DECLARATION
of 23 November 2021
amending Decree No. 409 / 2005 Coll., on sanitary requirements for products in direct contact with water and for water treatment, as amended
According to Article 108 (1) for the implementation of § 5 paragraphs 1, 2, 8 to 10 of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended by Act No. 320 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll., Act No. 222 / 2006 Coll., Act No. 151 / 2011 Coll., Act No. 223 / 2013 Coll., Act No. 267 / 2015 Coll. and Act No. 202 / 2017 Coll.:
Decree No. 409 / 2005 Coll., on sanitary requirements for products coming into direct contact with water and for water treatment, as amended by Decree No. 352 / 2013 Coll. and Decree No. 339 / 2015 Coll., is amended as follows:
1. in Paragraph 2 (w), the words "; polymer materials based on elements other than carbon, such as silicones, shall also be regarded as plastics."
2. In Article 3 (2), the words "TOC and CHSKMn 'are replaced by the words" TOC, CHSKMn and mercury' and the words "and mercury 'are replaced by the words" and mercury'.
3. Paragraph 3 (6) reads as follows:
"(6) For the purposes of this Decree, the following additional hygiene limits for drinking water shall be laid down for the characteristics not covered by the Decree laying down sanitary requirements for drinking and hot water and the frequency and scope of the control of drinking water:

4. In Article 7 (1), the words "special legislation (5) 'are replaced by the words" Article 3 of Regulation (EU) No 1935 / 2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food and repealing Directives 80 / 590 / EEC and 89 / 109 / EEC'.

