DECLARATION
of 6 December 2012
amending Decree No. 426 / 2005 Coll., on the details of licensing for business in the energy sector, as amended
According to Section 98a (2) (a) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 211 / 2011 Coll.:
Decree No. 426 / 2005 Coll., on the details of licensing for business in the energy sector, as amended by Decree No. 363 / 2007 Coll., Decree No. 358 / 2009 Coll. and Decree No. 392 / 2011 Coll., is amended as follows:
1. in Article 5, the following point (b) is inserted after point (a):
"(b) in the case of a power-generating facility, the data on each individual power-generating facility by which the power-generating facility is installed, the type of power-generating facility supported, the date of entry into service (if any) or the expected date of entry into service and the identification number allocated by the Authority when the decision to grant a power-generating licence was taken (if already allocated), ';
Points (b) to (e) shall be renumbered (c) to (f).
2. In Section 6 of the introductory part of the provision, the word "on 'is replaced by the word" v'.
3. In Articles 7 (1) and 7 (2), at the end of the text of point (a), the words "; the extract from the cadastral may be replaced by an indication of the number of the property sheet and the cadastral territory where the energy facility is located '.
4. in Article 9 (5) (c) (1):
'1. a territorial decision in respect of a construction or installation which does not require a building permit or notification; ';
5. in Article 9 (5) (c), the following points 3 and 4 are inserted after point 2:
'3. Public contract in respect of construction or installations which do not require a building permit or a declaration,
4. a regulatory plan in respect of construction or equipment which does not require a building permit or notification; ';
Points 3 and 4 shall become points 5 and 6.
6. In Paragraph 9 (5) (d), at the end of point 4, the dot is replaced by a comma and the following point 5 is added:
"5. another opinion of the competent building office or other credible way of demonstrating compliance with the conditions for the use or operation of the building pursuant to the building law5."
7. Paragraph 9 (6) is deleted.
8. Annex 3 shall read as follows:
