on the habilitation of docents and conditions and during the appointment of professors
The Ministry of Education, Youth and Sports of the Czech Republic provides according to § 35 paragraph 2 (b) of Act No. 172 / 1990 Coll., on Higher Education:

Conditions of habilitation
A professor for a particular field may become a candidate who has demonstrated teaching and scientific or artistic competence in the habilitation proceedings and has teaching experience.
Abatement procedure
(1) Accidental proceedings are carried out at a faculty or university which is not divided into faculties in which the subject of habilitation work or of a relative who is entitled to habilitation proceedings is taught and grown. 1) The departments in which habilitation proceedings take place determine the faculty status; in higher education, which is not divided into faculties, university status. The departments are designed by the scientific or artistic council of the faculty.
(2) The habilitation procedure is initiated by submitting habilitation work to the Dean of the Faculty. Part of the habilitation procedure is the defence of habilitation work and habilitation lecture.
(3) Abatement work means:
(a) written work bringing new scientific knowledge; or
(b) a set of published scientific works accompanied by a commentary; or
(c) a monograph issued by the press, which brings new scientific knowledge; or
(d) a work of art or artistic performance or a set of art, such as excellent public artistic activity.
(4) The applicant is obliged to submit:
(a) a CV;
(b) proof of higher education and the title concerned;
(c) evidence of obtaining academic degrees or degrees or other professional qualifications;
(d) an overview of the professional and pedagogical activities and the relevant evidence thereof;
(e) a list of scientific, professional or artistic works, textbooks and teaching texts or works of art or evidence of artistic performance;
(f) results of successful research tasks or discoveries and significant inventions and projects;
(g) results in the education of scientific or artistic staff.
(5) An exception to the provisions of paragraph 4 (b) may be provided for by the Arts Council of the Faculty, an exception to the provisions of paragraph 4 (c) by the Scientific or Artistic Council of the Faculty (hereinafter referred to as the Scientific Council of the Faculty).
(6) The Dean of the Faculty of habilitation with attached documents will return the applicants if
(a) not submit all the documents provided for; or
(b) it is a field in which there is no habilitation procedure at the faculty or university which is not studied at the faculty.
(7) In the event that the conditions laid down in paragraphs 3 and 4 are met, the Dean shall submit to the Faculty of habilitation work for consideration by at least three members of the habilitation committee.
(1) After approval by the Faculty's Scientific Council, the Dean of the Faculty shall be set up by the Habitats Committee. The members of the habilitation committee shall be professors or professors of the same or related field or significant experts. Only two members of the habilitation committee may be from a faculty or university which does not cover the faculty at which habilitation proceedings have been initiated. The chairman of the committee must be a professor.
(2) The Habitats Commission will appoint two opponents of the habilitation work from members of the Commission or other relevant experts capable of assessing habilitation work in the field concerned to produce opposition opinions. Only one opponent can be from the faculty or from a university which does not read into the faculty at which habilitation proceedings were initiated.
(3) The Commission will examine the documents submitted, the teaching experience, the teaching and scientific or artistic competence and, on the basis of the opposition opinions, evaluate the habilitation work and propose to the Scientific Council of the faculty
(a) terminate the habilitation procedure, stating the reasons; or
(b) to allow candidates for a habilitation lecture and to defend habilitation work.
(1) The applicant also demonstrates his teaching ability in the field through a habilitation lecture. The habilitation lecture is public and takes place before the habilitation committee and the scientific board of the faculty, which will determine its focus and duration.
(2) The level of the habilitation lecture will be evaluated by three members of the Scientific Council of the Faculty.
The defence of habilitation work takes place before the Scientific Council of the Faculty, the habilitation committee and the opponents; is not limited only to the topic of habilitation work, but has the character of a scientific debate with the applicant concerning the field of habilitation. The defense of habilitation is public.
Appointment by a lecturer
(1) The Scientific Council of the Faculty based on the evaluation of the habilitation committee, the opposition opinions of habilitation work, the evaluation of habilitation lectures, the outcome of the defence of habilitation work decides
(a) the termination of the habilitation procedure, which shall be notified together with its justification to the Dean of the Faculty; or
(b) to refer the proposal for appointment to the Dean of the Faculty by a lecturer with an indication of the field for which the candidate is to be appointed.
(2) The Scientific Council of the Faculty may decide to close the habilitation procedure even before holding a habilitation lecture and defending habilitation work on the basis of a proposal from the habilitation committee pursuant to § 3 (3) (a).
(3) The Dean of the Faculty shall notify the tenderer of the completion of the habilitation procedure, together with the reasons for the conclusion referred to in paragraph 1 (a) and paragraph 2.
(4) The Dean of the Faculty shall submit a proposal for appointment as a lecturer in accordance with paragraph 1 (b) to the Rector of the College. In universities which are not divided into faculties, a proposal for appointment by a lecturer under paragraph 1 (b) shall be submitted to the rector of the university by the Scientific Council of the College.
(5) The appointment decree is passed on to the appointed rector of the university; contains the name and surname of the person appointed, the field for which he was appointed, the university and the faculty at which the habilitation proceedings took place, the name of the habilitation work, the name and surname of the chairman and members of the habilitation committee and of the opponents and the date of effective appointment.
(6) The College shall notify the Ministry of Education, Youth and Sports of the Czech Republic (hereinafter referred to as the "Ministry") of the birth number, the titles of the newly appointed professor and the data referred to in paragraph 5.