Plastic articles
Only monomers and other starting substances and additives listed in the list of monomers and other starting substances referred to in Article 11 of Commission Regulation (EU) No 10 / 2011 of 14 January 2011 on plastic materials and articles intended to come into contact with foodstuffs, as amended, may be used for the manufacture of plastics and products for contact with water. '
6. Paragraph 14 (3) reads as follows:
"(3) Depending on the quality of the raw water in a particular site, the treatment process, as verified by a test of the correctness of that water, supported by a laboratory, semi-operational or operational test, the duration of which must be demonstrated by the required water treatment efficiency, shall be applied. The following technological procedures may be used for water treatment:
(a) the removal of organisms on micro-nets;
(b) aeration of water;
(c) filtration on suitable material;
(d) water stabilization by means of water filtration through limestone or other deacidification material or by the dosing of lime or, where appropriate, by the dosing of carbon dioxide;
(e) one or two-stage de-irradiation and de-manganese treatment,
(f) one-stage separation, in particular by filtration through a layer of granular material;
(g) two-stage separation by classifying the first separation step before filtration with a layer of granular material;
(h) membrane separation subject to compliance with the requirements referred to in paragraph 2;
(i) adsorption on powdered or granulated activated charcoal and other sorption materials;
(j) oxidation of inorganic constituents using chlorine, sodium hypochlorite, calcium hypochlorite, chloride oxide, potassium peroxide, hydrogen peroxide or ozone;
(k) oxidation of organic compounds using ozone, potassium peroxide or their combinations in advanced oxidation processes with hydrogen peroxide, Fenton reagent, catalysts or UV radiation; these processes must be followed by the absorption of oxidising products on activated charcoal or slow biological filtration to maintain the biological stability of the water,
(l) slow biological filtration;
(m) pH adjustment,
(n) disinfection of water using chlorine, sodium hypochlorite, calcium hypochlorite, chloride oxide, chloramine or ozone;
(o) irradiation by ultraviolet radiation with a wavelength of 250-270 nm and a minimum dose of 400 J / m2 at the full volume of water, with 85% of the radiation output being at the wavelength of 253,7 nm for a monochromatic low-pressure lamp, or a wavelength between 200-400 nm and a minimum dose of 400 J / m2 for a polychromatic medium-pressure lamp, and subject to the other conditions laid down in the CSN 75 505050-3 Economics for water disinfection in water-based plants - Part 3: UV-radiation disinfection,
(p) ion exchange adjustment; or
(q) anti-corrosion protection by dosing of corrosion inhibitors, subject to compliance with the requirements set out in Part F of Annex 2. ';
7. In Annex 1, point 3 (b), "conductivity 'is replaced by" conductivity'.
8. In Annex 1, point 3, at the end of point (c), the dot is replaced by a comma and the following points (d) and (e) are added:
"(d) comparative water for sensory evaluation - water described by the test panel as completely free of odour and taste and used in sensory assessment of drinking water. The comparative water may be water of water, bottled drinking, spring or infant water, possibly packaged natural mineral water with low mineral content or prepared according to Annex D in ČSN EN 1622: 2007,
(e) carbonate solution - test water containing (222 ± 2) mg calcium chloride anhydrous and (336 ± 2) mg sodium bicarbonate per litre of test water; the pH must be adjusted to 7,4 ± 0,1 by bubbling air and / or CO2 according to EN 14944-1; it is used for the simulation of the ageing of cement-based products. ';
9. In Annex 1 (5) (b):
"(b) the test samples of cement-based products shall be prepared in the form of beams (40 x 40 x 160 mm) and kept in the manner specified in ČSN EN 196-1 Methods of testing cement - Part 1: Determination of strength; the maximum ageing time, unless the manufacturer determines a shorter ageing period, shall be 28 days, of which the test samples shall be stored in a carbonate solution for the last 8 days; the storage in the carbonation solution does not apply to test samples of material of the management type (scrapings, torcretes) for which the manufacturer assumes a shorter period between application and putting into service. After this period it is necessary to immediately start pre-cleaning and testing the samples; Test samples of cement-based smelting materials shall be prepared by applying the smelting material to the beams prepared according to the CSN EN 196-1 or with sand matted glass or compact cast plates of smelting material. The additives in cement-based products shall be tested by comparing the concentration of the determined constituents from reference samples prepared according to EN 196-1 with the concentration of the determined constituents from the same prepared samples to which the additive has been added. '
10. in Annex 1 (7) (c):
"(c) the migration of the determined substances from materials used for internal cement linings of pipes and water sinks shall be determined using test samples and test water to maintain the following ratio of the sample surface to the volume of test water S (cm2): V (cm3):
1: 1 for tubes having a diameter of less than 80 mm;
1: 2 for pipes with a diameter of 80 mm to 300 mm;
1: 8 in the case of pipes with a diameter of more than 300 mm or internal cement linings of water, '.
11. In Annex 1, point 7 (g), the words "test samples' shall be inserted after the words" quantity '.
12. in the second paragraph of point 8 (a) of Annex 1, the word "water" shall be inserted after the word "volume."
13. In Annex 1, point 9, at the end of point (b), the dot is replaced by a comma and the following point (c) is added:
"(c) the sensory test shall be carried out with one test sample and one check. The leaching shall be performed immediately after pre-cleaning of the test samples by immersing the surface of the test sample intended to come into contact with water or the whole test samples into a comparative water for sensory evaluation at the prescribed test temperature as referred to in (a). After the first and second leaching intervals, all leaching shall be poured into waste and immediately replaced by the same volume of fresh comparative water for sensory evaluation at the prescribed test temperature. Sensoric evaluation shall only be carried out from the third leachate. ';
14. In Annex 1 (14) (b):
"(b) the equipment shall be further tested as a whole when operating, in the case of a water flow under the manufacturer's specified conditions and using fresh water from the tap referred to in point 3 (a), to verify that:
(ba) the installation does not degrade the quality of the input water in microbiological and basic chemical indicators - to this end the quality of the input and output water is compared; the test shall be carried out on the installation after at least two weeks of operation; for determining the number of colonies at 22 ° C and 36 ° C, the first proportion of treated water (100 ml) after 16 hours of unworking water (approx. 100 ml) is taken after 16 hours of unworking water and 1 litre of discharging water, after which further draining of water shall be carried out for 1 minute and the establishment shall be left out of operation for 2 hours, then the first proportion of treated water (100 ml) shall be removed after 1 litre of discharging water to determine the number of colonies at 22 ° C and 36 ° C; the results of colony counts at 22 ° C in the input water shall not exceed 200 cfu / ml and colony counts at 36 ° C 40 cfu / ml, otherwise the test shall be repeated; the method of sampling described shall be carried out on flow-through devices, but if the tank is part of the device in which the treated water is accumulated and collected from there, a sample of the water shall be taken for the discharge from the accumulation tank after 16 hours of unoperation,
(bb) the equipment has the required 99,99% disinfectant effect; shall be verified only if the manufacturer has declared disinfectant.
Assessment: The values at 22 ° C and 36 ° C in the water at the outlet of the device shall not exceed 1000 cfu / ml. The addition of foreign substances shall not exceed 10% of the hygiene limit of the drinking water indicator monitored under the specific legislationm3). The calcium and magnesium content shall not be less than 10% of the input water value. In the case of a technology that reduces the content of dissolved substances and the hardness of water, which can only be used if the calcium and magnesium content is significantly higher than the upper limit of the recommended range of values laid down in the specific legislationm3), the minimum value of the calcium and magnesium content in the water laid down by the specific legislature shall be respected and the content of the dissolved substances shall be greater than 150 mg / l. '
15. Point 15 of Annex 1 reads as follows:
"15. The minimum range of specified indicators per heading of the most used types of material (selection of other specified indicators is made on the basis of the specific composition of each product submitted; if the laboratory does not include any of the components of the minimum range in the examination, it shall state the reason in the report):
(a) cast iron, iron:
Cr, Ni, Mn, Fe, Pb, As, Cd, pH, colour, opacity
(b) Galvanised steel:
Pb, Cr, Cd, Ni, Zn, pH, colour, taste
(c) Stainless steel:
Pb, Cr, Cd, Ni, Mn, pH, taste
(d) Copper:
Pb, As, Cu, Cr, pH, taste, TOC (for copper tubes)
(e) Brass:
Pb, Zn, Cd, Sb, Cu, Ni, Sn, pH, taste
(f) Bronze:
Pb, Zn, Cu, Cr, Cd, Ni, Sn, pH, taste, Al (aluminium bronze)
g) Rubber:
TOC, CHSKMn, Cd, Pb, Zn, Ba, phenols, pH, primary aromatic amines, smell, taste, color, opacity, PAU in case of use of soot as filler
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
(h) Polyethylene:
TOC, CHSKMn, pH, Pb, Cd, Ni, V, phenols, odour, taste, colour, other indicators according to additives (for coloured metal according to pigments used), PAU in case of use of soot as fillers, Ba, Co, Cu, Mn, Zn, primary aromatic amines
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
(i) Polyurethane:
TOC, primary aromatic amines, CHSKMn, pH, taste, odour, color, Cr, Pb, Cd, Ni, phenols, other indicators according to additives (for coloured metals by pigments used), Ba, Co, Cu, Mn, Zn, primary aromatic amines
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
(j) Polystyrene:
TOC, CHSKMn, taste, odour, colour, styrene, Pb, Cd, pH, other indicators according to additives (for coloured metals according to pigments used), Ba, Co, Cu, Mn, Zn, primary aromatic amines
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
(k) Polypropylene:
TOC, CHSKMn, pH, Pb, Cd, taste, odour, colour, other indicators according to additives (for coloured metal according to pigments used), PAU in case of use of soot as filler, Ba, Co, Cu, Mn, Zn, primary aromatic amines
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
l. Polyvinyl chloride:
TOC, CHSKMn, pH, Pb, Cd, vinyl chloride, phthalates (soft PVC), taste, odour, colour, other indicators according to additives (for coloured metal according to pigments used), Ba, Co, Cu, Mn, Zn, primary aromatic amines
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
m) Polyamide:
TOC, CHSKMn, Pb, Cd, primary aromatic amines, pH, taste, smell, color, other indicators according to additives (for coloured metals according to pigments used)
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
n. Epoxy resins:
TOC, CHSKMn, primary aromatic amines, Cd, Pb, Ba, Hg, PAU, phenols, pH, epichlorhydrin, colour, opacity, taste, volatile organic substances (mainly benzene, toluene, styrene, ethylbenzene, xylenes)
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
o) Paints:
TOC, CHSKMn, Cd, Pb, phenols, pH, colour, opacity, taste, volatile organic substances (mainly benzene, toluene, styrene, ethylbenzene, xylenes)
Recommendation: the presence of other organic substances to verify the quality of GC / MS (according to ČSN EN 15768).
(p) Cemented matter:
Cr, Pb, Ni, pH, Cd, Al, As, TOC, CHSKMn, ammonium ions, conductivity, opacity, colour, smell, taste
(q) Ceramics, silicates:
pH, colour, odour, taste, opacity, Pb, Cd, As, Ni, Cr, Al, TOC
r. Ion-exchangers:
- in the leaching: pH, conductivity, CHSKMn, TOC, Pb, Cd, Cr, smell, taste, colour, epichlorhydrin, styrene,
- recommendation: to verify the presence of other organic substances by qualitative GC / MS (according to ČSN EN 15768),
- verification of microbiological purity,
- Water flow test (comparison of water input values with water levels after passing through the filter bed): hardness, chlorides, sodium, nitrates, nitrites, pH, CHSKMn-
Note: No taste determination shall be made for hot water products. The pH value shall be determined to check that the test water has not been externally affected during the leaching. ';
16. In Annex 2, Part B, point 2. Iron sulphate, the second sentence of the maximum dose is deleted.
17. In Annex No 2, Part C, the following points 11 and 12 are added:
"11. Sodium sulphite
Chemical formula: Na2SO3
CAS No Nr.: 7757-83-7
Relative molecular weight: 126,04 g / mol
Description: odourless fine crystalline white powder; Water solubility: 250 g / l at 20 ° C. The product shall contain at least 95% sodium sulphite.
Note: At 100 ° C sulphur dioxide is produced. The concentration of sodium sulphate shall not exceed 5%.
Use: for disinfection of water
Maximum dose: 5 mg expressed as SO32- per litre of treated water and no more than 2 mg after adjustment has been completed.
Purity requirement: maximum impurities concentration (mg) per kg of sodium sulphite:

Description: Gross material (crushed dolomitic lime) or powder (ground dolomitic lime) containing at least 90% CaO + MgO; water solubility as calcium magnesium hydroxide: 1000 mg / l or calcium magnesium oxide: 1385 mg / l at 20 ° C.
Note: The aqueous suspensions are highly alkaline. Dolomitic lime reacts with water to form calcium magnesium hydroxide and with acids to form calcium salts. These reactions are exothermic.
Use: for pH adjustment
Maximum dose: 30 to 100 mg / l for mineralisation of treated water.

18. In Annex No 2, Part E, point 6, the word "chloride 'is replaced by" sulphate'.
19. In Annex 4, Part A, point 2, the words "4224, lactose-TTC agar with Tegitol 7, Slanetz-Bartley agar 'are replaced by the words" 7000, the media prescribed in the standards for the determination of E. coli (CSN EN ISO 9308-1) and E. faecalis (CSN EN 7899-2),';
20. In Annex 4, Part B, point 1:

A standard test according to ČSN EN ISO 8692 (757740) is used to test algicide products. '
Final provision
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decree shall take effect on 1 January 2022.
