DECLARATION
of 22 October 2025
amending Decree No. 92 / 2012 Coll., on Minimum Technical and Substantial Equipment Requirements for Medical Devices and Contact Points, as amended
The Ministry of Health provides pursuant to Section 120 of Act No. 372 / 2011 Coll., on Health Services and the Conditions for their Provision (Health Services Act), as amended by Act No. 65 / 2017 Coll. and Act No. 290 / 2025 Coll., for the implementation of Section 11 (6) of the Health Services Act:
Decree No. 92 / 2012 Coll., on the requirements for minimum technical and material equipment of medical facilities and contact centres, as amended by Decree No. 284 / 2017 Coll., Decree No. 339 / 2022 Coll., Decree No. 357 / 2024 Coll. and Decree No. 115 / 2025 Coll., is amended as follows:
1. in Annex No 2, Part I, Section A, point 9 (o), Annex 3, point 4 (p), Annex 4, Part I, point 19 (l), Annex 4, Part II, point 1.27 (e), Annex 4, point 3.3 (l), Annex 4, point 4.1 (c) and Annex 10, point 18 (e), the words "or ethylene oxide" shall be inserted after the words "formaldehyde."
2. In Annex 4, Part I., point 16 reads as follows:
"16. A room for the deceased can be shared for several departments of the medical facility. The room for the deceased must be secured against insect intrusion and its ventilation and silenced lighting must be secured. The room for the deceased must also be equipped
(a) a wash basin with a supply of cold and hot water, disposable paper towels or hand dryer;
(b) hand disinfectant,
(c) with disposable gloves,
(d) container for disposal of disposable equipment,
(e) a work desk,
(f) seat furniture. ';
3. In Annex 4, Part II, the following points 4.3.1 and 4.3.1.1 are inserted after point 4.3:
"4.3.1. If it is about providing long-term intensive nursing care to children, it is part of the equipment:
(a) a defibrillator,
(b) ECG apparatus,
(c) a monitoring centre;
(d) a transport fan;
(e) nebulisers 3 pcs per 5 beds,
f) pulse oxymeter 1 pcs per 5 beds,
g) rehabilitation height adjustable table at least 90 cm wide,
(h) hinge exercise equipment;
(i) a vertical table or other vertical equipment.
Equipment for beds:
(a) antidecubite washers or mattresses;
(b) the source of medical oxygen, central vacuum and pressure air - the distribution of vacuum is not required if the separation is equipped with electrical suction devices;
(c) vital function monitor (ECG / RESP, NIBP, SPO2);
(d) suction - not required if the central distribution is a vacuum,
(e) an enteral pump,
(e) infusion pump,
(f) 3 syringes.
Rooms for patients must be equipped with effective air conditioning and vacuum ventilation.
4.3.1.1. If the provision of long-term intensive nursing care for essential life functions to children whose medical condition requires artificial pulmonary ventilation, the equipment referred to in point 4.3.1 shall be supplemented by:
a) fans for artificial pulmonary ventilation 7 pcs per 10 beds,
b) fans for artificial pulmonary ventilation covering all patient ages 3 pcs per 10 beds.
In this case, the equipment for the bed shall be added:
(a) airway humidification equipment;
(b) infusion pumps 2 pc. ';
4. In Annex 4, Part II, the following point 4.4.1 is inserted after point 4.4:
"4.4.1. Where palliative care is provided to children, the equipment referred to in point 4.4 shall be supplemented by:
(a) positioning aids;
(b) airway humidification equipment;
(c) a plate monitor for the provision of health care to infants. ';
5. In Annex 4, Part II, the following point 6 is inserted after point 5:
"6. Hospital
6.1. For hospice requirements Part II, points 4.4 and 4.4.1 of this Annex shall apply mutatis mutandis.
6.2. The hospice shall have a final parting room which shall be equipped for the purposes of the decent parting of persons close to the deceased.
6.3. If hospital care is provided to children,
(a) suitable game therapeutic areas are established within the hospice;
(b) a room shall be set up for parents and close persons for the purposes of their rest separately from the hospitalised child;
(c) each patient must have a separate room, equipped with a bed for his escort. "
6. The following Annex 13 is added:
"Annex No 13
Requirements for technical and material equipment of a comprehensive childcare centre
1. The basic operating premises of the centre of comprehensive childcare are
(a) rooms for patients,
(b) the place of work of the doctor;
(c) an examination room with a minimum area of 8 m2,
(d) nurses' workplaces;
(e) the physical therapist's workplace;
(f) toilet and bathroom for patients,
(g) the day room for patients with suitable game therapeutic areas;
(h) dairy.
2. The secondary operating areas of the centre of comprehensive childcare are
(a) sanitary facilities for staff (4);
(b) storage facilities;
(c) the space for cleaning the equipment and for pouring out the biological material.
3. The patient room must have a minimum area of 1 bed of 5 m2, and a minimum area of 8 m2. For each bed there shall be a source of electricity and local lighting; There must be a communication device in the room between the patient and the nurse. The room must have direct daylight. Each room must have a sink if it does not have a connection to the toilet or bathroom equipped with a sink, as well as a dedicated room for eating walking patients, unless the dining room is set up separately. There shall be sufficient space between beds for the operation of the staff, patient movement and handling of equipment, material and beds.
4. Rooms for patients must be maximum double. If the patient or his legal representative, foster parent or other person in whose care the patient has been entrusted by decision of the court or other authority so requests, he must have a separate room equipped with a bed for his escort.
5. Equipment of the exam room:
(a) furniture for the work of medical and other professionals;
(b) an examination cot or bed,
(c) sink.
6. Sisters' facilities:
(a) nurses' furniture;
(b) a working counter with separate surfaces for the preparation of sterile material;
(c) the area for handling biological material;
(d) the communication equipment between the patient and the nurse;
(e) sink,
(f) sink for washing and cleaning equipment.
7. Facilities of the physiotherapist's workplace:
(a) a deck chair with adjustable height,
b) apparatus for passive and active exercise of momentum,
(c) equipment for sensory stimulation;
d) apparatus for electrotherapy, magnetotherapy or ultrasound therapy,
(e) a sink with a supply of cold and warm water.
8. The patient toilet is set up separately for men and women.
9. Storage facilities shall be established for separate storage of clean and dirty laundry, sterile material, waste, cleaning products and basins and bottles with the possibility of decontamination.
10. The space for cleaning the equipment shall be equipped with a sink or a sink and a dishwasher.
11. The premises of the comprehensive childcare centre, including corridors, must be designed in such a way that handling of the chair or chair or the patient's mobile bed is possible. This requirement shall not apply to adjacent premises.
12. Equipment of the centre of comprehensive childcare:
(a) couches the size of which is adapted to minors;
(b) anti-decubite washers or mattresses;
(c) heating pads,
d) vital function monitor (ECG / RESP, NIBP, SPO2) 1 pcs per 3 beds,
(e) chairs with handles,
(f) defibrillator,
(g) medicinal products and first-aid supplies, including cardiopulmonary resuscitation, i.e. self-opening bag including mask, air ducts, gloves, bleeding build-up equipment and venous entry devices;
(h) a crash cart for the storage of devices and medicinal products;
(i) a medicine cabinet,
(j) a storage refrigerator for medicinal products equipped with a thermometer when the medicinal products or devices which require a temperature below room temperature for their storage are stored and a storage refrigerator for biological material equipped with a thermometer when the biological material is stored;
(k) steriliser, where instruments and aids requiring sterility are used and the central sterilisation service or the supply of all materials for single use is not provided or all materials are not supplied sterilised. If formaldehyde or ethylene oxide sterilisation is used, the steriliser shall be located outside the performance room;
(l) vacuum cleaner,
(m) airway humidification equipment;
(n) inhaler,
o) shower bed or chair,
(p) a mechanical mobile chair,
(q) a transport cot or a stretcher for the transport of patients,
(r) positioning aids;
(s) lifting equipment for immobile patients;
(t) self-sufficiency training and functional mobility evaluation aids;
(u) the source of medicinal oxygen;
(v) infusion stand,
(w) infusion pump,
x) syringe dispensers,
(y) glucometer,
z) tonometer,
(aa) fonendoscope;
(ab) a thermometer,
(ac) a breath panel monitor for providing health care to infants,
ad) changing counter and baby bath if the centre of comprehensive care is provided to infants,
(ae) a computer and a single data repository connected by the data network and the printer; a single data repository may be common to several workplaces or the whole medical facility,
(af) connection to a replacement power source. ';
Transitional provision
The health service provider, which has at its health care facility at the date of entry into force of this decree set up a room for the deceased, shall comply with the requirements set out in Part I. point 16 of Annex 4 to Decree No. 92 / 2012 Coll., as effective from the date of entry into force of this decree, until 31 December 2026.
Efficacy
This Decree shall take effect on 1 January 2026.
