DECLARATION
of 1 November 2005
amending Decree No. 267 / 1999 Coll., on determining the amount of the recruitment allowance, the transfer and subsistence allowance and the procedure for granting travel and other allowances to professional soldiers, as amended
The Ministry of Defence provides pursuant to § 70, § 73 paragraph 1, § 78 and 89 of Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 254 / 2002 Coll.:
Decree No. 267 / 1999 Coll., determining the amount of the recruitment allowance, the transfer and subsistence allowance and the procedure for granting travel and other compensation to professional soldiers, as amended by Decree No. 44 / 2001 Coll. and Decree No. 457 / 2002 Coll., is amended as follows:
1. In § 2 (a), the amount "CZK 60" is replaced by "CZK 65."
2. in § 2 (b) the amount "90 CZK" is replaced by "95 CZK."
3. In § 2 (c) the amount "CZK 142 'is replaced by" CZK 145'.
4. In Article 5 (2), at the end of point (b), the comma is replaced by a dot and the word "a 'and point (c) are deleted.
5. Paragraph 5 (3) reads as follows:
"(3) The refund referred to in paragraph 1 shall be granted from the date of establishment of the service or from the date of transfer where the application for the refund is made within 30 days of the date of admission to service or transfer. Where an application has been submitted at a later date, the refund shall be granted from the date on which the application for a refund was lodged. ';
6. Paragraph 5 (4), including footnote 3, is deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
7. In Paragraph 5 (5), the words "Married Soldier 'are replaced by the words" Soldier'.
8. In Article 5a (1), the words "the allocation of which has been requested pursuant to Article 5 (2) (c) 'are deleted.
9. In Paragraph 5a, the sentence "Paragraph 5 (3) shall apply mutatis mutandis to the granting of compensation as in the course of a mission shall be added at the end of paragraph 2."
10. in Paragraph 6 (2), the words "the approval decision" shall be replaced by "any other written act on the basis of which the apartment is used."
11. in Article 6 (3) to (5):
"(3) A soldier moving into an apartment of which he is the owner, co-owner or tenant shall be granted a transfer allowance in accordance with paragraph 1 for a maximum of five rooms, one kitchen and one basic accessory; Where more than one soldier moves to an apartment owned, co-owned or rented by a soldier, they shall be granted an equal transfer allowance from the amount fixed in accordance with paragraph 1.
(4) When moving to an apartment where, after its approval, a soldier becomes its first owner, co-owner or tenant, and when moving to an apartment in sublet or apartment owned, co-owned or in the rental of his wife (spouse), partner (partner) or other person with whom he creates a common household, a transfer allowance equal to one half of the amount determined in accordance with paragraph 1 shall be granted; if more than one soldier moves to the apartment, they shall be granted an equivalent transfer allowance.
(5) The transfer allowance shall be paid to the soldier on a written request after the service authority has confirmed in writing, after assessing the facts contained in the request, that the transfer is in the important interest of the service. ';
This Decree shall take effect on 1 December 2005.