MAKING PROFESSORIES
Conditions for appointment as professor
The professor of a particular field may become a candidate who has successfully habilitated on the basis of habilitation work under this decree or earlier regulations (2) governing habilitation proceedings, if the presentation of habilitation work was part of the habilitation procedure, is a prominent character in his field and is the author of significant scientific, professional or artistic work or works of art or works of art and is successful in the education of scientific or artistic workers.
Procedure for appointment
(1) The procedure for the appointment of a professor shall be initiated at the request of the candidate or of the President of the College or the Dean of the Faculty or of the Scientific Council of the Faculty or of the Scientific or Artistic Council of the College.
(2) The procedure for the appointment of a professor shall take place at a faculty or university which shall not be subdivided into faculties in which the subject of the appointment procedure or of the related field is taught and grown and which shall have the right to hold proceedings for the appointment of professors. 1) The departments in which the appointment procedure is held shall determine the status of the faculty; in higher education, which is not divided into faculties, university status. The field is designed by the scientific council of the faculty.
(3) The application or application to be appointed professor shall be submitted to the Dean of the Faculty. The application or application shall specify the field for which the tenderer is to be appointed.
(4) The application or application shall be accompanied by the documents referred to in Article 2 (4) (a), (b), (d), (f) and (g), and:
(a) a list of scientific, professional or artistic works supplemented by their foreign report, a list of textbooks and teaching texts or works of art or documents of artistic performance;
(b) the most important scientific, professional or artistic work, textbooks, teaching texts, documents on works of art or documents on works of art;
(c) proof of habilitation.
(5) The Dean of the Faculty shall return the application or application for the appointment of a professor with attached documents to the applicant if:
(a) the tenderer does not submit all the documents provided for; or
(b) it is a field in which no appointment procedure is held at the faculty or university which is not studied at the faculty.
(6) In the event that the conditions laid down in paragraphs 2 and 4 are met, the Dean of the Faculty shall submit a request or an application to be appointed professor for examination to at least three members of the Commission.
(1) The Dean of the Faculty shall, after approval by the Scientific Council of the Faculty, set up the Commission to examine the application or application for appointment as Professor. The members of the commission shall be professors of the same or related field or significant experts. Only two members of the committee may be from a faculty or a university which does not cover the faculty at which the appointment procedure was opened. The chairman of the committee must be a professor.
(2) The Commission will designate three opponents from members of the Commission or other relevant experts who are able to assess the most important scientific, professional or artistic and educational work of the applicant in the field in question in order to produce opposition opinions. Only one opponent can be from the faculty or from a university which does not cover the faculty at which the appointment procedure was initiated.
(3) Part of the appointment procedure is a public lecture in which the candidate presents in particular his concept of scientific or artistic work and teaching in the field. The lecture is public and takes place before the board and the scientific board of the faculty. The level of the lecture will be evaluated by mandated members of the Scientific Council of the Faculty.
(4) The Commission will evaluate the candidate's scientific or artistic and educational activities on the basis of the documents submitted, the opposition opinions and the lectures.
(1) The Scientific Council of the Faculty, in the presence of members of the commission and opponents, will decide on the basis of the evaluation of the commission, the Opponent's opinions, or the evaluation of the lecture
(a) the termination of the procedure for appointment by a professor who shall, together with his justification, notify the Dean of the Faculty; or
(b) on the referral of the proposal to be appointed by the professor designating the field for which the candidate is to be appointed to the Dean of the Faculty.
(2) The Dean of the Faculty shall notify the applicant of the termination of the procedure to be appointed by the Professor, together with the reasons for the decision of the Scientific Council of the Faculty referred to in paragraph 1 (a).
(3) The Dean of the Faculty shall submit a proposal for the appointment of a professor, together with the documents provided for in Section 8 (4), an evaluation of the commission, an opposition opinion and an opinion of the Scientific Council of the Faculty through the Rector of the University of Science Council.
(4) The Scientific Council of the College, in the presence of a representative of the Commission, shall discuss and examine the proposal for appointment as professor and shall decide:
(a) the completion of the procedure for appointment by the professor and the application, together with the documents submitted and the reasons for the decision, shall be returned to the Dean who shall inform the tenderer; or
b) the proposal to submit further progress to the Minister of Education, Youth and Sports of the Czech Republic through the Rector. 3)
(5) The application for appointment by a professor shall be accompanied by the following names and surnames:
(a) titles, birth number, permanent residence,
(b) a brief biography and evaluation of current scientific or artistic and educational activities;
(c) the list of works referred to in Section 8 (4) (a);
(d) proof of habilitation;
(e) a proposal for the field for which the tenderer is to be appointed.
COMMON, TRANSITIONAL AND FINAL PROVISIONS
The applicant may express his opposition to the course of the habilitation or appointment procedure from the point of view of the procedural objections raised by the Academic Chamber of the Faculty, in universities which are not subdivided into faculties, the Academic Chamber of the College. That authority shall deal with the objections within 30 days of their receipt.
The Scientific Council of the Faculty and the Scientific Council of the College shall, according to the rules of the meeting of the Scientific Council of the Faculty and of the Scientific Council of the College, which are set out in the Statutes of the Faculty and the Statutes of the College under Sections 28 and 29 of Act No. 172 / 1990 Coll., on Higher Education.
(1) In universities which do not study at the faculty, the duties of the Dean of the faculty are performed by the rector of the university and by the scientific or artistic board of the university.
(2) The condition for obtaining the title "Professor" for applicants who have obtained the scientific or artistic degree "Docent" according to earlier regulations without a habilitation procedure is prior habilitation under this decree without being appointed as a lecturer.
This Decree shall take effect on 1 November 1990.
