DECLARATION
of 19 December 2022
amending Decree No 273 / 2021 Coll., on the details of waste management, as amended by Decree No 78 / 2022 Coll., and other related Regulations on waste management
The Ministry of the Environment shall determine, pursuant to Articles 6 (2), 9 (7), 17 (4) (a), 34 (7) (a), 35 (3), 37 (6) (b), 40 (5), 63 (6) (c) and (d), 67 (1) (b) (2), 67 (3), 69 (2), 69 (3) (m), 94 (2) and 95 (7) (c) of Act No 541 / 2020 Coll., on waste and pursuant to Article 50 (6), 51 (7), 69 (5) (b), § 108 (3) (c) and 109 (7) (d) of Act No 542 / 2020 Coll., on end-of Life Products:
Amendment of the Waste Details Order
Decree No 273 / 2021 Coll., on the details of waste management, as amended by Decree No 78 / 2022 Coll., is amended as follows:
1. in Paragraph 3 (3) (a):
"(a) equipped with a waste mass determination device with a periodic calibration at intervals of not more than 24 months, except:
1. the watering plant referred to in point 6 of Annex 4 to the Act;
2. small plants intended for the management of biodegradable waste;
3. installations receiving exclusively liquid waste for which volume and weight are collected may be calculated; and
4. by the end of 2030, in the case of mobile devices, weight determination may be carried out by other means, in particular by external weighing devices; in such a case, a clear method of identifying the weight of the waste from each donor must be set out in the operating rules, where the installation has it, ';
2. In Paragraph 6 (4), "2 'is replaced by" 3'.
3. In Article 6 (5), the words "paragraph 2 (a) and (c) and paragraph 3 'are replaced by the words" paragraph 3 (a) and (c) and paragraph 4'.
4. In the third sentence of Paragraph 14 (2), the word "exemption 'is replaced by" exemptions'.
5. In Paragraph 48 (2), "27 'is replaced by" 28' and "30 'is replaced by" 31'.
6. in Paragraph 50 (2) (b):
"(b) the input method - the output to be carried out by taking 10 samples at the entry within 30 days and 10 samples at the exit, the minimum time between each sampling at the entry being 48 hours; the sample at the exit shall always be taken from the same material as the corresponding sample taken at the entrance; the time between the sampling of the input and the corresponding output sample shall correspond to the time during which the material is subjected to the technological treatment process. ';
7. In Article 50 (3) (b), the words "(KTJ) 'and the words" < = 1 KTJ' are replaced by the words "less than 50 KTJ 'after the words" the colonies forming the unit'.
8. Paragraph 57, including the title, reads:
Requirements for verification of sludge treatment technology in terms of hygiene efficiency
(1) Verification of sludge treatment technology in terms of hygiene efficiency shall be carried out in the following cases:
(a) when the technology begins to operate; and
(b) after any change in technology which may affect the survival of pathogenic or conditionally pathogenic agents.
(2) Verification of sludge treatment technology in terms of hygiene efficiency is carried out
(a) a test for direct evaluation of the process in which introduced indicator micro-organisms Salmonella senftenberg W 775 - H2S negative or Escherichia coli are used; or
(b) the input method - the output to be performed by taking 10 samples at the input within 30 days and 10 samples at the output, the minimum time between each sampling at the input being 48 hours; the sample at the exit shall always be taken from the same material as the corresponding sample taken at the entrance; the time between sampling the input and the corresponding output sample shall correspond to the time during which the material is subjected to the technological treatment process.
(3) The sludge treatment technology complies with the verification requirements in terms of hygiene efficiency if, subject to the technological parameters laid down in the operating rules,
(a) the output from the technology meets the microbiological criteria set out for sludge of category I in Table 38.1 of Annex 38 to this Decree;
(b) the geometric mean of the number of colonies forming the unit (KTJ) in the introduced organism or in the method of entry - the output is reduced by at least 5 orders during the process; in the case where, on the basis of analyses of samples taken prior to processing, the geometric mean of the number of colonies of the monitored organism in the findings of 10 sludge samples for the entry method is less than 105 cfu per gram sludge for Escherichia coli or enterococci, the geometric mean of colony numbers in the post-treatment sample shall be less than 50 cfu per gram for Escherichia coli or enterococci.
(4) The sludge treatment technologies producing sludges meeting the microbiological criteria laid down for sludge of category I or II in Table 38.1 of Annex 38 to this Regulation are considered to be verified. '
9. In Paragraph 60, "58 'is replaced by" 59'.

