DECLARATION
of 18 December 2023
amending Decree No. 156 / 2008 Coll., on improving the professional competence of drivers and amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 379 / 2020 Coll.
The Ministry of Transport provides, pursuant to Article 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., Act No. 374 / 2007 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 64 / 2014 Coll., Act No. 230 / 2014 Coll., Act No. 199 / 2017 Coll., Act No. 191 / 2021 Coll. and Act No. 271 / 2023 Coll., implementing Section 52j (7) of that Act:
Decree No. 156 / 2008 Coll., on improving the professional competence of drivers and amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 379 / 2020 Coll., is amended as follows:
1. In Article 1, at the end of point (m), the dot is replaced by a comma and the following points (n) to (p) are added:
"(n) the content and manner of training of starting drivers and the maximum number of participants;
(o) the model of the certificate of completion of training for starting drivers; and
(p) the method of keeping records of the training of starting drivers. ';
2. in Part One, the following Title IV is inserted after Title III:
DETERMINATION OF THE COMPETENT ELIGIBILITY OF THE ROADER PARTICIPATION IN TRAINING THE STARTING ROAD
Content and manner of training for start-up drivers
(K § 52j (7) of the Act)
(1) Teaching is focused on:
(a) analysis of the conditions and causes which led to the creation of an infringement of the training participants in relation to the principles of defensive and cooperative driving;
(b) analysis of factors affecting road safety, in particular mental state, fatigue and influence of alcohol and other addictive substances;
(c) information on relations between road users with an emphasis on particularly vulnerable participants, rules on cooperative driving and an emphasis on their respect; and
(d) the social and economic consequences of the infringement of road users.
(2) Training is focused on:
(a) the technique of correct driver seating and the driver's view from the vehicle, the use of vehicle controls, including advanced assistance and safety systems and information on driving;
(b) monitoring and evaluation of the situation in different traffic intensities, compliance with operating rules and procedures leading to risk minimisation;
(c) the ability to anticipate and respond correctly to dangerous situations in service;
(d) a defensive and cooperative way of driving in conditions close to those in which a serious infringement of road traffic rules has occurred; and
(e) economic driving and use of the vehicle with regard to the environment.
(3) The assessment of driver behaviour during training shall be aimed at:
(a) analysis of errors and deficiencies in driving the vehicle, reference to correctly handled situations, warning of the possibility of improving driving skills;
(b) warnings on the risks encountered during training and on other risks associated with the participation of particularly vulnerable road users;
(c) a lesson on the consequences of road users' infringements; and
(d) provision of advice to develop driver behaviour patterns to avoid repetition of road traffic infringements.
(4) The training and evaluation of driver behaviour in training takes place individually and on a single day. The assessment of the driver's behaviour shall be followed immediately after completion of the driver's training.

The maximum number of participants in the training of starting drivers is 12 persons.

The model of certificate of completion of the training of starting drivers is set out in Annex 11 to this Decree.
Record keeping of training of starting drivers
(K § 52j (7) of the Act)
(1) Evidence of training of start-up drivers is kept by the driver's operator in:
(a) a ledger on teaching and evaluation; and
(b) a register of training in driving under another legislation (18).
(2) The book of evidence of teaching and evaluation shall contain information on the teaching carried out and the assessment of driver behaviour in training, which shall be:
(a) the name, surname and date of birth of the trainee;
(b) the date and time of commencement of teaching; and
(c) the date and time of completion of the assessment of driver's behaviour during training.
(3) The register of vehicle driving training shall contain data on the training carried out, which shall be:
(a) the name, surname and title of the trainee, if any;
(b) the date of completion of the training in driving the vehicle;
(c) the status of the training vehicle's mileage counter before the start of the training in the driving of the vehicle and the time at which the training begins in the driving of each training participant; and
(d) the status of the mileage counter of the training vehicle after completion of the training in the driving of the vehicle and the time of completion of the training in the driving of each training participant.
(4) The correctness of the data entered in the register of training for starting drivers is confirmed by the training participant's signature. The signature of the trainee in the log book on teaching and evaluation shall be made immediately after completion of the assessment of the driver's behaviour during training. The signature of the trainee in the register of training in driving shall be made immediately after completion of the training.
(5) Corrections to entries in the register of initial training may be made only by crossing out the data and writing down the new data so that both the original and the new text can be read. Each repair shall be dated and signed by the person who made the repair.
(6) Evidence of training of start-up drivers may also be kept in electronic form. In such a case, the signature of the trainee shall be taken by means of a signature scanner or similar device enabling the digital recording of the signature, including the date of its acquisition, shall be entered directly in the electronic register.

3. The following Annex 11 is added:

This Decree shall take effect on 1 January 2024.
