropriate, other mechanics;
(c) Sergeant,
(d) other mining rescue workers;
(e) other staff designated to carry out the tasks of the mining rescue station, as appropriate.
(2) The Mining Rescue Corps of the Mining Mine Mining Mining Mining Mining Mines, with the exception of the Lignite Mine, accounts for at least 4% of both the number and the irregularly phasing staff, but not less than 60 mining rescue workers. On the lignite mine and the coal quarry, the number of mining paramedics cannot be less than 18. In a mine with simple conditions and in the cases referred to in § 7 (1) (c), (d) and (e), the number of mining rescue workers may be reduced to 12. If it is a common mining rescue station (§ 7 (2)), it is necessary that the mining rescue workers of all or parts of these organisations are included in the Corps.
(3) The condition for the composition of the mining rescue corps of the mining mining rescue station is to represent the mining rescue workers of all necessary professions that may occur in rescue work.
(4) The race mine shall ensure that the list of members of the Mining Rescue Corps of the Mining Mining Rescue Station, indicating their name and surname, profession, residence, telephone number and call device and function in the Mining Rescue Corps, is available at the racing mining rescue station and at the dispatcher or at another location designated by the emergency plan. The amendments shall be included in the list without delay.
(5) The race mine shall ensure that mining rescue workers on the coal mine are appropriately divided into all working shifts, with the inspection service or dispatcher always informed of where the mining rescue workers present on the exchange are. At the same time, they will ensure that the exchange records of mining rescue workers are differently recorded.
§ 17
Mining Rescue Corps of the State Mining Administration
(1) The Mining Rescue Corps of the State Mining Administration consists of the Head of the Board, its representative and other selected mining inspectors qualified by the Mining Rescue Officer.
(2) The head of the Mining Rescue Corps of the State Mining Administration is appointed and withdrawn by the President of the Czech Mining Office.
(3) Head of the Mining Rescue Corps of the State Mining Administration
(a) establish the method of selection and the conditions for inclusion in the Mining Rescue Corps of the State Mining Administration and the pursuit of the activities of members of that Mining Rescue Corps;
(b) determine the number of members of the Mining Rescue Corps of the State Mining Administration;
(c) appoint a Deputy Head of the Mining Rescue Corps of the State Mining Administration and determine its rights and obligations.

HLAVA II

REQUIREMENTS FOR COMPETENT ELIGIBILITY OF BAN SAFETY
§ 18
Mining Rescue
(1) A mining rescue worker can be the one who
a) has reached the age of 21 and is medical11) for work in the Mining Rescue Corps;
(b) have completed basic training and practical training for mining rescue workers and successfully passed the final examination of mining rescue at the main mining rescue station;
(c) take the oath of a mining bailiff into the hands of the head of the main mining rescue station; members of the Mining Rescue Corps of the State Mining Administration take the pledge of the Mining Rescue Officer into the hands of the President of the Czech Mining Office. After the promise is made, he will receive a medical certificate.
(2) The medical fitness is assessed and the medical assessment is issued by the provider of occupational medical services (12) with whom the employer has a written contract.
(3) Basic training and practical training referred to in paragraph 1 (b) (c) 80 hours; for university graduates and for mining rescue workers who have not received practical training in the last 2 years, the Director of the Main Mining Rescue Station may reduce basic training and practical training to up to 40 teaching hours.
(4) A mining rescue worker cannot perform the tasks of the mining rescue service if:
(a) are not subject to periodic medical examinations at least once a year under the legislation governing medical fitness assessment14);
(b) not undergo an emergency medical examination where there is reasonable grounds for suspecting that a change in his state of health has taken place in the course of his or her medical fitness; or
(c) a medical opinion has been issued on the basis of the inspection carried out, with the conclusion that it is not fit to carry out the activity of a mining rescue worker.
(5) The mining paramedic shall maintain his professional competence by receiving training and practical training in the range of 1 shift at least once a quarter. This training includes the use of a breathing apparatus in a pipe and training for the use of a respirator; mining rescue workers working on a coal mine will also attend the heat chamber as part of this training. Once a calendar year, this training may be replaced by participation in respiratory interventions. The place of practical training and its conditions shall be governed by the training rules of the main mining rescue station (§ 30).
(6) A mining rescue worker under 45 years of age also loses competence if at least once every 18 months he does not perform a permanent emergency service at the main mining rescue station or at a racing mining rescue station with a permanent emergency; This does not apply to members of the Mining Rescue Corps of the State Mining Administration.
§ 19
Director of Main Mining Rescue Station and its Deputy
(1) The director of the main mining rescue station and its representative may be only a mining rescue worker who must have the professional qualifications obtained by passing a master's study programme in the field of mining or other technical field, professional experience in mining activities or activities carried out in a mining way for four years, of which at least two years of experience in the mining rescue corps, and successfully passed the examination of mining and other technical fields before the panel of the Czech Mining Authority (3). The verification of competence shall be carried out in accordance with Decree No. 298 / 2005 Coll., as amended.
(2) The director of the main mining rescue station and its representative are appointed and dismissed after discussions with the Czech Mining Authority) by its founder.
§ 20
Main mechanic of the main mining rescue station and its representative
(1) The main mechanic of the main mining rescue station and its representative may be a mining rescue worker who has a university education obtained by successful completion of at least a Bachelor's study programme in the field of engineering sciences or electrical engineering, with at least four years of professional experience, of which at least two years of rescue practice; in the case of a staff member with a secondary education with a graduate examination (15) in the field of mining or other technical field, the requirement of professional and rescue practice is doubled.
(2) The chief mechanic is appointed and removed from office by the Director of the Main Mining Rescue Station.
§ 21
Head of the racing mining rescue station and its representative
(1) Only a mining bailiff who has the professional qualifications obtained through secondary education with a graduate examination in the field of mining or other technical field, professional experience in mining or mining activities, or activities carried out in a mining manner for 6 years, of which at least two years of experience in the mining rescue corps, and successfully passed the mining rescue test before the commission of the district mining authority (10) may be the head of the mining mining mining mining and rescue centre. in the case of higher education in the field in question, the requirement for professional practice is halved. The verification of competence shall be carried out in accordance with a specific legislative act (3a).
(2) The head of a mining rescue station and its representative may be appointed or withdrawn by the organisation after consultation with the district mining office. The provisions for the post of head of the racing mining rescue station and its representative shall be notified without delay to the district mining office and main mining rescue station.
(3) A precondition for the performance of the function of the head of the mining rescue station and its representative shall be knowledge of the emergency plans of the organisations or parts thereof referred to in Section 7 (1) for which the mining rescue station is established or for which it operates the mining rescue service.
§ 22