Limits for concentrations of selected risk substances and elements in treated sludge and microbiological criteria for the use of treated sludge on agricultural land
(1) Sludges meeting the microbiological criteria laid down for sludge of category I or II in Table 38.1 of Annex 38 to this Decree are considered as modified.
(2) Only sludges may be used on agricultural land which:
(a) meet the microbiological criteria laid down for sludge of category I or II in Table 38.1 of Annex 38 to this Regulation; and
(b) do not exceed the limit values for the concentrations of selected risk substances and elements set out in Table 38.2 of Annex 38 to this Decree.
(3) Where the sludge complies with the concentration limits referred to in paragraph 2 (b) and only the microbiological criteria laid down for Category II sludge in Table 38.1 of Annex 38 to this Regulation, the following additional conditions shall be met when used on agricultural land:
(a) the use of sludge from waste water treatment plants processing animal by-products falling within the scope of the directly applicable European Union Regulation on animal by-products (27);
(b) there must be at least one winter period from the use of sludge to the harvest except for cultivation of crops which will be used exclusively for technical purposes; and
(c) on the part of the soil block where sludge is used, field vegetables, potatoes and intensive fruit planting shall not be grown for 3 years from the use of sludge. "
11. in Article 64 (2) (b), the words "o" shall be inserted after the words "including."
12. in Paragraph 79 (6), "2022" is replaced by "2025."
13. in the first and third sentences of Paragraph 80 (4), "and 2022" shall be replaced by "up to 2024."
14. in Paragraph 82 (5), "2023" is replaced by "2024."
15. in Paragraph 83 (2), the text of the introductory part of the provision reads:
"By 31 December 2024, recycling from construction and demolition waste as regards soil, natural quarry or inert mineral material recycling output which changes granularity and classifies into size fractions shall cease to be waste if it meets the following requirements. '
16. in Article 83 (2) (a), the words "17 05 04 or 17 05 08 originating from earlier construction works" shall be replaced by the words "17 05 04, 17 05 08, 19 12 09 or 20 02 02, originating from earlier construction works or large terrain."
17. in Paragraph 83 (2) (b) (8), the words "recycled slate removed from the site of use" shall be replaced by the words "recycling from construction and demolition waste collected from the site of use."
18. in Paragraph 83 (2) (b), the following point 9 is added:
"The 9th body of infrastructure carried out in accordance with technical standard CSN 73 6133 of 1 February 2010,"
19. In Annex 4, Part C:
"C. Dangerous waste which is prohibited from landfill because it is technically possible to process it in hazardous waste incineration plants or in installations for material or energy recovery of waste operated in the Czech Republic

23. In Annex 7, Table 7.1, "40 'is replaced by" 45'.
24. In Annex No 11, for waste code 17 03 02 in the name of waste, the words "ZAS- T1 and ZAS- T2 'are deleted.
25. In Annex 25, the following is inserted after the text under Table 25.5:
"For waste 19 08 05 sludges from municipal waste water treatment shall not apply to Category I sludges. '
26. Annex No 38 reads as follows:

27. The following shall be added at the end of Annex 39:
"In the case of sludge treatment technology which has been verified in terms of hygiene efficiency in accordance with the requirements of § 57 (1) to (3) and in the case of sludge treatment technology considered to be verified in accordance with § 81 (4), a microbiological analysis shall be carried out only twice per year. ';
Amendment of the Decree on Waste Catalogue and Assessment of Waste Properties (Waste Catalogue)
In Section 14 of Decree No. 8 / 2021 Coll., on Waste Catalogue and Waste Assessment (Waste Catalogue), the following sentence is added at the end of paragraph 1: "In 2024, instead of a sub-species of waste, waste is classified into the relevant waste type. In 2024, waste facilities or traders that can take over a sub-type of waste may take over the corresponding type of waste. ';
Amendment of the Regulation on details of the handling of end-of-life vehicles
In Article 10 (3) of Decree No 345 / 2021 Coll., on the details of the handling of end-of-life vehicles, the words "and 2022 'are replaced by the words" to 2024'.
Amendment of the Order on details of handling certain end-of-life products
Decree No. 16 / 2022 Coll., on the details of the handling of certain end-of-life products, is amended as follows:
1. In Paragraph 33 (1), "2022 'is replaced by" 2023' and "2021 and 2022 'is replaced by" 2021 to 2023'.
2. In Paragraph 33 (2), "2022 'is replaced by" 2024' and "2021 and 2022 'is replaced by" 2021 to 2024'.
EFFECTIVE
This Decree shall take effect on 1 January 2023.
